EXHIBIT = "A" Instructions for the Use and Revision of the Compensation and Classification Plan The Compensation and Classification Plan has been coded and indexed for the purpose of simplifying reference and revision procedures. The revised coding system assigns a numeric code to each section, subsection, and paragraph. Indexes correspond to each major section number for easy reference. The numbers of the first and last section or subsection on each page appear in the top right -hand corner. The first number designates a continuation of a section or subsection if applicable. Revised pages will be released through Distribution "B" with instructions to replace certain pages with revised copies. Pages may also be added without altering the overall numerical sequence. In addition to the specific qualifications as set forth in the class specifications, it shall be understood that all positions require: ability to read, write, speak, and understand the English language and to follow written and oral instructions; ability to get along with others; thoroughness, accuracy, sobriety, integrity, loyalty, and a record of orderly law- abiding citizenship. 103 Adoption of the Classification Plan The classes of positions, as set forth in Section 250 of this article and the specifications for the respective classes, are hereby adopted and shall constitute the classi- fication plan on the basis of which all positions in the classified service shall be classified. All such classi- fied positions and incumbents thereof shall be subject to the provisions of Civil Service in accordance with State law, the City Charter, ordinances and rules and regulations of the Civil Service Board. Sect. 150 150/151.5 150 APPLICATION AND INTERPRETATION OF CLASSIFICATION PLAN 151 Allocation of Existing Positions 151.1 The positions in the classified service are hereby allocated to appropriate classes in accordance with the schedules attached hereto entitled: "Allocation and Application of the Classification Plan to Existing Positions." 151.2 Each employee shall be notified of the allocation of his position, and each employee having satisfactorily served in a classified position for six months or more is hereby given civil service status in such position provided that in the police and fire service no promotions in rank shall be achieved except in accordance with the rules on promotions in the Police and Fire Departments. 151.3 Any employee who has not served as provided above may be certified by the Civil Service Board in his position after either a qualifying examination or competitive exami- nation, written or unassembled, as considered appropriate. The Civil Service Director shall review each case and submit recommendations to the Civil Service Board on the action to be taken. 151.4 Any employee who has civil service status and is occupying a position not in the classified service as specified in Section 250 of the Article shall retain such status for purposes of tenure. The title of the position, however, shall be changed to conform with that title established by ordinance in the unclassified service and the salary rate shall be adjusted in accordance with the salary schedule prescribed for such position provided that no decrease in salary of the employee shall occur. 151.5 Any employee who has civil service status and is occupying a position in the classified service at a lower level than that indicated by his present title, grade, and salary shall retain such present title, grade, and salary until such time as a change is made in accordance with the Civil Service processes prescribed in the rules relative to promotion, demotion, or transfer. 152/152.3 152 Interpretation of Class Specification 152.1 Purpose and Effect of Class Specifications: Each class specification outlines the main characteristics and qualification requirements of positions in the class and gives examples of specific duties which employees holding such positions may properly be required to perform. The class specification is descriptive and explanatory but not restrictive. The listing of particular examples of duties does not preclude the assignment of other tasks of related kind or character or of lesser skills. 152.2 Application of Specifications to Positions: In determining the class to which a position shall be allo- cated, the specifications of each class shall be considered in its entirety and in relation to the specifications of other classes in the classification plan. 152.3 Statements of Desirable Qualifications: The statement of minimum qualifications in a class specification is intended to be used in determining the eligibility of candidates for admission to competitive examinations, as an aid in the preparation of such examinations, and for use in determining the relative value of positions in a class with positions iin other classes. Sect. 200 200/203 200 ADMINISTRATION AND MAINTENANCE OF THE CLASSIFI- CATION PLAN 201 Responsibilities of the Civil Service Director 201.1 The Civil Service Director shall be responsible for administering and maintaining the classification plan. As directed by the Civil Service Board, the Director shall make necessary reviews and prepare reports recommending appropriate actions to assure that the classification plan is kept current and that any important changes in duties and responsibilities in any existing position and of new positions are reflected in the classification plan. 201.2 The Civil Service Director after consultation with the City Manager, or his designated representative, and the department officials concerned, shall recommend for the action of the Civil Service Board the reallocation of any position from one class to another class whenever a change in duties and responsibilities of such position make the class to which the position was previously allocated no longer applicable. Any proposed reallocation shall be made with the knowledge of the employee concerned. 202 Changes Requiring Approval of the City Council The approval of the City Council shall be obtained through the City Manager on any action affecting the pay of employees or other matters included in the City Compensa- tion Ordinance which are not within the powers and authority of the Civil Service Board as prescribed by the Charter or State law. 203 Employee Requests for Classification Adjustments Any employee shall have the right to consideration by the Civil Service Board of any request that he may have with respect to a change in the classification of his position. The employee shall make his request initially to the head of his department who shall promptly seek to arrive at a solution which is consistent with the classification plan and acceptable to the employee. When the department head is unable to resolve such a request in a manner that the employee is willing to accept in writing, the matter shall then be submitted to the Civil Service Board through the Civil Service Director for such action as they may deem appropriate. The City Manager shall be advised of all such requests and actions taken by the Board. Sect. 250 i 250/250.4 250 CLASSIFICATION PLAN FOR ALL POSITIONS IN THE CLASSIFIED SERVICE 250.1 The classified service shall consist of the classes of positions listed at the end of this section, with such changes as may be made from time to time by amendment of this Article. The class grade is established for each class of positions to indicate the level for compensation purposes. . 