AN ORDINANCE
ANNEXING THAT PORTION OF SUNTIDE (VIOLA) ROAD RIGHT
OF WAY LYING BETWEEN THE NORTHEASTERLY RIGHT OF WAY LINE
OF I.H. 37 DESCRIBED HEREINAFTER, PURSUANT TO ARTICLE
970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER
ARTICLE I, SECTION 2(c), PROVIDING FOR THE ANNEXATION TO
THE CITY OF CORPUS CHRISTI OF ROADS, HIGHWAYS, AND STREETS
ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI;
PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, on the 9th day of November, 1977, a public hearing was
duly held at the Regular Council Meeting of the City Council, following
publication of due notice of said hearing in the official newspaper, pur-
suant to Article 970a, V.A.C.S., Texas, as amended, for the consideration
of proceedings for the annexation of a defined area wholly within the extra-
territorial Jurisdiction of Corpus Christi, including a portion of Suntide
(Viola) Road, more particularly described hereinafter, at which all interested
persons were afforded an opportunity to be heard, and by motion duly made,
seconded and carried the said hearing was closed on November 9, 1977; and
WHEREAS, it has been determined by the City Council that the
territory above mentioned, and now proposed to be annexed, abuts and is
contiguous and is adjacent to the City of Corpus Christi and constitutes
lands and territories dedicated to a public use within the meaning of
City Charter, Article I, Section 2(c); and
WHEREAS, it has been determined that it would be advantageous
to the City and to its citizens and in the public interest to annex the
aforesaid hereinafter more fully described area:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby annexed a portion of Suntide
(Viola) Road, in Nueces County, Texas, pursuant to Article 970a, V.A.C.S,
as amended, and City Charter Article I, Section 2(c), said area being more
fully described by metes and bounds as follows:

Being that portion of Suntide (Viola) Road right of way
lying between the northeasterly right of way line of I.H. 37
and the southwesterly right of way line of UpRiver Road and
more particularly described as follows:
Beginning at the point of intersection of the northeasterly
right of way line of said I.H. 37 and the West right of
way line of said Suntide Road, said point being an angle
point in the present city limit line as described in City
Ordinance No. 6636;
Thence N. 00" 48' 20" E. along the West right of way line
of said Suntide Road a distance of 8.6.36 feet to an
interior angle point;
Thence N. 32" 51' 12" W. continue along the Southwest
right of way line of said Suntide Road a distance of 66.59
feet to its intersection with the southwesterly right of
way line of above mentioned Up River Road;
Thence S. 66" 16' E. along an extension of the southwesterly
right of way line of said Up River Road a distance of
144.65 feet to its intersection with the easterly right of
way line of said Suntide Road;
Thence S. 54" 00' W. along the southeasterly right of way
line of said Suntide Road a distance of 45.0 feet, more or
less, to a point;
Thence S. 00" 48 20" W. continue along the East right of
way line of said Suntide Road a distance of 789.66 feet to
its intersection with the Northeast right of way line of
said I.H. 37;
Thence N. 89" 11' 40" W. cross the intersection of said
Suntide Road and said I.H. 37 on a line that is normal to
the East right of way line of said Suntide Road a distance
of 60.0 feet to the place of beginning and containing 1.185
acres, more or less.
The above described area shall hereafter be a part of the City of
Corpus Christi, Texas, and shall be subject to the general laws of the State
of Texas, the City Charter of the City of Corpus Christi and the ordinances,
resolutions, laws, rules and regulations of the City of Corpus Christi, to
all intents and purposes as the present City of Corpus Christi is so subject,
and subject to all the rights, privileges and burdens thereof.
SECTION 2. This ordinance of annexation shall be effective
from and after its passage.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase,word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance, for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,

phrase, word, or provision hereof be given full force and effect for its.
purpose.
SECTION 4. The necessity to immediately annex to the City of
Corpus Christi the aforesaid lands and to declare that they shall hereafter
be a part of the corporate limits of the City of Corpus Christi, creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction, but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and an necessity exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
