AN ORDINANCE ORDERING AN ELECTION TO BE HELD WITHIN THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE TERRITORY COMPRISING TWENTY (20) ,SEPARATE AREAS ADJACENT TO THE CITY OF CORPUS CHRISTI AS MORE FULLY DESCRIBED BY METES AND BOUNDS AND MAPS ON FILE IN THE OFFICE OF THE CITY SECRETARY, AND MADE A PART HEREOF BY REFERENCE THE SAME AS IF COPIED VERBATIM HEREIN, SHALL BE ANNEXED TO THE CITY OF CORPUS CHRISTI; DEFINING THE TERRITORY PROPOSED TO BE ANNEXED; SETTING A PUBLIC HEARING TO CONSIDER ANNEXA- TION OF THE SAID TERRITORY, TO BE HELD ON MARCH 15, 1978, AT 2:00 P.M., IN THE COUNCIL CHAMBER AT CITY HALL; PROVIDING PROCEDURE FOR THE HOLDING OF SUCH ELECTION; PROVIDING FOR JOINT ELECTION WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT AND WITH THE WEST OSO INDEPENDENT SCHOOL DISTRICT, AND SHARING EXPENSES ACCORDING TO LAW; PRESCRIBING THE FORM OF NOTICE OF ELECTION; PROVIDING FOR PUBLICATION THEREOF; PROVIDING FOR FORM OF BALLOT AT EACH POLLING PLACE; ENACTING PROVISIONS INSTANT TO AND RELATING TO THE PURPOSE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Corpus Christi desires to submit to the voters of the City the question of annexation of certain tracts of land, more fully described herein: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an election be held on the 1st day of April, 1978, within the City of Corpus Christi, and that there be submitted at said election to the qualified voters of said City the question of whether or not certain territory should be annexed to the City of Corpus Christi, Texas, said territory being described generally as hereinafter set forth and all as more particularly described by metes and bounds and maps or plats thereof on file in the office of the City Secretary, and made a part hereof by reference the same as if copied verbatim herein: STUDY AREA A -1, being all of Nottarb Place, as shown by map of record in Volume 36, pages 168, 169, Map Records, Nueces County, Texas, and Nottarb Place, Unit 2, as shown by map of record in Volume 38, page 190, Map Records, Nueces County, Texas. STUDY AREA A -2, being that portion of Block 3, Cabaniss Industrial Park not previously annexed . by City Ordinance No. 9270 and bounded by present City Limit line on all sides, being all of Lots 1 and 2, Block 3, Cabaniss Industrial Park, as shown by map of record in Volume 40, pages 122, 123, 124, 125, Map Records, Nueces County, Texas. STUDY AREA F -2, Being a tract of land out of a portion of State of Texas Subdivision Tracts for Mineral Development as shown by the General Land Office Map. -3- • • SECTION 2. That the official ballot for said election shall be, except for caption and date and other formalities as may be provided by law for the form of said ballot, as hereinafter set forth, and the proposition to be voted on at said election shall be as follows: "ANNEXATION PROPOSITION Shall the City of Corpus Christi, by ordinance, annex to said City certain additional territory referred to and described in the ordinance ordering an election passed March 1, 1978, to the City of Corpus Christi and its corporate limits, said territory being generally described as various tracts all fully described by metes and bounds in said ordinance." All voters favoring the annexation of the territory as herein described,and as generally provided in said Annexation Proposition, shall have written or printed on their ballots the following words: "ANNEXATION PROPOSITION FOR THE ANNEXATION OF SUCH ADDITIONAL TERRITORY REFERRED, TO IN THE ORDINANCE ORDERING AN ELECTION PASSED ON MARCH 1, 1978." and those opposed to the annexation of the territory hereinbefore described in Section i hereof and referred to and as generally provided in said Proposition shall have written or printed on their ballots the following words: "ANNEXATION PROPOSITION AGAINST THE ANNEXATION OF SUCH ADDITIONAL TERRITORY REFERRED TO IN THE ORDINANCE ORDERING AN ELECTION PASSED MARCH 1, 1978." SECTION 3. If at said election a majority of the duly qualified voters who reside within the City of Corpus Christi voting at said election shall vote in favor of the annexation to the City of Corpus Christi of the territory herein described in Section 1 hereof and referred to herein, and as generally provided in said Annexation Proposition, the City Council shall, by ordinance, annex and receive such territory as a part of said City, and thereafter such territory so annexed and received shall be a part of the City of Corpus Christi, Texas. SECTION 4. A copy of this ordinance, signed by the Mayor of the City of Corpus Christi, Texas, shall constitute the notice ordering said -4- • • election, and the Mayor is directed to cause a copy of this ordinance, signed by him, to be posted at the City Hall in the City of Corpus Christi, Nueces County, Texas, and at each of the polling places in each precinct of the City, said posting to be not less than fifteen (15) days prior to said election, and to have a copy of this ordinance published in the Corpus Christi Times, the official newspaper of the City of Corpus Christi, Texas, it being a newspaper of general circulation, published within the City of Corpus Christi, said publication to be made in accordance with the requirements of law. SECTION 5. The City Council of the City of Corpus Christi hereby declares that it will participate in a joint election to be held April 1, 1978, 0ith the Corpus Christi Independent School District and the West Oso Independent School District. The City Secretary is instructed to participate in accomplishing the details of the City's portion of said election. SECTION 6. The maximum number of judges and clerks