250.2 In cases where all positions of a class have a normal work week of more or less than 40 hours the work week is specifically indicated next to the class title and the grade reflects consideration of the longer or shorter work week as the case may be. 250.3 In all cases of Grade 23 or above, grades are established in consideration of the scope and responsibilities of the positions alone and not on any fixed hours or work to be required. In such executive, administrative, and professional positions no fixed or normal work week is established and no adjustment of salary is provided for in the compensation ordinance by reason of variations in the hours of work. 250.4 In case of a position of a class with a work week differing substantially from that indicated herein for the class, special compensation adjustments therefore are pro- vided in the compensation ordinance. Be It Ordained by the City Council of the City of Corpus Christi, Texas: 500 DEFINITION AND ADOPTION OF THE COMPENSATION PLAN 501 Salary Schedules The pay of City employees shall be on the basis of appro- priate salary schedules prescribed herein for the respec- tive grades of positions in the classified service as established by the Civil Service Board and for respective unclassified positions as listed herein. The general salary schedule shall consist of an entrance rate, inter- mediate rates, and three longevity rates. The schedule of salaries as shown in the following subsection shall comprise the compensation plan. The Fire Chief shall also prescribe the hours of duty and the number of hours comprising the work week of all firemen returning to limited service from an on- the -job injury. Salaries of part -time positions shall be determined as provided in Section 650. 508 Application of the Compensation Plan to Positions in the Classified Service The grades assigned to each of the salary schedules refer to the grades established for each class of positions in the classified service by the Civil Service Board and included in the classification plan as adopted and amended from time to time by the Board. Such additional compensation for no chargeable accidents shall be calculated from the first day of the month immediately following the anniversary date of the employ- ment of the Bus Operator and shall be accumulated from quarter to quarter. The amount so accumulated in the 12 months preceding the 30th day of November of each year shall be paid to the Bus Operator by the 10th day of December of that year. If, in the twelve months immedi- ately prior to November 30th of the year under conside- ration, the Bus Operator has incurred no chargeable acci- dents, the amount to be paid as an accumulated, shall be $25.00. Sect. 550 OG411.• JOY i 550/551.2 550 ADMINISTRATION OF THE COMPENSATION PLAN 551 Entrance Salary Rates 551.1 Starting Rate on Initial Employment. On original appointment to any position classified in Salary Grades 4 through 24, the salary shall be by successive steps. The City Manager may approve initial compensation for positions in Salary Grades 4 through 24 at the B or C step in the appropriate salary grade, when the experi- ence, skill, training, or labor market conditions justify the action. The City Manager may approve initial compensation in Salary Grade 25 through 43 at the B, C, D, E, or F step in the appropriate salary grade when exceptional experience, training, or labor market conditions justify the action. 551.2 Starting Rate on Return to Duty. Employees other than Fire and Police personnel returning to duty in the same class of positions after a separation from the City service of not more than one year, which sepa- ration was without prejudice to the employees, may, at the discretion of the City Manager, receive the rate in the salary schedule corresponding to the step rate received at the time of separation and shall subsequently be paid such rate for at least such period as is normally required for advancement to the next higher salary rate. Fire and Police personnel after reappointment as Fire- fighter or Patrolman, respectively, returning to duty with a separation from the City service, which separation was without prejudice to the employee, may, at the dis- cretion of the City Manager, receive recognition for prior experience and training by being placed in a lon- gevity pay step for Patrolman or Firefighter corresponding with actual prior service with the City as Patrolman or Firefighter in the same division; but in no case shall prior training and experience be recognized in a step greater than the actual prior service with the City in the same division shall justify. 551.3/551.5 551.3 Starting Rate on Return from Military Service. Any employee who leaves or has left the City service to enter the active service of the armed forces of the United , States and who subsequently is reinstated to a position previously held by him shall be entitled to receive a salary at the step rate to which he would have been entitled had his service with the City not been interrupted by service in the armed forces, assuming his manner of performance to be that evidenced prior to his military service. 551.4 Starting Rate in New Position. Whenever an employee is assigned to duty in a position of a dif- ferent class not previously held by him and such change is not in the nature of a promotion, he shall receive the entrance rate in the salary scnedule established for the class or such other rate within the applicable salary schedule as he may be entitled to by reason of crediting him in his new position with such prior ser- vice that is found to meet the following conditions: The character and nature of the duties of the position to which the employee was assigned are similar to those of the new position; the service in the former position provided experience which is valuable to the performance of the duties of the new position. 