HomeMy WebLinkAbout14156 ORD - 02/01/1978JKH:hb:2 /1/78 AN ORDINANCE CLOSING AND ABANDONING 40 FEET OF A 5 -FOOT .UTILITY EASEMENT ALONG THE NORTH SIDE OF LOT 1, BLOCK L, FLOUR BLUFF ESTATES, AS MORE PARTICULARLY DESCRIBED HEREINAFTER, SUBJECT TO THE DEDICATION OF AN ALTER- NATE EASEMENT AND THE RELOCATION OF EXISTING UTILITIES IN AND ABOVE THE EASEMENT; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a certain 5 -foot utility easement on the north side of Lot 1, Block L, Flour Bluff Estates, as more fully set forth hereinafter, situated in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon said easement upon the dedication of an alternate easement and the relocation of existing utilities in and above the easement, as more fully described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the utility easement in Lot 1, Block L. Flour Bluff Estates, in the City of Corpus Christi, Nueces County, Texas, described as follows: Being a portion of a 5.0 -foot wide utility easement located in Lot 1, Block L, Flour Bluff Estates, as shown by map of record in volume 8, Pages 1 and 2, Map Records, Nueces County, Texas, and more partic- ularly described by metes and bounds as follows: Beginning at a point on the easterly right -of -way line of Waldron Road, said point being the most westerly corner of abovementioned Lot 1, Block L; Thence S. 600 58' E. along the northerly boundary line of said Lot 1, Block L a distance of 25.0 feet to a point being the beginning point of the tract of land herein described; Thence continue S. 600 58' E. along the northerly boundary line of said Lot 1, Block L a distance of 40.5 feet to a point; Thence S. 29° 02' W. a distance of 5.0 feet to a point on the southerly boundary line of an existing utility easement; Thence N. 600 58' W. along the southerly boundary' line of said utility easement a distance of 40.5 feet to a point; Thence N. 290 02' E. a distance of 5.0 feet to the place of beginning and containing 202.5 square feet MIGROFILMM of land, more or less, JUL 0 7 1980 1415E be and the same is hereby closed for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the in- habitants of the City of Corpus Christi, Texas, subject to dedication of an alternate easement, and the relocation of existing utilities in and above the easement. SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule: and that this ordinance take effect and be in full force and effect from and after its. passage, IT IS ACCORDINGLY SO ORDAINED, this the &t day of , 1978.
