AN ORDINANCE
CLOSING THE DEAD END PORTION OF SECOND STREET SOUTH OF
ELIZABETH STREET BETWEEN LOTS 1 THROUGH 5, BLOCK 10,
AND LOTS 9 THROUGH 14, BLOCK 11 OF OCEAN VIEW SUBDIVISION,
AS MORE FULLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVER -
ABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing
concerning the closing of the dead end portion of Second Street south
of Elizabeth Street between Lots 1 through 5, Block 10, and Lots 9
through 14, Block 11 of Ocean View Subdivision, in the City of Corpus
Christi, Nueces County, Texas, was given by publication and mail to the
last known addresses of the owners of abutting property proposed to be
closed and within 450 feet of the area to be closed, and thereafter, pursuant
to said notice, public hearing was held at Regular Council Meeting by the
City Council of the City of Corpus Christi on January 25, 1978, in accordance
with the provisions of the City Charter; and
WHEREAS, it has been determined by the City Council after such
hearing that the dead end street, above described, proposed to be closed
is not needed now, nor will it be within the foreseeable future needed as
a public street:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the dead end portion of Second Street south of
Elizabeth Street between Lots 1 through 5, Block 10, and Lots 9 through 14,
Block 11 of Ocean View Subdivision, situated in the City of Corpus Christi,
Nueces County, Texas, be and the same is hereby closed for public use and
abandoned to the abutting property owners, said dead end portion being
more particularly described as follows:
BEGINNING at the northwest corner of Lot 14,
Block 11, Ocean View Subdivision, said point
lying at the intersection of the east right -
of -way line of Second Street and the south
right -of -way line of Elizabeth Street;
THENCE S 18° 55' 10" E along the east right -
of -way line of Second Street a distance of
253.75 feet to a point, said line also being
the west line of Lots 14, 13, 12, 11 and 10, MICROFILMED
Block 11, Ocean View Subdivision;

THENCE S 850 55' 30" W across Second Street
to the west right -of -way line-of Second Street
a distance of 62.07 feet to a point, said
point also being the southeast corner of -Lot 5,
Block 10, Ocean View Subdivision;
THENCE N 18° 55' 10" W along the west- right -of�
way line of Second Street a distance of 253.75 feet
to a point, said line also being the east line of
Lots 5, 40 3, 2 and 1, Block 10, said point lying
in the south right,of -way line of Elizabeth Street,
Ocean View Subdivision:
THENCE N 85° 55' 30" E along the south right -of.
way line of Elizabeth Street, a distance of 62.07
feet to the point of beginning; foraying a tract
of land embracing 15,224.60 square feet or
0.34951 acres.
SECTION 2. If for any reason any section, paragraph. subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word, or provision of this ordinance, for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause..
phrase, word, or provision hereof be given full force and effect for its
purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the hereinabove dead end portion
of Second Street creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be read at three several meetings of the City Council.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