551.5 Rate of Pay on Promotion. In any case where an einployee is promoted to a position of class with a higher salary schedule, the entrance salary rate shall be at the lowest step in the higher salary sche- dule that will provide an increase over the salary received immediately prior to such promotion. Subse- quent advancement to higher steps in grade will be on the same basis as described in paragraph 552. ■ 1 552/552.6 552 Advancement of Salary Within a Salary Schedule 552.1 Advancement in the salary of an employee within a salary schedule shall be based on the achievement of minimum periods of service and satisfactory performance. 552.2 The minimum period of service for the first salary advance after appointment or promotion to a position shall be six months. For each succeeding advance, longevity service shall be required as stipulated within the salary schedule for each step. 552.3 Advancement to the E step shall be made at the completion of at least one year of service in the D step and at least eight years of continuous service with the City, except as provided in paragraph 552.7. 552.4 Advancement to the F step shall be made at the completion of at least 18 months of service in the E step and at least 16 years of continuous service with the City, except as provided in paragraph 552.7. 552.5 Longevity step G shall be added to the general salary schedule with the requirements for steps E, F, and G, modified according to the following timetable: Years of Service Beginning E F G 1 year 18 months 2 years Minimum Minimum Minimum Service Service Service at Step D at Step E at Step F August 1, 1973 9 18 24 February 3, 1975 8 16 23 552.6 Police and Fire personnel shall receive longevity pay in addition to the base salary rates as prescribed above for service in either department or a combination of , i service in both departments in the amount provided by State law for service up to and including twenty -five (25) 552.6/552.11 years of service and any other longevity pay as authorized by this ordinance. Advancement to the six, eighteen, and thirty month longevity pay steps for "Patrolman" and "Fire- fighter" shall be based on uninterrupted continuous service, except that the City Manager may recognize prior service in the same division with the City. 552.7 To recognize exceptional performance or current labor market conditions, the City Manager may approve advancement in salary of any position in Grades 25 through 43 to any step of the salary grade, but such advancement cannot exceed two steps in any 12 -month period. The pro- visions of this section shall be in addition to all other provisions for step advancement within grade set forth in this ordinance. 552.8 To recognize labor market conditions or outstanding performance when recommended by the department adminis- trator and the Personnel Department, the City Manager may approve advancement in salary of any position in Grades 20 through 24 to any step of the salary grade provided that such advancement be limited to not more than one step in any one year for any employee. No employee may receive more than two such step advancements under this provision. 552.9 When an individual returns to work in a position of Grade 24 or below with 18 months or more of prior service, the City Manager at his discretion and after receiving the recommendation of the department supervisor, may advance such an employee not more than two steps in addition to the steps resulting from the application of other sections of this compensation plan, but in no case can such advance- ments exceed the step the employee would have been in had his total service been continuous. This discretionary authority shall continue to be available to the City Manager until the individual's step in grade reflects full credit for prior service. 552.10 Notwithstanding any other section of this ordinance, advancement beyond the "D" step for the positions of Chief of Fire, Chief of Police, Assistant Police Chief, Police Commander, First Assistant Fire Chief, and Assistant Fire Chief, shall be only according to the provisions of para- graph 552.7. 552.11 Effective June 7, 1976, employees in Salary Grades 25 and above shall be advanced according to the timetable 552.11 noted below. If the employee does not receive an immediate increase adjustment, then at the end of six months or twelve months as specified, the employee shall be advanced to the next highest salary step within the applicable salary grade as provided in the salary schedule adopted May 12, 1976. If the employee because of longevity is eligible for the next higher step after initial adjustment, then he or she shall be advanced to the next step after twelve months of service in position. All subsequent longevity increases shall required one additional year of service unless otherwise granted in conformity with the requirements of paragraph 552.7. This recommendation shall include a certification that the employee's manner of per- formance during the months immediately prior to the effec- tive date of the recommended advancement in salary was satisfactory. 554 Reappointment of Officer Salaries for appointed officers having a definite term shall be subject to reduction or increase by amendment to this ordinance. Unless otherwise provided, re- appointment shall have the same effect as a continuation of employment and the officer shall receive salary at the same step of which he would have been entitled had his employment been continuous. Sect 600 - Sect. 600 600/601.5 600 INITIAL ADJUSTMENTS TO THE COMPENSATION PLAN 601 In order to bring all salary rates into conformity with those provided in the compensation plan, or to correct errors in classification, the following rules shall be effective in fixing the rates of pay of incumbents of all classified positions (except positions in the classes of the Police and Fire series) at the time of adoption of the compensation plan or any amendment thereto. 601.1 The rate of pay of an employee receiving less than the minimum rate of the salary schedule prescribed for the class to which his position is allocated shall be increased to the minimum rate, provided that the rate of pay of an employee having five years or more continuous service in his present position or in an exact similar position with the City, shall be advanced to the second step. 601.2 The rate of pay of an employee receiving the same or more than the minimum of the salary schedule but less than the second step rate of the schedule prescribed for the class to which his position is allocated shall remain unchanged unless or until the employee has completed six months of satisfactory service in the position, when his salary shall be advanced to the second rate of the salary schedule. 