AN ORDINANCE
APPROPRIATING AND REAPPROPRIATING $37,676.60 OUT OF
THE NO. 126 GENERAL REVENUE SHARING FUND, ACTIVITY
5604, WHICH AMOUNT IS TO BE TRANSFERRED TO THE NO. 291
PARK BOND FUND FOR PROJECT NO. 291- 72 -12, TO SUPPLEMENT
FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 13085,
DATED MARCH 24, 1976, FOR JURY AWARD PLUS INTEREST
FROM THE DATE OF COMMISSIONERS' AWARD DEPOSIT AND FOR
COURT COSTS, ALL IN CONNECTION WITH THE ACQUISITION OF
PARCEL 304, CORPUS CHRISTI BEACH PARK SITES, IN CONDEMNA-
TION, STYLED CITY OF CORPUS CHRISTI VS. RUTH M. JUERGENS,
ET AL; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That there is hereby appropriated and reappropriated
the sum of $37,676.60 out of the No. 126 General Revenue Sharing Fund,
Activity 5604, which amount is to be transferred to the No. 291 Park Bond
Fund for Project No. 291- 72 -12, to supplement funds previously appropriated
by Ordinance No. 13085, dated March 24, 1976, for Jury Award plus interest
from the date of Commissioners' Award Deposit and for court costs, all in
connection with the acquisition of Parcel 304, described as follows:
Lots 9 and 11, Block 385, Brooklyn Addition to the
City of Corpus Christi, Nueces County, Texas, as
shown by map or plat thereof, recorded in Vol. A,
page 32, Map Records of Nueces County, Texas.
said acquisition being necessary for the Corpus Christi Beach Park Sites,
in condemnation, styled City of Corpus Christi vs. Ruth M. Juergens, et al.
SECTION 2. That the necessity to appropriate the sums hereinabove
described in order to satisfy the remaining balance due the landowner under
the judgment of the Court creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared such emergency and necessity
to exist, and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction and take

effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO ORDAINED, this the day of February, 1978.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
