PROJECT NO. 08 -51- 21019); AUTHORIZING EXE- CUTION OF CHANGE ORDER NO. 1 TO THE CONTRACT PRO- VIDING FOR AN INCREASE IN THE UNIT PRICE OF THE HOT - MIX OVERLAY, SUBJECT TO CONCURRENCE FROM THE UNITED STATES DEPARTMENT OF COMMERCE, ECONOMIC DEVELOPMENT ADMINISTRATION; APPROPRIATING $664,000 OUT OF THE NO. 162 FEDERAL /STATE GRANTS FUND, ACTIVITY 4721, CODE 502, PUBLIC WORKS IMPROVEMENTS, OF WHICH $609,989.25 IS FOR THE CONSTRUCTION CONTRACT, $4,106 IS FOR CHANGE ORDER NO. 1, AND $49,904.75 IS FOR ADDITIONAL ENGINEERING, LABORATORY TESTING, LEGAL ADVERTISING, AND INCIDENTAL AND RELATED EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized r� to execute a contract with Asphalt Paving and Construction Company (APCCO) for replacement of the South Staples water line (E.D.A. Project No. 08 -51- 21019), all as more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference, and according to the bid of Asphalt Paving and Construction Company (APCCO), opened on the 2nd day of November, 1977, said bid being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. That the City Manager be and he is hereby authorized to execute Change Order No. 1 to the contract, providing for an increase in the unit price of the hot -mix overlay, subject to concurrence from the United States Department of Commerce, Economic Development Administration. SECTION 3. That there is hereby appropriated the sum of $664,000 out of the No. 162 Federal /State Grants Fund, Activity 4721, Code 502, Public Works Improvements, of which $609,989.25 is for the construction contract, $4,106 is for Change Order No. 1, and $49,904.75 is for additional engineering, laboratory testing, legal advertising, and incidental and related expenses. SECTION 4. The necessity to authorize execution of the aforesaid contract and change order, and to provide the sums necessary to enable the aforesaid construction to be commenced at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be MICRGFILMER 1403(-) JUL 0°71980 passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of November, 1977. (If left off the plans and specifications, explain why.) To compensate contractor for overhead and profit distribution because of cut back in amount of hot -mix asphalt overlay work to be performed. How can similar changes be avoided in the future? V FIN 2 -55 1% Revised 7/31/69 Corpus Christi, Texas day o ig77 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or .requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of.the City Council.
