WHEREAS, the City Council finds that an incr'ea`se in ;such slip rental rates is necessary to cope with the rising cost of such 'service, to make, such service more nearly self- supportive; and q WHEREAS', the collection of marina revenues has been assigned:; to the collectioh section of the finance department of the City so as to '• r, have a'moretdetailed' collection record through data•processing methods; •,••� „NOW,:THEREFORE, BE IT ORDAINED 'BY THE CITY COUNCIL OF THE CITY `.OF`CORPUS, "CHRISTI; TEXAS: % { �• SECTION'1 _ °`That,the Code of Ordinances, City of Corpus Christi, 1976 Revision as amended,,be and the same is hereby amended by .:N. 1k revising Section 12 -61; "Rates and Rental Fees for Use of Slips and „Dock • Space - ,Schedule and Regulations',', to hereafter read as follows:. "Section 12 -61 Rates and rental fees for use of slips and dock,space - schedule and regulations.+ �c(1) 4 Definitions: ” Boat Slip: The area of wet boat storage bound by four (4) • �1 tie pilings,.including one -half of the adjacent catwalk /pier, as designated on the marina slip schedule. Berths: A designated area of dry boat storage where a craft can bj suitably pl.aced'on racks or cradles when not in use. �. Dockage:, A craft laying alongside a dock, pier or bulkhead having the.benefit of only a single- side-mooring. Moorages: Areas to moor a craft for storage by anchor or to make fastrto,a Spar,'cleat, post or °piling, usually without the benefit to ° V�IICROFILNIED �� 3.3889 'JUL 0'719 80 i secure on four corners of the craft or unable to lay off. Charter Boat: Any crafts referred to as a head boat, party boat, party fishing boat, charter fishing boat, tour boat, excursion boat, and sightseeing boat, which are for temporary charter, rent or hire for recreational purposes all shall be construed to mean they are charter boats. Where there are no special provisions of the Code of Articles provided concerning charter boats at the Marina,"the Code of Articles regulating all other watercraft at the marina shall also apply to the charter boats. Suitable Size Slip: A slip with reference to a particular boat which can physically and safely accommodate such boat as determined by the Marina Superintendent, considering both the safety of the vessel and the City property. Transient Craft: Craft having port -of -call other than the Corpus Christi Municipal Marina which are seeking overnight dockage at the marina. 'Limited Tap Water: The tap water provided at the various boat slips shall not be used in continuous running water jet pumps and in tap water cycling machinery; i.e., cooling plants. (2) The monthly rates and rental fees for boat slips, berths, dockage and gear boxes in the Corpus Christi Municipal Marina shall be as follows and shall include a limited amount of tap water and shore -power privileges except where noted: (a) L -Head South Slips 1. Slip 40 20.00 per month no shore -power provided If at any time for any reason, a boat slip or a combination of boat slips are rented to accommodate a larger craft than specified on the marina rate and size schedule, the monthly rate will be established by multiplying the slip length times the slip width, including 1/2 of the adjacent catwalk and /or pier to establish the total square feet in the slip; the total square feet then will be multiplied times three and one -half cents (3.5¢) plus $1.00 for craft under 20 feet in length and $3.50 for craft 20 feet but under 30 feet and $8.50 for craft 30 feet but under 40 feet and $17.00 for craft 40 feet and over in length. (f) The rate for berths in the dry boat dock shall be: K $12.00 per month for each lower level berth. $ 9.00 per month for each second level berth. $ 9.00 per month for each third level berth. (g) The rate for dockage shall be three and one -half cents (3.50) per square foot per month for the area occupied by the boat (determined by multiplying its length in feet times its width in feet), payable in advance monthly and including limited tap water. (h) The rate for slips used by charter boats shall be the same as that for all other craft unless more than one owner requests to lease the same `slip. Limited amount of tap water shall be provided free. Charter boat tenants shall obtain their own source of electricity and at their own expense make any connections required by the power company. If more than one charter boat owner desires to rent a particular slip, written notice of such request shall be submitted to the Marina Superintendent who shall set a date at .,least thirty (30) days thereafter to receive sealed bids for the monthly rental fee of the slip. Such bids shall be required to be in excess of the amount which would otherwise be -5- charged for the slip. The bidder submitting the highest bid shall agree to sign a one -year lease for the slip and pay three months of the lease in advance so that at all times, except during the final ninety (90) days of the lease period, the tenant in any slip obtained shall have paid in advance at least ninety (90) days rent.' Such higher rate shall continue after the end of the one -year lease period unless the owner wished to be released from the additional payment. At such time, bids shall again be taken for the slip to determine the tenant rate which shall apply. (3) The Slip Contract: As specified in Ordinance No. 13462, passed November 3, 1976, Section 12 -79(a) through (f) shall apply. (i) Transient pleasure craft shall be charged a boat slip or dockage fee of Six Dollars ($6.00) per day (constituted as staying overnight) with limited tap water and electricity and Five Dollars ($5.00) per day with limited tap water and no electricity. The fee shall be payable in advance daily and the length of stay shall not exceed five (5) continuous days. A transient craft cannot be registered at the marina as a.transient and on the waiting list for a boat slip at the same time. Transient craft may be assigned to slips where the regular slip tenant's craft is tempo- rarily out on cruises or ways. The regular slip tenant must report to fl the Marina Supervisor when he will be out of his slip for a period of five " (5) or more days. a: (j) Rental for standard gear boxes provided by the City shall be Three Dollars ($3.00) per month for the" arge boxes and Two Dollars and 50/100 ($2.50) per month for the small geat'boxes on piers;A, B, C, and D. The fee shall be payable in advance on "a,monthly basis "" SECTION 2. All ordinances 'or p rts_of. ordinances in conflict herewith are hereby repealed to the extent of such conflicts. SECTION 3. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, sub- division, clause, phrase, word, or provision hereof be given full force -6- and effect for its purpose. SECTION 4. This ordinance shall be effective from and after ' its final passage and publication. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
