Home My WebLink About14225 ORD - 03/15/1978JKH :vp:2- 8,78:ls.t AN ORDINANCE AMENDING THE LEASE AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND BRANIFF AIRWAYS, INC., AUTHORIZED BY ORDINANCE 13019, DATED FEBRUARY 11, 1976, SO AS TO PROVIDE FOR THE LEASE OF 2,000 SQUARE FEET OF SPACE ON A NON - EXCLUSIVE BASIS AT GATEHOUSE 3 AND 4 AT CORPUS CHRISTI INTERNATIONAL AIRPORT FOR THE ACCOM- MODATION AND PROCESSING OF PASSENGERS, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF SAID AMENDMENT BEING ATTACHED HERETO, MARRED EXHIBIT "A ", AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the lease agreement between the City of Corpus Christi and the Braniff Airways, Inc., authorized by Ordinance No. 13019, dated February 11, 1976, be and the same is hereby amended so as to provide for the lease of 2,000 square feet of space on a non - exclusive basis at Gatehouse 3 and 4 at Corpus Christi International Airport for the accommo- dation and processing of passengers, all as more fully set forth in the amendment to Lease Agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". MICROFILMED JUL 0 7 Iggp 14221 JKH:vp:2 -7 -78 AMENDMENT TO LEASE AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES I WHEREAS, by Ordinance No. 13019, dated February 11, 1976, the City Council authorized lease agreement between the City of Corpus Christi and Braniff Airways, Inc., covering rental of space at the Corpus Christi International Airport, for the term commencing the 8th day of August, 1975, and terminating the 7th day of August, 1980; and WHEREAS, it is mutually agreeable to the said parties to amend the said lease agreement in the following particulars: A. Add to Article I, PREMISES, a new provision, to be designated Paragraph F, entitled Non - Exclusive Space in Terminal Complex, and reading as follows: "F. Non - Exclusive Space in Terminal Complex. P The non - exclusive use of approximately 2,000 square feet for a portion of the structure known as gatehouse three and four, including the area to be added of approximately 660 square feet at lessees expense as shown on Exhibit "A" attached hereto and made a part hereof for the accommoda- tion and processing of passengers. Lessee will have first right to use said space, but will permit others to use space on an as needed basis. Lessee will have the right to make a reasonable charge for the use of the apace." B. Amend Article VII, RENTALS AND FEES, paragraph 50 by adding the words "and non - exclusive space" following the words "exclusive space" and preceding the words "on a metered basis ", said paragraph 5 to hereafter read as follows: "5. Lessee agrees to pay for the electrical energy con- sumed by Lessee in Lessee's exclusive space and non - exclusive space on a metered basis at City's cost." C. Amend Article VII, RENTALS AND FEES, by adding a new paragraph, to be designated 11, reading as follows: "11. The service fee for the gatehouse space will be $2.83 per square foot per annum for the first partial contract year beginning upon occupancy of apace and ending August 7, 1978 and after the first partial year the fee will be adjusted in accordance with the formula outlined in Article VII, Paragraph 1, under all other cost adjustment formula." m It Except as herein and hereby amended, the terms, conditions and provisions of the lease agreement entered into by authority of Ordinance No. 13019 shall be and remain in full force and effect.
