HomeMy WebLinkAbout13903 ORD - 08/24/1977hb:8/23,/77 r AN ORDINANCE CLOSING A CIRCULAR PORTION OF CORONA DRIVE, LOCATED GENERALLY BETWEEN EVERHART AND EMBASSY, AND PADRE ISLAND DRIVE AND STONEGATE, MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS HEREIN; AND SUBJECT TO THE FOLLOWING CONDITIONS: 1. DEDICATION OF ALTERNATE•RIGHT -OF -WAY BY SEPARATE INSTRUMENT AND REPLATTING. 2. EXTENSION OF THE 10' UTILITY EASEMENT BETWEEN LOTS 24 AND 25, BLOCK D, LEVEK TRACT TO INTER- SECT THE NEW RIGHT -OF -WAY LINE OF CORONA DRIVE. 3. REMOVAL OF THE EXISTING PAVEMENT ON THE PORTION OF CORONA DRIVE CLOSED AND THE REALIGNMENT AND RECONSTRUCTION OF CORONA DRIVE IN ACCORDANCE WITH THE ALTERNATE RIGHT -OF -WAY TO BE DEDICATED IN CONFORMANCE WITH PLANS TO BE APPROVED_BY THE DEPARTMENT OF ENGINEERING AND PHYSICAL DEVELOPMENT; � 4 AND DECLARING AN EMERGENCY. A WHEREAS, notice of the time and place for holding a hearing concerning the closing of a circular portion of Corona Drive, located generally between Everhart and Embassy, and Padre Island Drive and Stonegate, was given publication and mail to the last known address of the owners of property} abutting said streets and within 450 feet of the area to be closed and thereafter, pursuant to said notice,,public hearing was held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, August 17, 1977, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the circular portion of Corona Drive within the limits hereinabove set forth, for use as a public street, subject to the conditions outlined above: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the circular portion of Corona Drive, located generally between Everhart and Embassy, and Padre Island Drive and Stone - gate, and more particularly described'by metes and bounds as follows: . x ' '\ � MICROFILMED JUL 0'7,1980 13903 FIELDNOTES for the closure of a portion of Corona Drive out of Block D, Levek Tract, a map of which is recorded in Volume 41, Pages 174, 175, Map Records of Nueces County, Texas: BEGINNING at a point on the existing Northeast right -of -way line of Corona Drive for the North corner of this tract from which corner the common front corner of Lots 18 and 19, Block D, Levek Tract bears North 21028118" West 55.36 feet; THENCE with the existing right -of -way line of Corona Drive along a circular curve to the left whose radius point bears North 68*41142" East 10.00 feet and has a central angle of 72 °45153 ", a radius of 10.00 Feet, a tangent distance of 7.37 feet for an arc length of I2.70 feet; THENCE with said curve to the left, 12.70 feet to the point of tangency and the point of curvature of a circular curve to the right which has a central angle of 44058113 ", a radius of 125.00 feet, a tangent distance of -51.74 feet for an arc length of 98.11 feet;! THENCE with said curve to the right, 98.11 feet to the point of tangency and the point of curvature of a circular curve to the left whose radius point bears North 40054'02" East 250.00 -feet and has a central angle of 36652122 ", a radius of 250.00 feet, a tangent dis- tance of 83.33 feet for an arc length,of 160.87 feet; THENCE continuing along said existing right -of -way, 160.87 feet to the South corner of this tract] THENCE North 85058'10" West, along the proposed right -of -way - line of Corona Drive, 127.66 feet to the point of curvature of-a circular curve to the right which has a central angle of 64039'52 ", a radius of 138.74 feet, a tangent distance of 87.82 feet for an arc Flength of 156.58 feet; THENCE with said curve to the right, 156.58 feet to the POINT OF BEGINNING, containing 6,700 square feet of land. be and the same is hereby closed for use as a public street and hereby reverts to the abutting property owners, when the following conditions are met, as provided below: 1. Dedication of alternate right -of -way by separate instrument and replatting. 2. Extension of the 10' utility easement between Lots 24 and 25, Block D, Levek Tract to intersect the new riaht -of -way line of Corona Drive. .3. Removal of the existing pavement on the portion of Corona Drive closed and the realignment and reconstruction of Corona Drive in accordance with the alternate right -of- way to be dedicated in conformance with plans to be approved by the Department of Engineering and Physical Development. It is hereby specifically ordained that there is no reversion to the abutting property owners unless and until the above conditions are fully complied with in the judgment of the Director of the Department of Engineering and Physical Development. -2- SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase,,word, or provision of this ordinance,•for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. That the fact that the public convenience and necessity would be better served by the closing of a portion of the aforesaid street, within the limits defined and the conditions outlined herein, creates a public emergency and an imperative publjc necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the'.2� day of August, 1977.
