HomeMy WebLinkAbout14044 ORD - 11/16/19771RH:vmr:11- 11- 77;1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A TRACT OF LAND OUT OF LOT 1, SECTION 12, BOHEMIAN COLONY LANDS, AND A PORTION OF LOT 7, SECTION 11, BOHEMIAN COLONY LANDS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B -4" GENERAL BUSINESS DISTRICT TO "B -3" BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which bearing all person• wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday November 16, 1977 at Regular Council Meeting of the City Council in the Council Chamber at City Hall is the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was- decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the Zoning on the following described portions of Lot 1, Section 12, Bohemian Colony Lands, and of Lot 7, Section 11, Bohemian Colony Lands, being Tract A and Tract B, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "B -4" General Business District to "B -3" Business District, said portions of Tract A and Tract B being more particularly described as follows: Tract A Being a portion of Lot 1, Section 12, Bohemian Colony Lands as recorded in Volume A, Page 48, Nueces County Map Records, Nueces County, Texas. BEGINNING at the southwest corner of the intersection of Weber Road and Saratoga Boulevard for the most easterly northeast corner and Point of Beginning of this tract; THENCE with the westerly right -of -way line of Weber Road South 29° West 235 feet, more or less, to the southeast corner of this tract; THENCE North 61 °29'30" West 470 feet, more or less, to the southwest corner of this tract; THENCE North 29° East, 370 feet, more or less, to the south right -of -way line of Saratoga Boulevard for the northwest corner of this tract; THENCE with said right -of -way line, South 61 °29'30" East, 240 feet, South 31 °29' East, 270 feet, more or less, to the Point of Beginning, being approximately 3.4 acres. Tract B Being a portion of Lot 7, Section 11, Bohemian Colony Lands as recorded in Volume A, Page 48, Nueces County Map Records, Nueces County, Texas. BEGINNING at the southeast corner of the intersection of Saratoga Boulevard and Weber Road for the northwest corner and Point of Beginning of this tract; THENCE with the southerly right -of -way line of Saratoga Boulevard North 88 043'54" East, 208.4 feet, South 61 °29'30" East, 330.48 feet, to the northeast corner of this tract; THENCE South 28 °31'50" West, 710.1 feet, to the north right -of -way line of Acushnet Drive for the southeast corner of this tract; THENCE with said right -of -way line North 61 °28'10" West, 516.29 feet, to the east right -of -way line of Weber Road for the southwest corner of this tract; THENCE with said right -of -way line North 29° East, 606.51 feet, to the Point of Beginning, being approximately 8.3 acres. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative piublic necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, . and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from: after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of . 3-9_Z7• ATTEST: City Secretary MAYOR THE CITY OF CORPUS CHRISTI, TEXAS APP VED: DAY 0 , p_7 7 This ordinance is in effect and force with or without the J.
