AN ORDINANCE
AMENDING ORDINANCE NO. 13933, PASSED AND APPROVED
BY THE CITY COUNCIL ON SEPTEMBER 7, 1977, BY REDUCING
THE APPROPRIATION FOR ENGINEERING SERVICES PROVIDED
BY MCCAUGHAN, ETHERIDGE & WEBB, CONSULTING ENGINEERS,
IN CONNECTION WITH STEP III PORTION OF E. P. A. GRANT
NO. C -48- 1216 -03, APPLICABLE TO THE BROADWAY WASTEWATER
SYSTEM IMPROVEMENTS, PROJECT NOS. 250 -72 -1 AND 250 -72 -8,
FROM $298,300 TO $267,300; AUTHORIZING AN AMENDMENT TO
THE ENGINEERING CONTRACT AUTHORIZED BY SAID ORDINANCE
SO AS TO REFLECT THE REDUCED APPROPRIATION, ALL AS MORE
FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED
EXHIBIT "A "; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 13933, passed and approved by the
City Council on September 7, 1977, be and the same is hereby amended by
reducing the appropriation for engineering services provided by McCaughan,
Etheridge & Webb, Consulting Engineers, in connection with the Step III
portion of E. P. A. Grant No. C -48- 1216 -03, applicable to the Broadway
Wastewater System Improvements, Project Nos. 250 -72 -1 and 250 -72 -8, from
$298,300 to $267,300.
SECTION 2. That the City Manager be and he is hereby authorized
to execute an amendment to the Engineering Contract authorized by Ordinance
No. 13933, all as more fully set forth in the contract amendment, a substan-
tial copy of which is attached hereto, marked Exhibit "A ", and made a part
hereof.
SECTION 3. That the necessity to authorize the execution of the
aforesaid amendment to the contract for engineering services and to reduce
the appropriation for engineering services, all as more fully set forth in
the amendment to contract, creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance

or resolution shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take

effect and be in full force and effect from and after its passage, IT IS

AMENDMENT TO CONTRACT FOR ENGINEERING SERVICES
THE STATE OF TEXAS X
COUNTY OF NUECES I
The City of Corpus Christi, hereinafter called "City ", and McCaughan,
Etheridge S Webb, hereinafter called "Engineer ", agree to the following
amendment to the contract for engineering services approved by Ordinance No.
13933 and executed September 7, 1977.
1. Section C.1, Basic Services, Item b., "Provide to the City not to
exceed 25 copies each of the plans and specifications prepared
under Step 2 for each Phase, .five of which copies shall be for the
use of the Engineer," is amended to read "The City will provide
all necessary copies of the construction contract plans and speci-
fications for bidding and construction, using tracings and master
copies provided by the Engineer under Step 2."
2. Section C.3, Start Up Services, is amended by adding Item i. as
follows, "It is agreed that the Engineer's proposal and this
contract do not include the provision of the services of a certi-
fied plant operator by the Engineer, as called for in the E.P.A.
Regional Policy memorandum on Start Up Services." The City will
provide a certified operator for this service.
3. Section E.1, Amount of Fee, is amended by changing the fees for
Basic Services to the following amounts:
Fee
Phase 1 $ 50,000
Phase 2 $ 12,000
Phase 3 $ 36,000
except that in the event the fees for Phase 2 or Pbase 3 be not
approved by the Environmental Protection Agency, they shall be
renegotiated.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