at each polling place shall not exceed five, and the rate of pay shall be established as $2.50 per hour for each judge and clerk, and a fee of $5.00 is established for judges for delivering election returns. The polls shall be open from 7:00 o'clock A.M., to 7:00 o'clock P.M., on the date of the said election. SECTION 7. That voting machines shall be employed at the elec- tion herein ordered in accordance with the provisions of Revised Civil Statutes of Texas Election Code, Article 7.14, and said election .shall be held at the polling places in the regularly prescribed voting precincts of the City of Corpus Christi. Voting machines shall be used both for absentee voting by personal appearance and for voting at the regular polling places at said election; but paper ballots shall be used for .absentee voting by mail. Absentee voting shall be conducted by the City Secretary in the City Secretary's Officemin the-lobby of City Hall and the results canvassed.and returns made as is provided by law. That said election shall be held in accordance with the general election laws of the State of Texas. SECTION 9. That a public hearing shall be held as prescribed by Article 970a, V.R.C_S., on March 15, 1978, at 2:00 P.M., in the City Council Chambers at City Hall, 302 South Shoreline, Corpus Christi, Texas, and that the City Secretary is hereby directed to publish notice of the said public hearing one time in the official publication of the City of Corpus Christi according to the provisions of Article 970a, V.R.C.S. SECTION 10. The fact that it is necessary and essential that the governing body of the City of Corpus Christi shall order elections -6- • pertaining to municipal affairs and that the notice for such election should be promptly posted and that a regular City election for.the annexation of the territory hereinabove described shall be held on the 1st day of April, 1978, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the le4tday o March, 1978. PORQUE, el Concilio de la Ciudad de la Ciudad de Corpus Christi desea someter a los votantes de la Ciudad el asunto de la anexacion de ciertas parcelas de terreno mas plenamente descritas aqui: AHORA, POR ESTO, SEA ORDENADO POR EL CONCILIO DE LA CIUDAD DE LA CIUDAD DE CORPUS CHRISTI, TEXAS: SECCION 1. Todos lcs votantes favcreciendo la anexacion de el territorio que se describe aqui y como generalmente se provee en la Proposicion de Anexacion, tendra escrito o impreso en sus boletas las siguientes palabras; "PROPOSICION DE ANEXACION FOR LA ANEXACION DE TAL TERRITORIO ADICIONAL REFERIDO A EN LA ORDENANZA ORDENANDO UNA ELECCION, PASADA EN MARZO 1, 1978:" y aquellos opuestos a la anexacion de el territorio aqui antes descrito en Seccion 1 aqui y referido a y como generalmente se provee en dicha proposicion tendran escrito o impreso en sus boletas las siguientes palabras: "PROPOSICION DE ANEXACION ENCONTRA LA ANEXACION DE TAL ADICIONAL TERRITORIO REFERIDO A EN LA ORDENANZA ORDENANDO UNA ELECCION PASADA MARZA, 1, 1978." SECCION 3. Se en dicha eleccion una mayoria de debidamente calificados votantes que residen dentro de la Ciudad de Corpus Christi, votando en dicha eleccion votaran en favor de la anexacion a la Ciudad de Corpus Christi de el territorio aqui descrito en Seccion 1 de esto y a cual se refiere aqua, y como generalmente se provee en la Proposicion de Anexacion, el Concilio de la Ciudad, por ordenanza, anexara y recibira tal territorio como parte de la Ciudad de Corpus Christi, Texas. SECCION 4. Una copia de esta ordenanza, firmada por el Mayor de la Ciudad de Corpus Christi, Texas, constituira la noticia ordenando tal eleccion, y el Mayor sera dirijido que cause que se cartele una copia de esta ordenanza, firmada por el, en el Edificio Municipal en la Ciudad de Corpus Christi, Condado de Texas, y en cada casilla de cada precinto de la Ciudad, dicha cartelada sera no menos que quince (15) dias antes de dicha eleccion y que hags que se publique -5- una copia de esta ordenanza en el Corpus Christi Times, el diario oficial de la Ciudad de Corpus Christi, Texas, este siendo un diario de circulacion general, publicado dentro de la Ciudad de Corpus Christi, dicha publicacion se hara de acuerdo con los requisitos de ley. El numero maximo de jueces y escribanos en cads casilla no debe excedir cinco, y el precio de pago sera establecido a $2.50 por hora para cada juez y escribano y un honorario de $5.00 esta establecido pars los jueces por la entrega de los resultados de la eleccion. Las casillas permaneceran abiertas desde las 7:00 A.M. hasta las 7:00 P.M. en la fecha de la eleccion. SECCION 7. Que maquinas para votar deberan ser usadas en la eleccion por esto aqui ordenado de acuerdo con las provisioner de el Codigo de'Estatutos Civiles Revisado de el Codigo de Elecciones de el Estado de Texas, Articulo 7.14, y dicha eleccion se llevara a Cabo -6- en las casillas en los reglamentariamente prescribos precintos para votar de la Ciudad de Corpus Christi. Maquinas para votar se usaran para votar en ausencia compareciendo personalmente y pars votar en las casillas regulares en dacha eleccion pero boletas de papel se usaran para votar en ausencia por correo. Votacion en ausencia sera conducido por el Secretario de la Ciudad en la officina de el Secretario de la Ciudad en la antesala de el Edificio Municipal y los resultados seran examinados y aprobados y los resultados expuestos como provee la ley. Una samara especial se nombra aqui como sigue para examinar y aprobar el resultado de la eleccion: SECCION 8. Que dicha eleccion se llevara a cabo de acuerdo con las leyes generales de elecciones de el Estado de Texas. SECCION 9.
