HomeMy WebLinkAbout14108 ORD - 12/28/1977• JKH:vp:12 /.2$/77:1-st • AN ORDINANCE AMENDING ORDINANCE NO. 13934, PASSED AND APPROVED BY THE CITY COUNCIL ON SEPTEMBER 7, 1977, BY REDUCING THE APPROPRIATION FOR ENGINEERING SERVICES PROVIDED BY McCAUGHAN, ETHERIDGE & WEBB, CONSULTING ENGINEERS, IN CONNECTION WITH THE STEP III PORTION OF E. P. A. GRANT NO. C -48- 1217 -03, APPLICABLE TO THE WESTSIDE WASTEWATER SYSTEM IMPROVEMENTS, PROJECT NO. 250- 72 -11, FROM $52,500 TO $46,500; AUTHORIZING AN AMENDMENT TO THE ENGINEERING CONTRACT AUTHORIZED BY SAID ORDINANCE SO AS TO REFLECT THE REDUCED APPROPRIATION, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 13934, passed and approved by the City Council on September 7, 1977, be and the same is hereby amended by reducing the appropriation for engineering services provided by McCaughan, Etheridge & Webb, Consulting Engineers, in connection with the Step III portion of E. P. A. Grant No. C -48- 1217 -03, applicable to the Westside Waste- water System Improvements, Project No. 250- 72 -11, from $52,500 to $46,500. SECTION 2. That the City Manager be and he is hereby authorized to execute an amendment to the Engineering Contract authorized by Ordinance No. 13934, all as more fully set forth in the contract amendment, a substan- tial copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 3. That the necessity to authorize the execution of the aforesaid amendment to contract for engineering services, all as more fully set forth in the amendment to contract creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of Its introduction and take effect and be in full force and effect from and MICROFILMED 14108 JUL 0 71980 -1111 n 7 ann^ after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of December, 1977. BRUCE AYCOCK, C Y ATTORNEY BY: A sistant Citr Attorne AMENDMENT TO CONTRACT FOR ENGINEERING SERVICES THE STATE OF TEXAS X COUNTY OF NUECES X The City of Corpus Christi, hereinafter called "City ", and McCaughan, Etheridge 6 Webb, hereinafter called "Engineer ", agree to the following amendment to the contract for engineering services approved by Ordinance No. 1393y -and executed September 7, 1977. 1. Section C.1, Basic Services, Item b., "Provide to the City not to exceed 25 copies each of the plans and specifications prepared under Step 2 for each Phase, five of which copies shall be for the the use of the Engineer." is amended to read "The City will provide all necessary copies of the construction contract plans and speci- fications for bidding and construction, using tracings and master copies provided by the Engineer under Step 2." 2. Section C.3, Start Up Services, is amended by adding Item I. as follows, "It is agreed that the Engineer's proposal and this . contract do not include the provision of the services of a certi- fied plant operator by the Engineer, as called for in the E.P.A. Regional Policy memorandum on Start Up Services." The City will provide a certified operator for this service. 3. Section E.1, Amount of Fee, is amended by changing the fee for Basic Services to $12,000. EXECUTED IN DUPLICATE, each of which shall be considered an original, this the day of 1977.
