HomeMy WebLinkAbout13863 ORD - 08/03/1977= -- dkh:7- 19 -77; 1st - -- — - - AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, AS AMENDED, BY AMENDING SECTION 19 -77, PHYSICAL EXAMINATION OF APPLICANT; UALIFICATIONS OF EXAMINING PHYSICIAN. SUBSECTION b SO AS TO PROVIDE FOR EITHER X -RAY OR A TUBERCULIN SKIN TEST TO DETERMINE THE PRESENCE OF TUBERCULOSIS WHEN APPLICANTS APPLY FOR FOODHANDLER'S PERMITS; AMENDING SECTION 19 -80, FEE - -FOR ORIGINAL. SO AS TO PROVIDE FOR A $2.50 CHARGE FOR THE ISSUANCE OF A SIX- MONTH'S TEMPORARY "FOODHANDLER'S PERMIT; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances, City of Corpus Christi, 1976 Revision, as amended, be amended by amending Chapter 19 thereof, relating to food and food establishments, by amending Section 19 -77, subsection (b), to hereafter read as follows: "(b) A careful examination of such person shall be made for tuberculosis by means of a seventy (70) millimeter photofluorograph X -ray of the chest or a tuberculin skin test or both, at the discretion of the ` examining physician. If the tuberculin skin test is positive, the furnishing of a photo•fluorographshall be mandatory. If there is in the opinion of the " physician, evidence of possible active tuberculosis in the miniature photo - fluorographic films, then at his discretion a fourteen (14) by seventeen (17) inch X -ray may be required of the applicant, the resulting report of which must be in writing and on file in the foodhandler's section of the health division of the department of public health before issuance of a foodhandler's Permit." SECTION 2. That Section 19 -80 of the Code of Ordinances, City of Corpus Christi, be amended to hereafter read as follows: "Sec. 19 -80. Fee - -for original. There shall be a charge made of Two Dollars and Fifty Cents ($2.50) for the issuance of a six (6) months temporary foodhandler's permit and a charge of Four Dollars ($4) for a one -year permanent foodhandler's permit, and MICROALMED 18�� 'JUL 0 7 19E0 a the revenues derived from the issuance of such permits shall be used to defray the expenses of issuing such permits and the keeping of the necessary files and records in regard to foodhandlers' permits." SECTION 3. That all ordinances or parts of ordinances in conflict herewith be and the same are repealed to the extent of such conflict. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made in the official publication of the City of Corpus Christi, one time, which publication shall contain the caption stating in substance the purpose of the ordinance.
