A RESOLUTION
URGING RENEWAL OF A LOAN AGREEMENT BETWEEN THE
ENVIRONMENTAL PROTECTION AGENCY AND THE CORPUS
CHRISTI AREA OIL SPILL CONTROL ASSOCIATION WHEREIN
A MECHANICAL DEVICE FOR CLEANSING OIL SOAKED BEACH
SAND IS PLACED IN THE CUSTODY AND CARE OF THE SPILL
ASSOCIATION; INSTRUCTING THE CITY SECRETARY TO
FURNISH TRUE COPIES OF THIS RESOLUTION TO APPRO-
PRIATE OFFICIALS OF THE ENVIRONMENTAL PROTECTION
AGENCY; AND DECLARING AN EMERGENCY.
WHEREAS, the Environmental Protection Agency and the Corpus
Christi Area Oil Spill Control Association entered into an agreement in 1973
whereby the Environmental Protection Agency assigned, on a loan basis, to
the Corpus Christi Area Oil Spill Control Association a mechanical device
for cleansing oil soaked beach sand, and
WHEREAS, at the time of assignment it was decided by the En-
vironmental Protection Agency that Corpus Christi was the most logical
place for storing such a unit, primarily because of our beach area extending
from Brownsville to near Houston, and
WHEREAS, the Spill Association has expended several thousands of
dollars in sand blasting, painting and repairing various mechanical devices
on the unit, and has kept it in good and operable condition, and
WHEREAS, the Corpus Christi area is a high risk area insofar as
oil contamination is concerned, and the Association desires to use the
unit for further research, and
WHEREAS, the loan agreement expires in January 1978, and
WHEREAS, the Spill Association as well as the City Council
desires to retain use of the beach cleaning device in the Coastal Bend area,
and to that end desires and urges renewal of the loan agreement with the
Environmental Protection Agency:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. The City Council of the City of Corpus Christi hereby
requests and urges the Environmental Protection Agency to renew for an addi-
tional term the loan agreement with the Corpus Christi Area Oil Spill Control

Association wherein a mechanical device for cleansing oil soaked beach
sand is charged to and placed in the care of the Spill Association.
SECTION 2. The City Secretary is hereby instructed to furnish
true copies of this resolution to appropriate officials of the Environmental
Protection Agency and any other interested public officials.
SECTION 3. The necessity to renew the loan agreement for a
mechanical device for cleansing oil soaked beach sand with the Environmental
Protection Agency at the earliest practicable date creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date of
its introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, having requested the suspension of the
Charter rule and that this resolution take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED this the
day of December, 1977.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
