HomeMy WebLinkAbout13847 ORD - 07/20/1977JKH:vmr:7- 18- 77;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A THREE- YEAR LEASE AGREEMENT WITH THE CORPUS CHRISTI.HOUSING AUTHORITY FOR THE CONTINUED USE AND OCCUPANCE OF AN APARTMENT LOCATED AT 3312 WAYSIDE DRIVE, CLAIRELAINE _ GARDENS, CORPUS CHRISTI, TEXAS, FOR THE PURPOSE OF PROVIDING A•CENTER THROUGH WHICH THE CITY'S SENIOR COMMUNITY SERVICES PROGRAM MAY PROVIDE OUTREACH, REFERRAL, RECREATION, AND OTHER SUPPORTIVE SERVICES TO THE OCCUPANTS OF CLAIRELAINE GARDENS AND ALL THE SENIOR CITIZENS OF THE COMMUNITY, AND TO EXECUTE THE OPTION PROVIDED FOR IN SAID LEASE AGREEMENT, ALL AS rt MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A '; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to enter into a three -year lease agreement with the Corpus 1 Christi Housing Authority for the continued use and occupancy of an apart- ment located at 3312 Wayside Drive, Clairelaine Gardens, for.the purpose of providing a Center through which the City's Senior Community Services Program may provide outreach, referral, recreation, and other supportive services to the occupants of Clairelaine Gardens, in the City of Corpus Christi; as well as all other senior citizens of the community, and to execute the option provided for in the said lease agreement, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A'. SECTION 2. The necessity to authorize execution of the afore - said lease in order to continue providing a Center for the senior citizens of the City and of the community, as hereinabove set forth, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared MICROFILMED 13847 JUL 0 71980 such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after s passage, IT IS ACCORDINGLY SO ORDAINED, this the �' day of , 1977. BRUCE AYCOCK, CITY ATTORNEY Assistant CiW Attorney s` STATE OF TEXAS COUNTY OF NUECES This Agreement, made and entered into this th day of July, 1977, by and between the Housing Authority of the City of Corpus Christi, Texas, a'public body organized and existing under the Laws of the State of Texas, acting herein through the Chairman of the Board, Mr. Orby G. Roots, and duly authorized by Resolution 'of the Board of Commissioners of the Housing Authority adopted on,July 13, 1977, (hereinafter called "The Authority "), and the City of Corpus Christi, a municipal corporation, body politic and home rule city operating under the home rule statutes of the State of Texas, acting herein through the City Manager, (hereinafter called "Lessee "). WITNESSETH: That the Authority has agreed to let and hereby does let to the Lessee the use and occupancy of an apartment located at 3312 Wayside Drive, Clairelaine Gardens, Corpus Christi, Texas, for the sole pur- 1 pose of providing a center through which the Senior Community Services may provide outreach, referral, recreation, and other supportive ser- vices to the occupants of Clairelaine Gardens and all the senior citi- zens of the community. That no alteration shall be made to the building or the premises without prior written approval by the Authority. The Lessee shall pay directly to the Central Power and Light Company the cost of electricity for lighting, air- conditioning and any other uses on the premises; the Lessee shall be responsible for all janitorial service and for payment to the Authority for breakage or damage resulting from negligence of staff or participants, normal wear and tear excluded. The lessee shall furnish all supplies and materials utilized in the Services. That the Authority shall maintain the structure and lawn area, but furnish no office equipment or special equipment, only the range, refrigerator, piano, and tables and chairs presently located in the apartment. The Authority shall furnish water, and gas for area bs ating and water heating. That the Lessee shall provide on —site personnel on week days for scheduling and directing on —going activities and other activities deemed to be of benefit to the senior citizens of the community. That this Agreement shall extend for a period of three (3) years unless terminated by either party giving thirty (30) days written prior notice of intent to terminate this Agreement. Lessee shall have and is hereby granted an option to extend said Agreement for an additional three (3) year period. To exercise such option the Lessee shall give Lessor written notice of such intention to renew at least thirty (30) days prior to the expiration of this Agreement.
