A RESOLUTION
ADOPTING MINUTE ORDER NO. 73267 PASSED BY THE STATE
HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION ON
AUGUST 31, 1977, DESIGNATING A FARM TO MARKET ROAD
FROM STATE HIGHWAY 44 NORTH A DISTAME OF 1.8 MILES,
PRESENTLY KNOWN AS MCKENZIE ROAD; AND DECLARING AN
EMERGENCY.
WHEREAS, the State Department of Highways and Public Transportation
has submitted a copy of Minute Order No. 73267, passed by the State Highway
and Public Transportation Commission on August 31, 1977, as follows:
In NOBLES COUNTY, a FARM TO MARKET ROAD is hereby designated
extending from State Highway 44, 1.5 mile West of Farm to
Market Road 2292, North a distance of approximately 1.8 miles,
subject to the condition that Nueces County and the City of
Corpus Christi will furnish all required right of way clear
of obstructions and free of cost to the State and acquisition
procedures will be in accordance with the applicable Federal
and State laws governing the acquisition policies for
acquiring real property.
At such time as the City and the County shall accept the pro-
visions of this Order and agree to the furnishing of the
required right of way, the Engineer- Director is directed,to
proceed with the engineering and development, Relocation
Assistance at an estimated cost of $300 and construction of the
project in the most feasible and economical manner at an
estimated cost of $294,700 financing the cost in the 1977 Texas
Farm to Market Road and Safer Off System Road Program and to
assume the road for State Maintenance upon completion of
construction.
This Order is subject to acceptance by Nueces County and the City
of Corpus Christi and if not accepted within 90 days of the date
hereof, the action contained herein shall be automatically
cancelled.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Minute -Order No. 73267, passed and approved by the
State Department of Highways and Public Transportation Commission August 31,
1977 designating a farm to Market road from State Highway 44 north a distance
of 1.8 miles, presently known as McKenzie Road, be and the same is hereby
adopted by the City of Corpus Christi, Texas.

SECTION 2. The necessity to immediately adopt the aforesaid
Minute Order creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolu-
tion shall be passed finally on the date of its introduction but that such
ordinance or resolution shall be read at three several meetings of the City
Council and the Mayor having declared that such emergency and necessity
exist, and having requested the suspension of the Charter rule and that
this resolution be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO RESOLVED, this the ,q day of Sj-.h h Ll 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
