AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED
QUITCLAIMING THAT PORTION OF HIAWATHA STREET BETWEEN "
OLD BROWNSVILLE ROAD AND MORGAN AND THE ISLAND BETWEEN
HIAWATHA STREET AND OLD BROWNSVILLE ROAD TO J. F. PASDERMY
,AND WIFE, ANN PASDERMY, OWNERS OF LOT 15, BLOCK 12, AUSTIN
ADDITION,.A SUBSTANTIAL COPY OF SAID QUITCLAIM DEED BEING
ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A '; '
AND DECLARING AN EMERGENCY.b�

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS.
SECTION 1. That the City Manager be and he is hereby authorized

to execute a quitclaim deed quitclaiming that portion of Hiawatha Street
between Old Brownsville Road and Morgan and the island between Hiawatha "
Street and Old Brownsville Road to J. F. Pasdermy and wife, Ann Pasdermy,
owners of Lot 15, Block 12, Austin Addition in the City of Corpus Christi,
all as more fully set forth in the said quitclaim deed, a substantial copy
of which quitclaim deed is attached hereto and made a part hereof marked
Exhibit "A ".

SECTION 2. The necessity to authorize execution of the aforesaid
quitclaim deed in order that said tract may be utilized by the owners of
the abutting property creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no,ordinance or
resolution shall be passed finally on the date of its introduction and that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared that such emergency and necessity
exist, and having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after is passage, IT IS ACCORDINGLY
SO ORDAINED, this the day of , 1977.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES J
THAT the City of Corpus Christi, Nueces County, Texas, in con-
sideration of the sum of ONE DOLLAR AND NO CENTS ($1.00) and other
valuable consideration, the receipt of which is hereby acknowledged,
have Quitclaimed and by these presents do hereby Quitclaim unto J. F.
Pasdermy and wife, Ann, of Nueces County, Texas, all rights, title and
interest in certain lots, blocks, tracts, or parcels of land in the
City of Corpus Christi, Nueces, County, Texas, and being that portion
of Hiawatha Street lying between Morgan Avenue and Old Brownsville
Road closed by City Ordinance Number 13529 and a portion of an
irregularly shaped tract of land out of the L. M. Hitchcock 193•4
acre tract of land in Nueces County, Texas, bounded by Morgan Avenue,
relocated Old Brownsville Road and aforementioned Hiawatha Street,
subject to retention by the City of the entire right -of -way for Utility
Easement save and except the west 10 feet and more particularly des-
cribed by metes and bounds as follows:
Beginning at a point on the south right -of -way line of 80
foot wide Morgan Avenue, said point being the northeast
corner of Lot 15, Block 12, AUSTIN ADDITION as shown by map
of record in Volume 9, Page 25, Map Records, Nueces County,
Texas, for the northwest and beginning corner of the tract
of land herein described;
Thence N. 710 32' E., along the south right -of -way line of
said Morgan Avenue, a distance of 115.17 feet to a point
being the intersection of the south right -of -way line of
said Morgan Avenue and the west right -of -way line of said
relocated Old Brownsville Road;
Thence S. 180 28' E., along the west right -of -way line of
said Old Brownsville Road, a distance of 9.20 feet to a
point being the P.C. of a circular curve to the right;
Thence in a southwesterly direction continue along the
right- of-way line of said Old Brownsville with the arc of
said curve whose central angle is 700 37', radius 40.0 feet,
tangent 28.33 feet, a distance of 49.30 feet to the point
of tangency;

Thence S. 520 09' W., continue along the northwest right -
of way line of said Old Brownsville Road, a distance of
122.07 feet to a point being the southeast corner of above
mentioned Lot 15;
Thence N. 010 30' 30" W., along the east boundary line of
said Lot 15, a distance of 91.35 feet to the place of be-
ginning and containing 7,547.2 square feet of land, more
or less.
To have and to hold all Grantor's right, title and interest in
and to the above described property and premises unto the said Grantees,
their heirs and assigns forever; so that neither the Grantor nor it's
heirs, legal representatives or assigns shall have claim or demand any
right or title to the aforesaid property, premises or appurtenances or
any part thereof with the exception of Utility Easement purpose as noted.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
