HomeMy WebLinkAbout14001 ORD - 10/26/1977• jkh:10 -26 -77 • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH. 1961, BY AMENDING ARTICLE 31, NEWLY PATENT NO. 208, NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING Ali EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on October 26, 1977, at Regular Council Meeting of the _City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follow: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "B -1" Neighborhood Business District should be granted to the tract of land described herein by metes and bounds, being a 1.713 acre tract; and, that permanent zoning of "R -2" Multiple Dwelling District should be granted to the tract of land described herein by metes and bounds, being a 12.500 acre tract. (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning. WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amend- ments would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31 -5, by adding thereto a new subsection to be numbered Section 31 -5.17, said new subsection to hereafter read as follows: "Section 31 -5.17 The following described tract of land shall be zoned and classified "B -1" Neighborhood Business District: That parcel or tract consisting of 1.713 acres of land out of a 47.939 acre tract out of Survey No. 419, State Abstract 570, Patent No. 208, more particularly described by metes and bounds as follows: BEGINNING at a 2 inch iron pipe found at the point of inter- section of the East right -of -way line of McKenzie Road and the South right -of -way line of McKenzie Lane (Sid Allison Road) for the Northwest corner of said 47.939 acre tract and the Northwest corner of this tract; THENCE South 81 °00'00" East, along said South right -of -way line of McKenzie Lane (Sid Allison Road), 300.00 feet for the Northeast corner of this tract; THENCE South 09 °00100" West 303.92 feet to a point on the South property line of said 47.939 acre tract for the Southeast corner of this tract; THENCE North 61 °03'35" West, with said South property line, 316.61 feet to a 2 inch iron pipe found on said East right -of -way line of McKenzie Road for the Southwest corner of said 47.939 acre tract and the Southwest corner of this survey; THENCE North 08 °18'24" East, along said East right -of -way with the West property Sine of said 47.939 acre tract, 195.96 feet to the POINT OF BEGINNING. -2- SECTION 3. That there is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31 -5, by adding thereto a new subsection to be numbered Section 31 -5.18, said new subsection to hereafter read as follows: "Section 31 -5.18 The following described tract of land shall be zoned and classified "R -2" Multiple Dwelling District: That parcel or tract consisting of 12.500 acres of land out of a 47.939 acre tract out of Survey No. 419, State Abstract 570, Patent No. 208, Nueces County, Texas, more particularly described by metes and bounds as follows: BEGINNING at a point-on the South right -of -way line of McKenzie Lane ( Sid Allison Road) same being the North property line of said 47.939 acre tract for the Northwest corner of this tract from which corner the point of intersection of said South right -of -way line of McKenzie Lane (Sid Allison Road) and the East right -of -way line of McKenzie Road being the Northwest corner of said 47.939 acre tract bears North 81 100'00" West 300.00 feeti THENCE South 81 "00'00° East, along said South right -of -way line, 1,086.72 feet for the Northeast corner of this tract; THENCE South 09 °00'00" West.698.17 feet to a point on the South property line of said 47.939 acre tract for the Southeast corner of this tract from which corner the Southeast corner of said 47.939 acre tract bears South 61 "03135" East 1,474.72 feet; THENCE North 61 "03'35" West, along said South property line of the 47.939 acre tract, 1,156.03 feet for the Southwest corner of this tract; THENCE North 09 100'00" East 303.92 feet to the POINT OF BEGINNING. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. The necessity for making the aforesaid changes immediately for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at -3- three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .o day of , 1977.
