Home My WebLink About13854 ORD - 07/27/1977jkh:7- 26 -77; 1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE COOPERATION AGREEMENT WITH THE HOUSING AUTHORITY OF THE CITY OF CORPUS CHRISTI FOR THE CONSTRUCTION, MAINTENANCE AND OPERATION OF AN ADDITIONAL 300 LOW -RENT HOUSING UNITS IN THE CITY OF CORPUS CHRISTI, TEXAS, ALL AS MORE FULLY SET FORTH THE AMENDMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. .WHEREAS, the Housing Authority of the City of Corpus Christi has 4 heretofore been authorized to construct and operate a total of 1970 units of low -rent housing in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, the Local Authority and the City desire to amend the Cooperation Agreement to authorize an additional 300 units of low -rent housing; and WHEREAS, the Local Authority and the City contemplating an amendment to the Cooperation Agreement, caused notice of said intention to enter into said amended Agreement to be published on May 28, 1977, and May 31, 1977, pursuant to Article 1269 (L), Section 7A, Vernon's Revised Civil Statutes: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an Amended Cooperation Agreement with the Housing Authority of the City of Corpus Christi for the construction and operation of low -rent housing in the City of Corpus Christi, all as more fully set forth in the Agreement, a substantial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to enter into the aforesaid agreement at the earliest practicable date in order to provide additional low -rent housing in the City of Corpus Christi creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take MICROFILMED X3854 JUL 0 71980 effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the -($— of July, 1977. BRUCE AYCOCK, CITY ATTORNEY By Av&&& Assistant Cit4 Attorney 13854 \ Q AMENDMENT TO COOPERATION AGREEMENT THIS AMENDMENT, made and entered into this day of , 1977, by and between the Housing Authority of the City of Corpus Christi, Texas, (herein called the "Local Authority ") and the City of Corpus Christi, Texas (herein called the "City ") and for such WITNESSETH that: WHEREAS, the Local Authority has heretofore been authorized to construct and operate a total of nineteen hundred seventy (1970) units of low -rent housing in the City of Corpus Christi, Nueces County, Texas, and, WHEREAS, the Local Authority and the City desire to amend the Cooperation Agreement to authorize an additional three hundred (300) units of low -rent housing and, WHEREAS, the Local Authority and the City contemplating an amendment to the Cooperation Agreement, caused notice of said intention to enter into said amended Agreement to be published on May 28, 1977, and May 31, 1977, pursuant to Article 1269 (L), Section 7A, Vernon's Revised Civil Statutes; NOW, THEREFORE, in consideration of the premises and the mutual benefits to the parties hereto, it is hereby agreed that the contract be and is hereby amended as follows: 1. Page 2, Section 2 is amended to read as follows: The Local Authority is hereby authorized to construct, maintain and operate a total of twenty two hundred seventy (2270) units of low -rent housing in the City of Corpus Christi, Nueces County, Texas. Except as herein amended, all other provisions of the amended Cooperation Agreement of June 11, 1971 shall remain in force and effect. IN WITNESS WHEREOF,,the City and Local Authority have respectively caused this amended Agreement to be duly executed as of the day and year first above written.
