AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH MOBIL PIPE LINE COMPANY FOR THE ADJUSTMENT OF A
LINE WHICH CROSSES THE HEARN ROAD DITCH, A SUBSTANTIAL
COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A
PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING $12,348
OUT OF THE NO. 295 STORM SEWER BOND FUND, APPLICABLE
TO THE AFORESAID PROJECT, NO. 295- 70 -70; AND DECLARING
AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with Mobil Pipe Line Company for the adjustment of
a line which crosses the Hearn Road Ditch, all as more fully set forth in
the agreement, a substantial copy of which agreement is attached hereto
and made a part hereof, marked Exhibit "A ".
SECTION 2. That there is hereby appropriated out of the 295 Storm
Sewer Bond Fund the sum of $12,348 applicable to the aforesaid Project No.
295- 70 -70, for the City's estimated share of construction costs.
SECTION 3. The necessity to execute the aforesaid agreement at
the earliest practicable date and to appropriate the necessary funds to
accomplish the pipe line construction as it relates to the Hearn Road Ditch,
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this ordinance take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the ?QS 'day of January, 1978.

AGREEMENT
THE STATE OF TEXAS X
COUNTY OF NUECES
This agreement is authorized by Ordinance No. and is
entered into between the City of Corpus Christi, Texas, a municipal corporation
and body politic operating under the home rule statute of the State of Texas,
hereinafter called "Ciq, and Mobil Pipe Line Company, and pertains to utility
adjustment for construction of a portion of the Hearn Road Ditch, a City drainage
project within the city limits of Corpus Christi.
W I T N E S S E T H
WHEREAS, Mobil Pipe Line Company has been requested by the City to adjust
its facilities for the future excavation of the Hearn Road Ditch in the City
drainage project; and
WHEREAS, the City has agreed to reimburse Mobil Pipe Line Company for
applicable expenses incurred in providing said protection;
NOW, THEREFORE, the City and Mobil Pipe Line Company agree as follows:
1. Mobil Pipe Line Company will adjust facilities they operate immediately
south of Leopard Street (I.E. 37) at the downstream end of the Hearn Road Ditch.
Said work will consist of the lowering of a 6 -inch diameter pipe line across the
City drainage project. For location see attached Exhibit A.
2. Mobil Pipe Line Company will secure approval of property owners for
work to be conducted outside of City drainage easement.
3. Mobil Pipe Line Company agrees to begin the adjustment of its facilities
covered by this agreement no later than sixty (60) days from the date of this
agreement and continuously pursue the work to completion.
4. The City will pay Mobil Pipe Line Company for the work, which may be
done by Mobil Pipe Line Company's maintenance forces, in accordance with the state-
ment of work and estimate attached hereto and made a part of this agreement. Mobil
Pipe Line Company will submit final billing for actual materials, labor and equip-
ment used on project.
5. The City will have the right to provide inspectional services for purposes
of tabulating material, labor, and equipment costs incurred by Mobil Pipe Line
Company.

6. The City will monitor staking control of the work for
horizontal and vertical alignment.
7. Mobil Pipe Line Company agrees to indemnify and hold harmless
the City from any and all claims, suits or liability of any kind whatsoever
arising as a result of the work performed under this agreement and agrees
to perform all work in a good workmanlike manner.
8. This agreement shall be executed in two (2) copies, each of
which shall be considered an original, and shall become effective and be
binding upon and inure to the benefit of the parties hereto and their respec-
tive heirs, successors, and assigns.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
