AN ORDINANCE
MAKING FINDINGS OF FACT; AMENDING ORDINANCE NO. 12208,
PASSED AND APPROVED AUGUST 7, 1974, BY AMENDING CERTAIN
SCHEDULES THEREIN SO AS TO INCREASE THE WATER RATES TO
PROVIDE AN OVERALL INCREASE FOR CUSTOMERS USING TREATED
WATER AND UNTREATED WATER, INCLUDING MINIMUM CHARGES,
AS MORE FULLY SET FORTH HEREINAFTER; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE;
PROVIDING AN EFFECTIVE DATE; AND PROVIDING PUBLICATION.
WHEREAS, the existing water rates of the City of Corpus Christi
have been in effect since 1974; and
WHEREAS, various costs of acquiring water, transporting of water,
treatment and distribution of the same has been greatly increased since
1974; and
. WHEREAS, existing conditions have been studied by the City Council
and the City Council has concluded that a new schedule of rates should be
adopted; and
WHEREAS, costs in materials and operating costs, as well as antici-
pated.maintenance costs have increased at least 459; and
WHEREAS, a rate increase is necessary to make the water distribu-
tion system more self- supportive:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 12208, passed and approved August 7,
1974, be and the same is hereby amended by amending the first two schedules
found in Section 1 thereof, under the caption TREATED WATER - REGULAR RATE,
to hereafter read as follows:

to hereafter read as follows:

TREATED WATER - ALTERNATIVE CAPACITY COMMODITY RATE_
Upon request and approval or as may be required by the City to
treated water customers who provide special metering facilities and whose
water use exceeds 2,500,000 gallons per month, the following rates shall
apply:

SECTION 3. That Ordinance No. 9472, passed and approved by the
City Council on August 27, 1969, as amended, and particularly as amended by
Ordinance Pao. 12834, passed and approved on October 1, 1975, be and the same
is hereby amended so as to provide an untreated water rate of eleven cents
(lld) per one thousand (1000) gallons for all water consumed.
SECTION 4. All ordinances or parts of ordinances in conflict
herewith shall be and are hereby repealed to the extent of conflict herewith.
SECTION 5. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause, phrase,
work, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word,
or provision hereof be given full force and effect for its purpose.
SECTION 6. This ordinance shall be effective from those billings
beginning with Cycle 1 for March, 1978.
SECTION 7. Publication shall be made one time in the officiaT
publication of the City of Corpus Christi by publishing the caption of this
ordinance, stating in substance the purpose of the ordinance.

MOTION
David Diaz moved and Edward L. Sample
seconded the motion that the ordinance amending Ordinance No. 12208, pro-
posing to increase water rate schedules, read on.the first of three readings
on January 11, 1978, be and the same is hereby amended prior to the second
reading as follows:
1. Delete the phrase "and to avoid a tax increase" in the last
introductory paragraph.
2. Delete, in Section 1, under schedule Outside Corpus Christi,
the words "All Others" and in lieu thereof reword as "All but Padre Island."
3. Delete. at the end of Section 1, the words "Causeway and all
water areas", the said last sentence to hereafter read as follows:
'"The area designated as 'Padre Island' includes all area East of the City
limits, including Padre Island and Mustang Island."
4. Delete,_from Section 2, under TREATED WATER - ALTERNATIVE
CAPACITY COMMODITY RATE, Capacity and Commodity Charges, the words "Maximum
Day Capacity Requirement" and "Maximum Hour Capacity Requirement ". Said
statements under Capacity and Commodity Charges to hereafter read as
follows:
"Rate per month per 1,000 gallons per
day of maximum day capacity require-
ment.
"Rate per month per 1.000 gallons per
day of excess hourly capacity require-
ment (in excess of maximum day
!y capacity requirement)"
and delete from the last statement under said Capacity and Commodity Charges
the word "rate", said statement to hereafter read, "Capacity Charge for all
water per 1,000 gallons."
5. Delete, from Section 2, "Note" the parenthetical number (11).
