AN ORDINANCE
AUTHORIZING TEE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH MR. CRAIG GIBBS FOR THE CONSTRUCTION OF A DISC
SCULPTURE FOR LOCATION IN THE COOPER'S ALLEY TRAFFIC
ISLANDS FOR $3,000, A SUBSTANTIAL COPY OF THE AGREE-
MENT BEING ATTACHED HERETO, MARRED EXHIBIT "A ", AND
INCORPORATED HEREIN; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with Mr. Craig Gibbs for the construction of a disc
sculpture for location in the Cooper's Alley traffic islands for $3,000,
all as more fully set forth in the agreement, a substantial copy of which
agreement is attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize the City Manager to execute
the hereinabove described agreement to accomplish the construction of a
disc sculpture for location in the Cooper's Alley traffic islands creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
day of February, 1978.

CONTRACT
This contract for the creation of a sculpture is entered into
this the day of February, 1978 by and between the City of Corpus
Christi, hereinafter called "City" and Mr. Craig Gibbs, sculptor (herein-
after called Sculptor), upon the following terms and conditions:
1. Scope of the work. Sculptor will create a six foot diameter
1/4" to 3/8" thick, corten steel sculpture utilizing the image and colig-
raphy exhibited on the scale model submitted by him for the Cooper's Alley
Sculpture Competition and directly stylized from an original Pre - Columbian
design. The steel cut out figurative disc shall be mounted on 2 -24" case
concrete cylinders that shall be anchored to a foundation footing approved
and installed on Site A as shown on the attached exhibit and as approved by
the Director of Engineering and Physical Development.
Corten Steel shall be used because it is an industrial low grade
stainless steel that will oxidize (rust) for a 6 -month period then stop
oxidizing altogether. The nickel content of the steel keeps it from deter-
iorating back to iron ore. This material is designed to be exposed_ to
severe corrosive climates such as in the Gulf Coast area.
2. Location of work. The sculpture shall be located on the median
islands at the intersection of Cooper's Alley and Mesquite Street as shown
on the attached exhibit. No part of the sculpture shall be closer than 15
feet to the Mesquite Street curb line. The disc shall face northeast_
At the location a base shall be prepared of concrete as specified
by the Director of Engineering and Physical Development Department. This
base shall be put below the brick work to hold the estimated one ton weight
of the finished sculpture. The sculpture itself shall be anchored into the
base with 12 inch steel tie pins. The Department of Engineering and Physical
Development will approve the base installation.
3. Liability to and from work. Sculptor hereby assumes all
liability for any damage he may do or cause as a result of his work. Sculptor
also assumes all responsibility for any damage that may be done to his work
by others while under construction and agrees to hold the City harmless
therefrom.
4. Time for construction. The construction of the sculpture
shall begin as soon as possible and shall be completed not later than three
calendar months from the date of this agreement.
5. Payment. Upon the completion of the sculpture according to
the proposal and the approval and acceptance of the. same by the City, the
City shall pay the Sculptor the sum of Three Thousand and no /100 Dollars
($3,000) which shall include the Sculptor's fee, cost of materials, base,
installation, transportation to site and any other incidental and related
costs.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