601.3 The rate of pay of an employee receiving the same or more than the second rate but less than the third rate of the appropriate salary schedule shall remain unchanged unless or until he has satisfactorily served in his posi- tion 18 months when his salary shall be advanced to the third rate of the salary schedule. 601.4 The rate of pay of an employee receiving the same or more than the third rate but less than the maximum rate of the appropriate salary schedule shall remain unchanged unless or until he has satisfactorily served in his position 30 months in which case he shall be advanced to the maximum salary rate of the salary schedule. 601.5 The rate of pay of an employee receiving the same or more than the maximum rate, but less than the first lon- gevity rate, shall remain unchanged unless or until he has completed 10 years of continuous service with the City, and has satisfactorily served 42 months in his present position. 601.6/604 601.6 The rate of pay of an employee receiving the same or more than the first longevity rate, but less than the second longevity rate, shall remain unchanged unless or until he has completed 20 years of continuous service with the City and has satisfactorily served 54 months in his present position. 601.7 In any case where the present salary of an employee is at or above the second longevity rate of the salary schedule, the salary of such employee shall remain unchanged until such employee is promoted to a higher class or until the salary schedules are changed by the City Council. 602 The salaries of unclassified employees shall be adjusted to the rates of appropriate salary schedules specified herein at the step determined by the City Manager: provided that longevity rates shall not be used unless employee has met requirements for continuous service with the City. 603 According to the terms of the contract between the Corpus Christi Independent School District and the City of Corpus Christi authorized by the City on November 18, 1959, all employees of the District employed in the Tax Office as of November 18, 1959, and desiring to become City employees as of December 1, 1959, July 31, 1960, or July 31, 1961, or July 31, 1962, will receive compensation according to sub- sections 601 and 602 above as though the date of transfer to the City and the date of adoption of the compensation plan were the same. Years of service with the District will be considered to be years of service with the City for longevity purposes. 604 Whenever any governmental unit or non - profit corpo- ration consolidates with the City of Corpus Christi, except as previously provided in subsection 603 above, the employees of the governmental unit or non - profit corporation so con- solidating will receive compensation according to subsections 601 through 603 above, as though the date of consolidation and the date of the adoption of the compensation plan were the same. Years of service with the consolidating unit will be considered to be years of service with the City for lon- gevity purposes. 605/607 605 Any employee entering into a position under this compensation plan as of October 1, 1966, having been employed by the Nueces Transportation Company immediately prior to October 1, 1966, shall receive compensation as set forth in Section 500. For compensation purposes only, continuous service with Nueces Transportation Company, as continuous service is defined in this ordinance, shall be considered as service with the City but such service shall be considered for longevity purposes only and not for retirement or vacation determinations. 606 Any employee entering into a position under this compensation plan as of November 1, 1971, having been employed by the Housing Section of the Housing Authority pursuant to the aforesaid contract for the management of the emergency housing program provided pursuant to the aforesaid contract by and between the Housing Authority and the City immediately prior to November 1, 1971, shall receive compensation as set forth in Section 500 of this ordinance. For compensation purposes only, continuous service with said Housing Section may be considered for longevity purposes only and not for retirement or vacation determinations. 607 Any employee entering-into a position under this compensation plan as of July 6, 1972, having been employed by the Neighborhood Youth Corps, shall receive compensation as set forth in Section 500. For compensation purposes only, continuous service with the Neighborhood Youth Corps program as continuous service is defined in this ordinance, shall be considered as service with the City but such service shall be considered for longevity purposes only and not for retirement or vacation determinations. Sect. 650 Sect. 650 650/653 650 COMPENSATION OF PART -TIME EMPLOYEES 651 Compensation of Part -Time Hourly Employees A part -time employee shall be defined as any employee in Grade 12 or above who works less than 20 hours per week and any employee in Grades 11 and below who works less than 40 hours per week. A part -time employee shall be paid on an hourly rate basis equivalent to the appropriate monthly rate in the salary schedule for the classification. 652 Advancement in Salary for Part -Time Employees A part -time employee may be advanced in pay within a salary schedule in the same manner as other employees, provided that only actual hours of work shall be considered in determining such advancement. When the hourly equivalent of required periods of service has been attained, advancement to the high step rate may be affected in accordance with Section 550 of this ordinance. 653 Compensation of Temporary Employees A temporary employee shall be defined as any employee who is employed for a known period of time to perform a specific function of temporary nature. All such employment must be specified as to the length of time anticipated to complete the temporary assignment on the appropriate form on initial employment. A temporary employee shall be paid on an hourly rate basis equivalent to the appropriate monthly rate in the salary schedule for the class. Sect. 700 .^,',......^.. ...,,.. Sect. 700 •••■•••P.■•■■,.... 700/702.3 700 SPECIAL COMPENSATION PROVISIONS 701 Compensation of Working Supervisors In case an employee is working in a class and assigned in charge of one or more persons in positions of the same class or grade, such employee shall be paid at the corresponding step rate in the next higher salary schedule. 