HomeMy WebLinkAbout14007 ORD - 11/09/1977THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the 9th day of November, 1977, the City Council of the City of Corpus Christi, Texas, convened in Regular Meeting, with the following members of said Council ii present, to -wit: Jason Luby, Mayor Eduardo de Ases, Mayor Pro -Tem David Diaz Ruth Gill Bob Gulley , Gabe Lozano, Sr. Edward L. Sample R. Marvin Townsend, City Manager J. Bruce Aycock, City Attorney Bill G. Read, City Secretary with the following absent: N O N E , constituting a quorum, at which time the following among other business was transacted: Mr. Luby, Mayor, presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communication in writing pertaining to said proposed ordinance, as followst "Corpus Christi, Texas November 9, 1977 "TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas i For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council. The Mayor announced that the ordinance has been passed. The ordinance is as follows: l ORDINANCE CANVASSING ELECTION RETURNS THE STATE OF TEXAS - COUNTY OF NUECES CITY OF CORPUS CHRISTI WHEREAS, the City Council.of said City duly ordered an election to be held in said City on the 8th day of November, 1977, on the Propositions hereinafter stated; and IMREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding, and making returns of said election; and 0 MEAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordi- nance is passed, such emergency or urgent public necessity , being that the proceeds from the sale of the proposed bonds are required as soon as possible and without delay for necessa and urgently needed public improvements; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon °s Ann_ Civ. St.-article 6252 -17, as amended, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election; that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election, 2. That the City Council officially finds, determines and declares the result of said election to be that each Proposition so submitted has received a favorable majority vote in all respects and has carried, and that the aforesaid bonds and certificates of obligation may be issued and taxes may be levied, assessed and collected annually, as voted and as pro- vided by law. 4. That it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is I passed, such emergency or urgent public necessity being that the proceeds from the sale of the proposed bonds and certificates of obligation are required as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting was open to the public, and public notice of the it time, place and purpose of said meeting was given, all as re- i quired by Vernon's Ann.
