AN ORDINANCE
CLOSING AND ABANDONING THE TWO 10 -FOOT UTILITY EASEMENTS
IN LOTS 10, 11 AND 12, BLOCK D, FLOUR BLUFF ESTATES NO. 1,
SUBJECT TO THE DEDICATION BY SEPARATE INSTRUMENT OF A
FIVE -FOOT EASEMENT ALONG THE EAST PROPERTY LINE OF LOT 12,
EXTENDING FIVE FEET INTO LOT 15, ALL IN BLOCK D, FLOUR
BLUFF ESTATES NO. 1; SUBJECT TO THE MAKING OF ADEQUATE
ARRANGEMENTS WITH CENTRAL POWER AND LIGHT COMPANY IN REGARD
TO THEIR FACILITIES AT THIS LOCATION; AND SUBJECT TO
REPLATTING OF LOTS 10, 11, AND 12 AS ONE LOT; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, there exist two 10 -foot utility easements in Lots 10, 11,
and 12, Block D. Flour Bluff Estates No. 1, situated in the City of Corpus
Christi, Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easementsupon dedication by
separate instrument of a five -foot easement along the east property line
of Lot 12, extending five feet into Lot 15, all in Lot D, Flour'Bluff
Estates No. 1, subject to the making of adequate arrangements with Central
Power and Light Company in regard to their facilities at this location, and
further subject to replatting of Lots 10, 11, and 12 into one lot:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the existing two 10 -foot utility easements in
Lots 10, 11, and 12, Block D, Flour Bluff Estates No. 1, be and the same
are hereby closed for public use and every municipal purpose, subject to
dedication by separate instrument of alternate easement by the owners of
a five -foot easement along the east property line of Lot 12, extending five
feet 'Into Lot 15, all in Block D, Flour Bluff Estates No. 1; subject to
the making of adequate arrangements with Central Power and Light Company
in regard to their facilities at this location; and subject td replatting
of Lots 10, 11, and 12 into one lot, and the said easements hereby closed
are abandoned to the owners of the abutting property in accordance with
the laws of the State of Texas, and for the service and interest of the
inhabitants of the City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivi-
sion, clause, phrase, word, or provision of this ordinance shall be held

invalid or unconstitutional by final judgment of a court of competent
jurisdiction it shall not affect any other section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph, subdivision,
clause, phrase, word, or provision hereof be given full force and effect
for its purpose.
SECTION 3. The fact that the public convenience and necessity
would be better served by the closing of the aforesaid easements creates
a public emergency and an imperative public necessity requiring the suspen-
sion of the Charter rule that no ordinance or resolution shall be passed y
finally on the date of its introduction but that such ordinance or resolu-
tion shall be read at three several meetings of the City Council, and the
Mayor having declared such emergency -sand necessity to exist, having
requested the suspension of the Charter rule and that this ordinance
take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED, this the, day of arch, 1978.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