702 Educational Incentive Pay - Fire and Police Series 702.1 Employees shall be eligible for educational incentive pay at the monthly rate of $0.60 per month for each academic semester hour satisfactorily completed, provided that such hours are applicable toward a degree in Police Science when employed in the Police Division or in Fire Science when employed in the Fire Division. Approved hours must include the core curriculum in Law Enforcement or other similarly required curriculum in Fire Science. In no event will more than $42.60 per month be paid without successful completion of the requirements and the receipt of the Associate of Applied Science Degree, Police Science, or Fire•Science, as applicable. If the employee is attending a four -year college, he may meet this requirement by filing a copy of his certi- , fied degree plan with the Director of Personnel, noting his expressed intent to obtain a Bachelor's Degree in Police Science or Fire Science. All approved hours above the Associate Degree in Fire or Police Science will be eligible for educational pay at this rate up to an additional $29.40 per month or a combined total of $72. Successful completion of the requirements and receipt of a Bachelor's Degree in Police Science or Fire Science will qualify the employee for a maximum of $75 per month. 702.2 Approved hours above the Bachelor's Degree applicable toward a Master's Degree in Police Science or Fire Science will be eligible for educational incentive pay at the same rate up to an additional $12 per month. Successful comple- tion of the Master's Degree in Police or Fire Science will qualify the employee for an additional $6 per month for a maximum combined total of an additional $18 on a Master's Degree. 702.3 Non -core or elective courses shall qualify for edu- cational incentive pay when each twelve elective academic hours are matched by at least three core academic hours. No probationary employee in either the Fire or Police Divisions will be eligible for educational incentive pay until after he has successfully passed his probationary period. Specific 702.3 hours obtained through participation in the Police Academy or equivalent Fire Recruit Academic Training Program will be considered eligible for educational incentive pay only after successful completion of at least one other academic course in the related field on his own time. Sect. 750 Sect. 750 750 750 DEDUCTION FOR MAINTENANCE FURNISHED IN KIND The salary rates established in the compensation plan represent total compensation for full -time employment. In cases where quarters and /or subsistence are provided to an employee by the City as part of the compensation for the position, the value of such maintenance shall be deducted from the prescribed salary rates before payment to such employee. The value of such quarters and subsis- tence shall be computed by the department head concerned based on the approximate cost of providing such maintenance and shall be approved by the City Manager. In no event shall quarters and subsistence be provided by the City for the sole convenience of the employee. Sect 800 Sect. 800 800/803 800 OVERTIME COMPENSATION 801 Authorized Overtime In emergencies, a department head may prescribe reasonable periods of overtime work to meet operational needs. Overtime work shall not be established as a regular continuing extension of the normal work week. Overtime work of less than one -half hour shall not be considered for compensation except that the minimum working hours to be reported as call -back time shall be two hours regardless of the actual time required. With the preceding exceptions, all authorized overtime work shall be reported to the nearest half hour. 802 Overtime Compensation All full -time employees in positions of classes in Grade 22 and below, Equipment Operator IV's, Engineering Design per- sonnel, Senior Radio Technicians, and all positions in the • Police and Fire Series except Police and Fire Chiefs, Assis- tant Police Chiefs, and Police Commanders, shall be paid for. authorized overtime work at the rate of one and one -half times the regular rate, provided that such rate for positions in - the Fire Series with scheduled work weeks other than 40 hours. shall be computed on the basis of 173.33 hours per month. Compensatory time off equal to the actual hours of overtime may be granted and scheduled at the discretion of the depart- ment head concerned. Employees within the Police Series may elect, with the concurrence of the department head, to be granted compensatory time off at the rate of one and one - half times the actual hours of overtime worked in lieu of overtime cash payment. Other salaried officers and employees in positions of Grade 23 or above, excluding Equipment Operator IV's and Engineering Design personnel, shall not be eligible for regular overtime compensation as provided above, but may be granted compensatory time off in unusual cases when authorized by the City Manager; except upon authorization of the City Manager, overtime work may be paid on a straight • time basis for work performed under contracts with the Federal government for civil defense.purooses. 803 Overtime Administration Where the need for overtime work to be compensated in cash can be anticipated, funds shall be provided in the depart- mental activity budget. In unforeseen emergencies, the depart- ment head may authorize overtime work to be compensated in •1 803/804 cash when he deems it essential to the proper conduct of the department operations. In all such cases, proper report with justification shall be made to the City Manager as prescribed in administrative instructions of the City Manager. The allocation of funds to a department or unit in anticipation of emergency overtime payments shall not constitute authority for overtime work per se. All compensatory time accrued prior to August 1, 1974, will be carried forward and may be taken as equal time off for authorized overtime work performed prior to August 1, 1974. In cases of employees who are compensated for overtime work by equal time off, detailed records shall be maintained by each department of overtime work and compen- satory time off granted each employee. Accrual for time off purposes shall not exceed fifteen (15) working days at any time. In the event of termination, compensation for accrued compensatory time shall not exceed fifteen (15) days. Accrual for time off purposes for employees in the Police Series may be accrued on an unlimited basis with payment of accrued compensatory time in the event of separation in good standing of such employee, not to exceed thirty (30) days at the employee's regular rate of pay. 804 Notwithstanding the above provisions, overtime worked by employees of the Transit Division shall be compensated in the following manner: Supervisor III, when working as• Chief Dispatcher, shall be paid straight time for all hours over 40 per week. Bus Operators will be paid overtime at the rate of one and