ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE TWO AGREEMENTS WITH THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR CITY PARTICIPATION IN THE SIGNALIZA- TION OF SIX MAJOR INTERSECTIONS, SUBSTANTIAL COPIES OF WHICH ARE ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBITS "A" AND "B "; APPROPRIATING $6,780 OUT OF THE NO. 220 STREET BOND FUND, APPLICABLE TO PROJECT NO. 220 -72 -14.4, TRAFFIC SIGNALIZATION.AT THE FOLLOWING SIX 4OCATIONS: Leopard and Tancahua; Tancahua and Lipan; Carancahua and Lipan; Leopard and Carancahua; Alemeda and Louisiana; and Staples and Morgan; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute two agreements with the State Department of Highways and Public Transportation for City participation in the signalization of six major Intersections, substantial copies of which are attached hereto and made a part hereof, marked Exhibits "A" and "B ". SECTION 2. That there is hereby appropriated out of the No. 220 Street Bond Fund the sum of $6,780, applicable to Project No. 220 -72 -14.4, Traffic Signalization at Six Locations: 1. Leopard and Tancahua; 2. Tancahua and Lipan; 3: Carancahua and Lipan; 4. Leopard and Carancahua; 5. Alameda and Louisiana; and 6. Staples and Morgan. SECTION 3. The necessity to authorize execution of the aforesaid agreements and the appropriation of the necessary funds to accomplish the signalization at the described locations creates a public emergency and an Imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of.its MICROFILMED, 14071 7JUL 0 7 P, a introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the_j_� day of December, 1977. HHS OOOS(197) Nueces County STATE OF TEXAS X X ' COUKIY OF TRAVIS X THIS AGREEMENT, by and between the City of Corpus Christi, hereinafter called the "City", Party of the First Part, acting by and through its duly authorized officers and the State of Texas, acting by and through the State Department of Highways and Public Transportation, hereinafter called the "State ", Party of the Second Part, made to become effective when fully executed by both parties: W I T N E S S E T H WHEREAS, Section 209 and Section 210 of the Federal -Aid Highway.Act of. 1973 provide for projects to eliminate or reduce hazards and roadside obstacles on any Federal -aid highway system other than the Interstate System; and WHEREAS, the State Highway and Public Transportation Commission recognizes the need for said program and desires to cooperate with the local government and to promote the program insofar as available State funds will permit and within legal limitations imposed by State statutes; and WHEREAS, the State Highway and Public Transportation Commission has es- tablished Departmental policy for said program and requires that for projects not a part of the State Highway System funds required to match available Federal aid will usually be provided from sources other than the State and such funds will be in the amount of 102 of the total estimated cost of the project including engineering and contingencies; and WHEREAS. the City desires certain work as approved in the Statewide Highway Safety Improvement Program (Federal- Section 209 and 210) in accordance with the attached list marked "Exhibit A "; and WHEREAS. should the project be abandoned after preliminary engineering work is underway then the City will be responsible for all costs not reimbursable by the Federal Highway Administration but limited to 109 of the estimated project cost. The City upon request of the State shall remit this amount in the form of a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927; and WHEREAS, at least 30 days prior to scheduled letting or issuance of work order for state force account work the City upon request of the State shall transmit a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of One Thousand Five Hundred and No /100 Dollars ($1,500.00), which is 10% of the total estimated cost of the project including preliminary engineering, construction, construction engineering and contingencies. A G R E E M E N T NOW THEREFORE, it is agreed that the State will provide for said work and the City will upon request of the State at least 30 days prior to scheduled letting or issuance of a work order for state force account work transmit to the State a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of One Thousand Five Hundred and No /100 Dollars ($1,500.00), which is 10% of the total estimated cost of the project including preliminary engineering, construction, construction engineering and contingencies. If, during project development or construction or upon completion of the project, it is determined that this amount is not sufficient to fulfill the City's re- sponsibility, the City will, upon request of the State, supplement this amount by an amount equal to the City's full estimated cost less the amount previously paid. In the event the amount paid by the City is more than the City's. responsibility, the excess amount will be returned to the•City. In the event the project be 2. abandoned after preliminary engineering work is underway then the City will be responsible for all coats not reimbursable by the Federal Highway Administration but limited to 10% of the estimated project cost. The City upon request of the State shall remit this amount in the form of a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927. IT IS FURTHER agreed that the City will operate and maintain all of the work constructed as part of the project in a manner suitable to the State.
