HomeMy WebLinkAbout14000 ORD - 10/26/1977• :Mvmr:10- 26- 77;1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTIONS OF LOTS 6 AND 7, _SECTION 11 BOHEMIAN COLONY LANDS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COMM, TEXAS, FROM "A -1" APARTMENT HOUSE DISTRICT TO "B -3" BUSINESS DISTRICT ON TRACT A AND FROM "A -1" APARTMENT HOUSE DISTRICT TO "R -1B" ONE- FAMILY DWELLING DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ti Rte, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday_, October 19, 1977 at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 61069 as amended, be and the same is hereby amended by making the change hereinafter set out. That the Zoning on Tract A and Tract B being portions of Lots 6 and 7, Section 11, Bohemian Colony Lands situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "A -1" Apartment House District to "B -3" Business District on Tract A and from "A -1" Apartment House District to "R -1B" One - Family Dwelling District on Tract B, said portions of Tract A and Tract B being described as follows: TRACT A BEGINNING at a point on the Southeast right -of -way line of P.M. Highway #43 (Weber Road) for the North corner of this tract from which the point of intersection of the Southeast right -of- way line of P.M. Highway 843 and the Southwest right -of -way line of Acpshnet Drive bears North 29 °00'00" East 609.92 feet; THENCE North 61 °00'00" West 442.38 feet to the point of curva- ture of a circular curve to the left whose radius point bears South 45 °37105" East 485.58 feet and has a central angle of 15 °221550, a radius 485.58 feet, a tangent distance of 107.65 feet for an arc length of 130.36 feet and the East corner of this tract, THENCE with said curve to the left 130.36 feet to the point of tangency; THENCE South 29 °00100" West 605.80 feet to the South corner of this tract; THENCE North 61 128110" West 425.00 feet to a point on the Southeast right -of -way line of F.M. Highway #43 for the West corner of this tract; THENCE North 29 °00100" East along the Southeast right -of =way line of F.M. Highway 843 738.08 feet to the POINT OF BEGINNING. TRACT B BEGINNING at the West corner of Country Club Estates Unit29 , a map of which is recorded in volume 42, Page 38 of said Map Records for an inside corner of this survey] THENCE along the Southwest subdivision line of said Unit 19, South 43 °00100" East 320.00 feet; South 58 °00'00" East 400.00 feet and South 70 °30128" East 317.90 feet to,a point on the West right -of- way line of Aaron Drive for the South corner of said Country Club Es- tates Unit 29 and the point of curvature of a circular curve to the left whose radius point bears North 75 °53'28" East 649.47 feet and has a central angle of 08 °49118 ", a radius of 649.47 feet, a tangent distance of 50.10 feet for an are length of 100.00 feet; THENCE with said curve to the left, along the West right -of -way line of Aaron Drive, 300.00 feet to the point of tangency and the point of curvature of a circular curve to the right which has a cen- tral angle of 51 °271410, a radius of 586.69 feet, a tangent distance of 282.74 feet for an arc length of 526.95 feet; THENCE with said curve to the right, along said right -of -way line, 526.95 feet to the point of tangency; THENCE South 28 °31'50" West, with said West right -of -way line of Aaron Drive, parallel to the centerline thereof and 30.00 feet distant therefrom, measured at right angles thereto, 91.89 feet to the South corner of this survey; THENCE North 61 °28110" West 1,606.92 feet to the West corner of this survey; THENCE North 29 °00'00" East 605.80 feet to the point of curvature of a circular curve to the right which has a central angle of 25 °00100 ", a radius of 485.58 feet, a tangent distance of 107.65 feet for an arc length of 211.87 feet; THENCE with said curve to the right, 212.87 feet to the point of tangency; THENCE North 54 °00'00" East 593.17 feet to a point on the South- west right -of -way line of Acushnet Drive for the North corner of this survey and the point of curvature of a circular curve to the right whose radius bears South 34 °22'23" West 351.67 feet and has a central angle of 42 °24133 ", a radius of 351.67 feet, a tangent dis- tance of 136.44 feet for an arc length of 260.30 feetj THENCE with said curve to the right, along said Southwest right - of -way line of Acushnet Drive, 260.30 feet to the point of tangency and the point of curvature of a circular curve to the left which has a central angle of 01 °59134 ", a radius of 485.04 feet, a tangent dis- tance of 8.44 feet'for an arc length of 16.87 feet; THENCE with said curve to the left, along the Southwest right -of -way ling of Acushnet Drive, 16.87 feet to the North corner of said Country Club Estates Unit 29 for a corner of this survey; THENCE South 54 °00'00" West, along the Northwest subdivision line of said Unit 29, 580.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus. Christi. Texas. be, and the some is hereby, amended as herein ordained. sECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi. Texas. approved on the 27th day of August. 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect// K from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of �• 19-v.