one -half times their regular rate for all hours worked over 44, with the exception that Bus Drivers on charter runs, shall be paid on a straight time basis regardless of total hours worked. Sect. 850 850/850.3 850 PERSONALLY -OWNED AUTOMOBILE AND MOTORCYCLE ALLOWANCE 850.1 An officer or employee of the City who is required and specifically authorized by the City Manager to have available and to regularly operate his personally -owned automobile in the conduct of City business shall be paid monthly according to the following schedule for such travel: Miles Driven Allowance 100 to 200 miles per month 201 to 300 miles per month 301 to 400 miles per month 401 to 500 miles per month 501 to 600 miles per month 601 to 700 miles per month 701 to 800 miles per month 801 to 900 miles per month 901 to 1000 miles per month 1001 to 1100 miles per month Over 1100 miles per month $ 30.00 40.00 45.00 50.00 56.00 62.00 69.00 76.00 84.00 92.00 100.00 850.2 The use of a motorcycle owned by a Police Officer shall be compensated according to the above schedule-plus $50.00 per month. 850.3 In cases of local need for travel with the use of a personally -owned automobile in the conduct of City business, the City Manager shall, in lieu of the above, authorize a mileage allowance of $0.15 per mile for such travel. All employees authorized to receive automobile reimbursement after August 4, 1975, shall be reimbursed on a reported trip - mileage basis. All employees already receiving stan- dard schedule monthly automobile allowances prior to August 4, 1975, may, at the discretion and approval of their depart- mental administrator, continue to be paid such reimbursement or voluntarily elect to be reimbursed on a reported trip - mileage basis. In the event this voluntary election is made it shall be irreversible. Sect 900 Sect 900 900/900.3 900 HOLIDAYS 900.1 The following days, or parts of days, are hereby declared holidays for all City officers and employees: The first uay of January (New Year's Day) The last Monday of May (Memorial Day) The fourth day of July (Independence Day) The first Monday of September (Labor Day) The fourth Thursday of November (Thanksgiving Day) The twenty -fifth day of December (Christmas Day); provided, however, that whenever Christmas falls on a Saturday, that December 24th shall be a holi- day instead of December 25 One holiday to be determined by the City 900.2 When a holiday listed above falls on a Sunday, the following business day shall be considered a holiday. When any holiday listed above falls on a Saturday, the preceding Friday shall be considered a holiday. In addition to the above, any day may be designated as a holiday by procla- mation of the Mayor, upon approval of the City Council. 900.3 No full -time employee shall lose pay as a result of authorized absence on a prescribed holiday. Monthly sala- ried employees in positions of Grade 22 or below with the exception of employees working a rotating or variation of rotating shift work shall be compensated in addition to .R their regular rate of pay for time worked on a holiday, one and one half times the regular rate of pay, or, at the dis- cretion of the division head, such employee may be granted equal time off at such time as the division head may desig- nate, for required work on a holiday and be paid, in addi- tion to such time off, one -half times the regular rate of pay. Employees working a rotating or variation of rotating shift work shall be granted in addition to their regular rate of pay for time worked on a holiday equal time off as the head of the division may designate, and be paid in addition to such time off, one -half times the regular rate of pay. Part -time and temporary employees, as defined in Section 650, Subsection 651 and 653 of this ordinance, and all employees below Grade 7, shall not be compensated for holidays, except for time actually worked. Compensation for temporary and part -time holiday work will be on one and one -half times the straight time basis. 900.4/900.5 900.4 Any employee who for any reason is absent without pay on a workday immediately preceding or following a holiday or on the holiday shall not be paid for the holi- day unless worked, in which case he shall be paid only at his regular rate of pay. 900.5 Firemen and Policemen shall be credited with one day holiday leave with pay for each designated holiday worked. If a declared holiday falls upon the employee's normal day off, an extra day shall be added to his holiday leave. Unused holiday leave shall be paid on termination. Sect. 950 Sect. 950 950/951.6 950 LEAVES OF ABSENCE 951 Vacation Leave 951.1 Every officer or employee in the City service except part -time, temporary, and all positions below Grade 7, and Police and Firefighting personnel shall accrue and be allowed vacation leave with pay at the rate of one working day for each full month of con- tinuous service. A working day of vacation is defined as eight working hours. 951.2 All employees except Police and Firefighting personnel who are regularly required to work more or less hours per week than set forth in the above schedule shall accrue and be allowed vacation leave in the same ratio as 12 working days bears to 40 hours. 951.3 All employees who have completed 15 years of continuous service with the City shall begin to accrue and be allowed an annual total of 17 working days vacation leave with pay. 951.4 Vacation leave credit may be accumulated without limit by all employees and leave may be granted in periods of not less than one day, unless approved by the division head, and not more than 30 working days in any calendar year unless in connection with sick leave and /or work injury leave; however, employees who regularly work 1/2 day on a sixth working day of a week may take vacation in the amount of 1/2 day pro- viding it is taken concurrently with other days of authorized vacation leave. 951.5 Absence on account of sickness, injury, or disability in excess of that hereinafter authorized for such purposes may, at the request of the employee and within the discretion of the department head, be charged against vacation leave allowance. 951.6 No vacation credit shall be granted or paid at termination unless the employee has been employed for a period of time in excess of six months. No more than 30 working days of vacation shall be paid an employee upon termination except as provided below. Payment of accrued vacation, on termination due to retirement of any full -time employee after 25 years of service, termination at age 65 or over regardless of 951.6/952.2 number of years of service, disability retirement in accordance with TMRS or Social Security regulations, or death, shall be provided all employees or their beneficiaries. 