HomeMy WebLinkAbout13931 RES - 09/07/1977jkh:9 -6 -77; 1st t A RESOLUTION AMENDING THE SANITARY SEWER MASTER PLAN, ADOPTED BY RESOLUTION NO. 7441 ON DECEMBER 23, 1964, SO AS TO INCLUDE ALL THE AREA ALONG AND EAST OF EVERHART ROAD WHICH COULD BE TIED INTO THE EXISTING GRAVITY LINE BY GRAVITY AND WITHOUT THE USE OF LIFT STATIONS;- PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. WHEREAS, a public,heari'ng on the amendment to the Sanitary -Sewer Master Plan south of Saratoga and along Everhart Road, as herein set forth, was held on August 31, 1977, in the Council Chambers at City Hall, in the City of Corpus Christi; and WHEREAS, said amendment is submitted by the City Manager to the City Council in accordance with the provisiohs of Article V, Section "4 of the City Charter: ...NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Master Plan for Sanitary Sewer, adopted by Resolution No. 7441 on December 23, 1964, be and the same is hereby amended by amending the plan south of Saratoga and along Everhart Road so as to include all the area along and east of Everhart Road which could be tied into the exist- ing gravity line by gravity and without the use of lift °stations. SECTION 2. 'The Sanitary Sewer Master Plan,adopted by Resolution No. 7441, shall.remain in full force and effect except as herein amended. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this resolution shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this resolution, for it is the definite intent of this City Council that every section, paragraph, subdivisicn,clause, phrase, word, or provision hereof be given full* force and effect for its purpose. SECTION 4. The necessity to immediately amend the Sanitary Sewer Master Plan, adopted in 1964, and as previously adopted by the City Council, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor 13931 MICROFILMED JUL 0 7 1980 having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the ?tt day of September, 1977.
