HomeMy WebLinkAbout13997 ORD - 10/26/19770 JKH:vp:1O /26/77:lst • TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ,EXECUTE FOR THE CITY OF CORPUS CHRISTI, AS THE PROGRAM AGENT, TITLE II AND TITLE VI COMPREHENSIVE EMPLOYMENT AND TRAINING ACT WORK SITE AGREEMENTS WITH PUBLIC AND NONPROFIT AGENCIES ALLOCATED PUBLIC SERVICE EMPLOYMENT POSITIONS APPROVED BY THE CITY COUNCIL, A SUBSTANTIAL COPY OF WHICH FORM OF AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute for the City of Corpus Christi, as the Program Agent, Title II and Title VI Comprehensive Employment and Training Act work site agreements with public and nonprofit agencies allocated public service employment posi- tions approved by the City Council, a substantial copy of which form of agreement is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to authorize execution at the earliest practicable date of the aforesaid agreement with the public and nonprofit agencies allocated public service employment positions creates a public emer- gency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of October, 1977. B CE AYCOCK, I ATTORNEY BY: I IF A sistant City torney MICROFILMED JUL 071980 12997 TITLE VI COMPREHENSIVE EMPLOYMENT AND TRAINING ACT WORK SITE AGREEMENT This Agreement is entered into between the City of Corpus Christi, hereinafter referred to as "City" and , hereinafter referred to as "Agency" for the use of Title VI Comprehensive Employment and Training Act personnel, This Agreement delineates the program responsibilities of the City and the program responsibilities of the Agency. I. Responsibilities of the City. a. Participants outstationed at the Agency as a work site will be employed by the City and paid at a comparable wage scale as other City employees performing like work in accordance with the City's Compensation and Classification Plan. b. Participants will be employed consistent with the City's hiring procedures and must meet minimum job requirements as established by mutually agreed upon job descriptions. c. Selection and termination of employees must be mutually agreed upon by both the City and Agency. d. The City will pay participants on a bi- weekly basis and maintain payroll fiscal accountability. e. The City will provide and pay workers' compensation benefits for partici- pants outstationed at the agency work site; however. the City will retain the right to control the performance of the work of participants and such participants shall be and remain solely the servants and employees of the City while engaged in work and /or training at the agency work site. f. Participants will be employed as temporary and paid on an hourly rate basis equivalent to the appropriate monthly rate as established by the City's Compensation and Classification Plan. No provision is made for sick leave, holidays, vacation or group life and health insurance coverage. II. Responsibilities of the Agency. a. The Agency will provide participants with a work site, necessary equipment, materials and supplies. b. The Agency will maintain accurate time records as prescribed by the City of work performed and will provide such records as requested to the City. 0 ` 0 • • c. The'Agency will provide on site supervision of participants. • d. Participants will be utilized consistent with the Projeet Data Summary sheet(s) attached hereto as Exhibit "A ". e. The Agency further certifies to the following assurances: 1. It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88 -354). 2. It will comply with the requirement that the participants will not be involved in political activity or work for any political party. 3. The Agency will establish safeguards to prohibit employees, either of the Agency or participants, from using their positions for a purpose that is or gives the appearance of being motivated by desire for private gain for themselves or others, particularly those with whom they have family, business or other ties. 4. No person with responsibilities involved in the operation of the program will discriminate with respect to any program participant or applicant for participation because of race, creed, color, national origin, sea, age, political affiliation or beliefs. 5. Participants in the program will not be employed in the construction, operation, or maintenance of any part of a facility which is used for religious instruction or worship. 6. Appropriate standards for health and safety in work sites will be maintained. 7. The participants will not result in the displacement of employed workers or impair existing contracts for services. 8. The Agency shall furnish any information which may be necessary for the City to comply with the regulations of the Department of Labor pertaining to the Title VI Comprehensive Employment and Training Act program. This Agreement shall take affect on and terminate on In Witness Whereof, the parties hereto have executed this Agreement: Agency By Title Address City of Corpus Christi City sy Title Date Corp Christi, Texas .;4 day of Auk. , 1977 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