951.7 Official City holidays occurring during an employee's vacation shall not be considered or charged as a part of the employee's vacation. 951.8 Each department shall keep necessary records of vacation leave allowance and shall schedule vacation leaves with particular regard to seniority of the employees, in accord with the operating requirements, and insofar as possible, with the requests of employees. 952 Sick Leave 952.1 Every employee in the City service, except part - time, temporary, and Police and Firefighting personnel, shall accrue and be allowed sick leave with pay at the rate of one working day for each full month of continuous service. 952.2 Police and Firefighting personnel shall be granted 15 days sick leave per year in compliance with State law. Any employee of the Sanitation Division required to work on a sixth day in any week will, when absent on the sixth day, due to "sick leave ", as defined below, be charged one full day of sick leave. Such sick leave allowance may be used only by an employee when incapacitated to perform his duties due to sickness or non - service- connected disability, when quarantined, or in the event of a serious illness or death in the employee's immediate family. All foreseeable leaves for such purposes shall require specific prior approval of the department head. In the event of sick leave for any purpose, the department head may require a certificate of a medical doctor or other competent professional individual giving information as to the circumstances involved. The immediate family for these purposes shall be regarded to include the parents, spouse, children, brothers and sisters in any case, and also shall include grandparents, grandchildren, and immediate in -laws when living in the household of the employee. 952.3/953.4 952.3 Payment of accrued sick leave not to exceed 90 working days, on termination due to retirement of any full - time employee after 25 years of service with the City of Corpus Christi; termination at age 65 or over regardless of number of years of service; disability retirement in accordance with TMRS or Social Security regulations; or death, shall be provided all employees or their bene- ficiaries in the City service. Payment of such accrued sick leave shall be at the rate of the employee's last monthly salary or hourly rate for an equivalent period. 953 Disability Leave 953.1 No sick leave shall be charged for injuries sus- tained in the line of duty for employees in the Fire and Police Series. Employees shall be paid disability leave in an amount not to exceed their regular salary as pro- vided by State law for injuries occurring while in the course of employment. All other employees of the City will be compensated in cases of injury while occurring in the course of employment necessitating the employee's absence from work as follows: 953.2 All cases of injury occurring while in the course of employment necessitating the employee's absence from work shall be compensated for under provisions of the Work- men's Compensation Act concerning the particular class of employment, and the employee shall be considered absent without pay from the time of injury as provided by said Workmen's Compensation Policy. 953.3 Every employee so injured on the job shall receive workmen's compensation as provided under the provisions of the Workmen's Compensation Act. The employee, upon his request, may elect to use accrued sick leave credit to the extent of such credit, or upon recommendation of the department head and approval of the City Manager be granted disability leave with pay, to provide supplemental compen- sation equal to the difference between the employee's regular salary and the amount of workmen's compensation. In no case will the combined total of workmen's compensation and supple- mental compensation exceed the employee's regular salary. 953.4 The recommendation of the department head or division head may by them or the City Manager or the City Council be limited, extended within the maximum herein provided, or terminated at any time. 953.5/955.1 953.5 Notwithstanding any other provisions of Section 953, the City Manager is authorized to grant disability leave, not to exceed 12 months, to any employee injured in the course of employment after the first calendar week of absence caused by such injury. The first week of such absence shall be governed by subsection 953.3. Any request for such disability from injury suffered in the course of employment, leave with pay shall be for the period commencing after the first week of absence and shall be submitted to the City Manager by the responsible department heads with supporting information and may be either approved or disapproved as the City Manager deems to be in the best interest of the City. The rate of pay during such disa- bility leave shall be reduced from the regular rate of pay by the amount of workmen's compensation being paid to said employee for the same period of time. 954 Military Leave Any permanent employee who presents official orders re- quiring his attendance for a period of training or other active duty as a member of the United States Armed Forces, the Texas State Reserve Corps, or the Texas State Guard shall be entitled to military leave with pay for a period or periods not exceeding a total of 15 calendar days in any one year. Any permanent employee who leaves his posi- tion for the purpose of entering the Armed Forces of the United States, or enters State service as a member of the Texas National Guard or Texas State Guard or as a member of any of the reserve components of the Armed Forces of the United States shall, if discharged, separated or released from such active military service under honorable conditions be restored to employment in the same position as held at the time of induction, enlistment, or order to active Federal or State military duty or service if still physically and mentally qualified to perform the duties of such position. In order to qualify for re- employment, the employee must make written application for re- employment within 90 days after discharge or release from active Federal or State military service, to the head of the department in which he was employed prior to entering such military service. 955 Special Leave 955.1 In addition to leaves authorized above, a department head may authorize an employee to be absent without pay for 957.3/958 957.3 Only the number of days accrued as of December 31 of any calendar year will be taken into consideration in determining whether or not a member of the Fire Division has exceeded the maximum number of accrued vacation days allowed by the compensation ordinance. 