HomeMy WebLinkAbout14090 ORD - 12/21/1977TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE ART COMMUNITY CENTER FOR SUPPORT OF THE ART MUSEUM, AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby, authorized and directed, for and on behalf of the City of Corpus Christi, to enter into an agreement with the Art Community Center for support of the Art Museum, as more fully set forth in the agreement, a substantial copy of which is attached hereto and marked Exhibit "A ". SECTION 2. That the necessity to authorize the execution of the aforementioned agreement at an early date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .2j— day of December, 1977. BY: AW,4, Assistant C ty Attorney MICROFILMED 14UP3 JUL 0 7 T90 AGREEMENT THE STATE OF TEXAS II COUNTY OF NUECES Q WHEREAS, the City of Corpus Christi, hereinafter referred to as "City" owns and has leased to the Art Community Center, hereinafter referred to as "Center ", the buildings and fixtures at 902 Park Avenue in South Bluff Park for a period of five years ending December 6, 1981; and WHEREAS, City under the terms of the abovementioned lease provides cleaning and restroom supplies, maintenance of the exterior of the building and grounds, paints the interior of the building as needed, pays all utility bills except telephone service, and includes the building in its fire and extended coverage and liability insurance policies; and WHEREAS, Center, a nonprofit organization, provides opportunities for all citizens of Corpus Christi to broaden their appreciation of the arts; NOW, THEREFORE, in consideration of the covenants and agreements contained herein, the parties hereto do hereby agree to the following: 1. Center agrees to keep the Museum open six days per week consistent with the City's leisure services programs; to levy no admission charges on the general public attending events presented by Center; that membership in Center will be open to all citizens who have an active interest in art; and to provide art shows, workshops, lectures, art classes and facilities for winter tourists to paint while visiting Corpus Christi. ATTEST: 2. City agrees to pay Center for the 1977 -78 fiscal year a sum not to exceed $2,500 for postage, office supply, printing and telephone expenses incurred by Center.
