HomeMy WebLinkAbout14097 ORD - 12/21/1977AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF RFN M17ARKS . FT Al BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF LOTS 3 AND 4 OSO FARM TRACTS. SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FEM "A -1" APARTMENT HOUSE DISTRICT TO "A -2" PARVENT HOUSE DISTRICT : KEEPING IN EFFECT ALL OTHER PROVSSIONS- OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Ben Marks, et al for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all peisons. wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday December 21, 1977 , at Snecial Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WMEAS, by motion duly made, seconded and carried, it. was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. MICROFILMED 14097 Juv 01 19 0 SECTION 4 That the zoning of the hereinafter described portion of Lots 3 and 4, Oso Farm Tracts, be and the same is hereby changed from "A -1" Apartment House District to "A -2" Apartment House District: FIELDNOTES for 6.06 acres of land proposed for -A -2 zoning out of Lots 3 and 41 Oso Farm Tracts, a map of which is recorded in Volume A, Page 49, Map Records of Nueces County, Texas: BEGINNING at the South corner of Lot 4, Block 2, Marks Tract, a map of which is recorded in Volume 39, Page 132 of said map re- cords for the North corner of Block D, Levek Tract, a map of which is recorded in Volume 41, Pages 174, 175 of said Map Records and the East corner of this tracts THENCE South 29 °01100" West, along the Northwest boundary line of said Block D, Levek Tract, 321.10 feet for the South corner of this tract; THENCE North 60 °59'00" West, along the common existing R -2, A -1 zone line, 816.09 feet for the West corner of this tract; THENCE North 29 °02'00" East 324.42 feet for a point on the Southwest right -of -way line of Corona Drive for the North corner of this tract; THENCE South 60 058'00° East, along said Southwest right -of -way line, 362.13 feet for the point of intersection with the Southeast right -of -way line of Embassy Drive and a corner of this tract; THENCE South 60 °34137" East 453.88 feet to the POINT OF BE- GINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 19370 as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION S. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension -2- of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, day of 19%1.
