HomeMy WebLinkAbout14041 ORD - 11/16/19770 jkh:11- 16- 77;lst TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE TEXAS JAll FESTIVAL SOCIETY FOR PRESENTATION OF A FREE JAll FESTIVAL, A STAGE BAND COMPETITION AND FREE BAND CLINICS ON JULY 8 AND JULY 9, 1978, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized C to-enter into an agreement with the Texas Jazz Festival Society for presenta- tion of a free jazz festival, a stage band competition and free band clinics on July 8 and July 9, 1978, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to enter into the aforesaid agreement at the earliest practicable date creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its intro- ductionand take effect and be in full force and effect; from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the�d"ay of November, 1977. BRUCE AYCOCK, CITY ATTORNEY signature of the Mayor, in accordance with Article II B Section 6 of the City Charter. y Assistant C orney MICROFILMED JUL 0 71980 14041 AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES p WHEREAS, the City of Corpus Christi is interested in bringing to the citizens a major Jazz Festival, a high school stage band competition, and band clinics, free to the public; and WHEREAS, the Texas Jazz Festival Society has a program of provid- ing an annual Jazz Festival and related events free to the public; and WHEREAS, the Texas Jazz Festival Society agrees to provide the following program: A. A Jazz Festival in Memorial Coliseum, free to the public, on Sunday, July 9, 1978. B. Stage band competition and free clinics on Saturday, July 8, 1978. In consideration of the Texas Jazz Festival Society providing the above and foregoing music program, the City of Corpus Christi agrees to pay to the Texas Jazz Festival Society the sum of $5,000 for expenses of the Festival activities. Payment, however, is conditioned upon presentation to the City by the said Jazz Festival Society of bills as they become due and payable, signed by the Treasurer and one other designated officer of said Jazz Festival Society. Expenses will be limited to fees and lodging for bands of performers, expenses for the Memorial Coliseum on July 8 and July 9, 1978, and promotion and printing for jazz musical activities spon- sored by the Jazz Festival Society during the period of November, 1977 through July, 1978. The Jazz Festival Society shall submit to the Manager of the Memorial Coliseum a copy of all receipts and statement of expendi- tures for the dance to be held in Memorial Coliseum, July 8, 1978, at the earliest practicable date, which dance is to be held for the purpose of raising funds for the Jazz Festival. The Texas Jazz Festival Society further agrees that Coliseum expenses for the said dance are not to be included for payment by the City unless and until copy of receipts and a statement of expenditures for the dance, as aforesaid, are submitted to and approved by the City.