957.4 For those members of the Fire Division who are scheduled to work an average of 56 hours per week on an annual basis, 12 scheduled working hours shall be counted as one working day for vacation purposes; for those members of the Fire and Police Divisions scheduled to work 40 hours a week, 8 working hours shall be counted as one working day for vacation purposes. 957.5 Except as provided in the paragraphs of this sub- section, all regulations and conditions relating to vaca- tions for City employees generally`shall apply to members of the Fire and Police Divisions. 958 Administrative Leave Assistant Chiefs and Commanders in the Police Department may receive administrative leave time for work performed in excess of their regularly scheduled duties. Said leave time may be granted at the discretion of the Chief subject to scheduling and manpower contingencies that may arise. Said administrative leave time shall, in no event, exceed that amount of time that Assistant Chiefs and Commanders have accumulated in excess of their regularly scheduled work. Sect. 1000 Sect 1000 1000/1000.6 1000 REQUIREMENTS AS TO CONTINUITY OF SERVICE 1000.1 Service requirements for advancement within compen- sation schedules and for other purposes as specified in this ordinance, shall have the implication of continuous service. Leaves without pay of less than 30 days and leaves of absence with pay shall not interrupt continuous service and shall not be deducted therefrom. Absences of leave without pay in excess of 30 days except for disability leave and extended service with the armed forces of the United States shall be deducted in computing total service but shall not serve to interrupt continuous service. In case of repeated one day absences without leave the City Manager may consider the service of the employee interrupted and shall have the personnel record of the employee show the same. 1000.2 Upon interruption of service followed by reinstate- ment or return to duty, the continuous service date shall be the effective date of reinstatement or return to duty except as further provided in this section. 1000.3 Prior service may be recognized for continuous service credit, but shall be reduced by the rate of one calendar month for each calendar month or part thereof absence, upon approval of the City Manager, as recommended by the department head. The effective date of reinstatement shall be adjusted by the amount of prior service recognized. 1000.4 Prior service of less than six months shall not be considered in computing continuous service credit. 1000.5 Recognition of prior service for continuous service credit shall not be granted until satisfactory completion of six months probationary period. 1000.6 An employee's last two periods of employment, less service breaks, shall be used in calculating prior service credit. Sect. 1050 Sect. 1050 1050/1052 1050 ADMINISTRATION AND MAINTENANCE OF COMPENSATION PLAN AND OVERALL PERSONNEL ADMINISTRATION 1051 Responsibilities of the City Manager 1051.1 The City Manager shall be responsible for but may delegate the work of administering the compensation plan, including, but not limited to, the processing of salary advancements, the determination of proper salary rates within the existing ordinance provisions, and the prepa- ration of recommendations and initiation of approved revisions to the compensation plan on the basis of changes in cost of living and prevailing rates of pay for compa- rable positions outside the City service. Any changes recommended by the City Manager shall be considered by the City Council and the changes in the salary schedule deemed appropriate shall be effective upon favorable action by the City Council. 1051.2 The City Manager also shall have the responsibility for and may delegate the work of administering all person- nel matters in connection with unclassified personnel including, but not limited to, the recruitment and screening of such personnel and the preparation of class specifications including job descriptions and desirable qualification requirements for the unclassified positions. 1051.3 The City Manager also shall, with the assistance of others designated by him, develop a program of overall personnel administration including, but not limited to, in- service training and career development, organization and staffing studies, long -range recruitment activities, employee and vehicular safety programs, and a management - employee relation plan for furthering the cooperation of employees and supervisors on personnel matters. 1052 Employee Requests for Compensation Adjustments Any employee shall have the right to the consideration of any request he may have with respect to changes in the application of the compensation plan to his position. The employee shall initially make his request to the department head who shall promptly seek to arrive at a solution which is consistent with the compensation plan and acceptable to the employee. Where the department head is unable to resolve such a request, the matter shall then be submitted to the City Manager or his authorized representative for conside- ration and final decision by the City Manager. Sect. 1100 -1250 Sect. 1100 -1250 1100 1100 REPEAL OF CONFLICTING ORDINANCES All ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. 1150 1150 SAVINGS CLAUSE If any section, sentence, clause, or phrase of this ordi- nance shall be held, for any reason, to be inoperative, void, or invalid, the validity of the remaining portions of this ordinance shall not be affected thereby, it being the intention of the City Council in adopting this ordi- nance, that no portion thereof, or provision herein, shall become inoperative or fail by reason of invalidity of any other portion or provision and the City Council of the City of Corpus Christi, Texas, does hereby declare that it would have severally passed and adopted the pro- visions contained herein, separately and apart one from the other. 1200 1200 EFFECTIVE DATE This ordinance shall take effect as of August 5, 1974. 1250 1250 This ordinance shall be deemed a continuance in effect of the provisions of Ordinance No. 3658 and the amendments thereto, except as herein changed and amended. The fact that there is an immediate need to create certain new position classes and a need to maintain an efficient administration of City affairs creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule that no ordinance resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three separate meetings of the.City Council, and the Mayor, having declared such emergency and necessity to exist, having requested suspension of said Charter Rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5th day of August 1974.
