AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS FOR THE ACQUISITION OF PARCEL NO. 1, GAS
DIVISION PARKING AREA EXPANSION PROJECT, FROM THE
OWNERS, WILLIAM 0. BROWDER AND JOE R. CLARK; APPROPRI-
ATING,AND REAPPROPRIATING OUT OF THE NO. 106 GAS FUND,
ACTIVITY 5251, CODE 501 $75,550.50, OF WHICH AMOUNT
$75,000 IS FOR ACQUISITION AND $550.50 IS FOR COSTS
RELATED TO CLOSING; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute the necessary documents for the acquisition of Parcel No. 1,
Gas Division Parking Area Expansion Project, in the City of Corpus Christi,
said parcel being more fully described as follows, owned by William 0. Browder
and Joe R. Clark:
Being a tract of land out of Lot 1, Section D, Paisley's
Subdivision of the Hoffman Tract as shown by map of record
in Volume A, Page 28, Map Records, Nueces County, Texas,
and more particularly described by metes and bounds as
follows:
Beginning at a point on the west right -of -way line of
100.0 foot wide Port Avenue, said point being the north-
east corner of a 3.335 acre tract of land out of Lot 1,
Section D, Paisley's Subdivision of the Hoffman Tract,
as shown by map of record in Volume 24, Page 37, Map r .
Records, Nueces County, Texas, said tract now being the
property of the City of Corpus Christi, Texas;
Thence S. 89 degrees 03' W., along the north boundary
line of said City property, a distance of 413.54 feet to
an angle point;
Thence N. 61 degrees 40' W., continue along the northerly
boundary line of said City property, a distance of 171.74
feet to a point on the southeast right -of -way line of
State Highway No. 286 (Crosstown Expressway);
Thence N. 28 degrees 20' E., along the southeast right -
of -way line of said Highway No. 286, a distance of 70.0
feet to a point;
Thence S. 61 degrees 40' E., along a line that is north-
east of and parallel to the northeast boundary line of
said City property, a distance of 153.45 feet to an
angle point;
Thence N. 89 degrees 03' E., along a line that is north
of and parallel to the north boundary line of said City
property, a distance of 395.25 feet to a point on the
west right -of -way line of abovementioned Port Avenue;

Thence S. 00 degrees 57' E., along the west right -of-
way line of said Port Avenue, a distance of 70.0 feet
to the place of beginning, and containing 39,689.30
square feet or 0.911 acres more or less.
SECTION 2. There is hereby appropriated and reappropriated out
of the No. 106 Gas Fund, Activity 5251, Code 501 $75,550.50 of which amount
$75,000 is for acquisition and $550.50 is for costs related to closing.
SECTION 3. The necessity to authorize the execution of the
necessary documents and to appropriate the necessary sums in order that
the City may take possession of the aforesaid parcel in connection with
the Gas Division Parking Area Expansion Project creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having declared
such emergency and necessity to exist, and having requested the suspension
of the Charter rule and that this ordinance be passed finally on the date
of its introduction and take effect and be in full force and effect from
and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the J14d)
day of August, 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance _
finally on the date it is introduced, or at the present meeting of the City
Council.
