HomeMy WebLinkAbout13834 ORD - 07/13/1977AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A TWO -YEAR AGREEMENT, EFFECTIVE SEPTEMBER 1, 1977, WITH THE TEXAS OFFICE OF THE GOVERNOR TO PROVIDE FOR RECONFIRMATION OF THE CITY OF CORPUS CHRISTI AS THE METROPOLITAN PLANNING ORGANIZATION FOR THE CORPUS CHRISTI URBANIZED AREA AND TO COMPLY WITH THE FEDERAL -AID HIGHWAY ACT OF 1973, ALL AS MORE FULLY SET,FORTH IN THE AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a two -year agreement, effective September 1, 1977, with the Texas Office of the Governor to provide for reconfirmation of the City of Corpus Christi as the Metropolitan Planning Organization for the Corpus Christi urbanized area and to comply with the Federal -Aid Highway Act of 1973, all as more fully set forth in the agreement, in substantially the form attached hereto marked Exhibit "A ", and made a part hereof for all pertinent purposes. SECTION 2. The necessity to authorize execution of the aforesaid agreement in order that the City may be reconfirmed as the Metropolitan P,lanning Organization for the Corpus Christi urbanized area and thereby receive funds needed to continue the transportation planning program in the Corpus Christi area creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read'at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY . ATTEST: 0;11,� City Secretary MA Y 0 R N: APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS L 3 DAY OF JULY, 1977: MICROALMED `llll /J JUL 0 7 Ciiy Attorney /',/ i/ " / X980 13834 AGREEMENT STATE OF TEXAS COUNTY OF TRAVIS THIS AGREEMENT made this day of A.D., 1977, by and between the Texas Office of the Governor, acting by and through the Director of the Budget and Planning Office, Party of the First Part, and the City of Corpus Christi Party of the Second Part: WITNESSETH WHEREAS, the Federal -Aid Highway Act of 1973 in Section 112 allocates, for the first time, planning funds to Metropolitan Planning Organizations to support the urban transportation planning process; and WHEREAS, the Federal Highway Administration (in accordance with Section 112 of the Federal -Aid Highway Act of 1973) and the Urban Mass Transportation Administration (in accordance with Section 9 of the Urban . z. Mass Transportation Act of 1964, as amended) intend to fund the same designated metropolitan planning organization in each metropolitan area; and WHEREAS, the Federal Aviation Administration intends to consider this agency for the receipt of airport system planning funds under Section 13 of the Airport and Airway Development Act of 1970; and WHEREAS, it is the desire of the parties that urban transportation planning be integrated to the maximum extent possible with other areawide planning in the metropolitan area; and WHEREAS, the successful implementation of urban transportation planning requires the assistance and concurrence of all local governments in the metropolitan area. EXHIBIT "A" NOW THEREFORE, it is hereby agreed that the use of funds made available under Section 112 of the Federal -Aid Highway Act of 1973 shall be governed by the organization and responsibilities as set out in the following paragraphs: I. Organization The City of Corpus Christi shall be the Metropolitan Planning Organization for transportation planning in the Corpus Christi urbanized area. The Metropolitan Planning Organization shall: A. Develop or assist in the-development of a multi -modal transportation planning process. Prepare a Unified Work Program which would specify the use of Section 112 funds or in those regions where a Unified Work Program is not required, prepare a plan for the use of these monies, and submit the Unified Work Program or plan for approval to the Steering Committee established pursuant to Section 134 of Chapter 1 of Title 23 United States Code. B. Insure that transportation planning in the urbanized area is successfully coordinated and integrated with other i comprehensive planning in the State Planning Region. C. Use the Steering Committee structure established pursuant to Section 134 of Chapter 1 of Title 23 U.S.C. as the group giving the Metropolitan Planning Organization overall transportation policy guidance. II. Section 112 of the 1973 Federal -Aid Highway Act authorizes additional funds for the purpose of carrying out the provisions of Section 134 of Chapter 1, of Title 23 U.S.C. Therefore, first consid- eration for the distribution of Section 112 funds will be given to planning efforts being conducted by cities, counties and regional councils of governments who are assigned responsibility for basic elements of the Urban Transportation Study Agreements established by the State Department of Highways and Public Transportation pursuant to Section 134 of Chapter I of Title 23 U.S.C. III. This 'agreement shall in no way establish any activity or process that would infringe upon or interfere with the statutory obligation of the State Department of Highways and Public Transportation. IV. The Metropolitan Planning Organization will contract with the State Department of Highways and Public Transportation for Section 112 Planning Funds. The expense involved in urban transportation planning will be assumed by the Metropolitan Planning Organization or agencies with which the Metropolitan Planning Organization has sub - contracted to accomplish work identified in the approved Unified work Program or plan for the use of Section 112 funds. Vouchers for completed work under the annual Unified Work Program or plan for use of Section 112 will be audited and approved by the State Department of Highways and Public Transportation according to federal and State requirements. Reimbursement will be made on a periodic basis. V. This agreement may be renegotiated as necessary to meet changing conditions or terminated by either party. VI. This agreement will terminate on August 31, 1979. Renegotiation for renewal of the designation may begin after May 31, 1979. Then by mutual agreement this agreement may be renewed for a two -year period. IN WITNESS WHEREOF, the Parties have hereunto affixed their signatures on the dates indicated. A RESOLUTION BY THE CORPUS CHRISTI URBAN.TRANSPORTATION STUDY STEERING COMMITTEE ENDORSING THE CONTINUED DESIGNATION OF THE CITY OF CORPUS CHRISTI AS THE METROPOLITAN PLANNING ORGANIZATION FOR THE CORPUS CHRISTI URBANIZED AREA WHEREAS, the existing Agreement between the Governor's Office and the City of Corpus Christi designating the City as the Metropolitan Planning Organization for the urbanized area expires August 31, 1977; and WHEREAS, the City of Corpus Christi, in the capacity of the Metropolitan Planning Organization; has duly .carried out the responsibilities of the areawide transportation planning agency, in cooperation with the State Department of Highways and Public Transportation; and WHEREAS, the Governor's Office has requested the Steering Committee's concurrence in the continued designation of the City of Corpus Christi as the Metropolitan Planning Organization; and WHEREAS, such designation is necessary to enable the City of Corpus Christi to continue receiving transportation planning funds pursuant to Section 112 of the Federal -Aid Highway Act of 1973; NOW, THEREFORE, BE IT RESOLVED that the Corpus Christi Urban Transportation Study Steering Committee representing the Cities of Corpus Christi and Portland, the Counties of Nueces and San Patricio, and the State Department of Highways and Public Transportation hereby concurs with the designation of 8 the City of Corpus Christi as the Metropolitan Planning Organization for the urbanized area.
