HomeMy WebLinkAbout14228 ORD - 03/15/1978jkh:3- 15 -78; lst , AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 27, SUPPLEMENTARY HEIGHT, AREA AND BULK REQUIREMENTS, BY AMENDING SECTION 27 -3.03 FRONT YARDS, SUBSECTION 27- 3.03.05 AND RENUMBERING SUBSECTION 27- 3.04.05 TO 27- 3.04.04 SO AS TO CLARIFY SIDE AND FRONT YARD REQUUIRE- ME TS FOR CORNER LOTS AND WHERE THE LOTS WITHIN 200 FEEZ OF THE SUBJECT LOT HAVE FRONT YARDS LESS THAN SHE REQUIRED MINIMUM; DELETE THE PRESENT SUBSECTION-27-3 04,Q4 IN ITS ENTIRETY, AND RENUMBER THE PRESENT SUBSECTION 27- 3.04.06 AS 27- 3.04.05; KEEPING IN EFFECT ALL OTHER PROVISIONS,OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning Certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi, Texas; and WHEREAS, public hearing was held at which hearing all persons • wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, soiicL public hearing having been held on Wednesday, March 15, 197, '-°at.Regular Council.Meeting of the City Council in the Council .Chamber at City Hall in,ithe City of Corpus Christi; and 9HEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve.public,health, necessity and convenience and the general welfare of l e City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the Zoning Ordinance of the 'City of Corpus Christi passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the changes herein- after set out. �09 14228 SECTION 2. That Article 27, Supplementary Height, Area and Bulk Requirements, be amended by amending Section 27 -3.03, Subsection 27.3.03.05 to hereafter read as follows: "27- 3.03.05 Where the street frontage within 200 feet on either side of a lot within a block is improved with buildings which have a front yard that is less than the required front yard in the district, the required front yard may be reduced but no .building shall project beyond the average front yard of the two adjacent buildings on either side of the lot in question. Where the lot is on a corner within a block that is improved with buildings within 200 feet which have a front yard that is less than the required front yard in the district, the required front yard may be reduced, but no building shall project beyond the front yard of the adjacent building." SECTION 3. That Subsection 27- 3.04.04 be deleted in its entirety. SECTION 4. That Subsection 27- 3.04.05 be renumbered to 27- 3.04.04 and amended to hereafter read as follows: "27- 3.03.04 A side yard on the side of a corner lot abutting the street shall be a minimum of not less than ten (10) feet back of the street right of way when such lot is back to back with another corner lot and not less than the required minimum front yard in every other instance. This Article does not apply in either the 'B -5' Primary Business District or the 'B -6' Primary Business Core District." SECTION 5. That Subsection 27- 3.04.06 be and the same is hereby renumbered 27- 3.04.05. SECTION 6. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 7. Publicatim shall be made one time in the official publication of the City of Corpus Chgristi, which publication shall contain the caption stating in substance the purpose of the ordinance. -2- SECTION B. That the necessity of immediately making the afore- said changes for the purpose of maintaining at a -11 times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this the day of ch, 1978.
