HomeMy WebLinkAbout14239 ORD - 03/22/1978jkh:3- 22 -78; lst z AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF BEN MARKS, TRUSTEE BY AMENDING THE ZONING NAP BY CHANGING THE ZONING ON•PORTION OF LOTS 3 and 4, OSO FARM TRACTS , SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "A -1" APARTMENT HOUSE DISTRICT TO - 2" APARTMENT HOUSE DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Ben Marks. Trustee for amendment to the 9 zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons, wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday March 22, 1978 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it-was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That the Zoning Ordinance of the City of CorpusY�; Christi, Texas, passed on the 27th day of August, 1937, appearing of record -in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the following described parcel or tract, being a portion of Lots 3 and 4, Oso Farm Tracts, in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "A -1" Apartment House District to "A -2" Apartment House District: Being a 5.021 -acre tract out of Lots 3'and 4, Oso Farm Tracts, a map of which is recorded in Volume A, page 49, Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the North corner of Lot 1, Block 3, Marks Hract, a map of which is recorded in Volume 43, Page 92, for the East corner of this tract; THENCE South 29 °02'00" West along the Northwest boundar$ line of said Lot 1 324.42 feet for the South corner of this tract; THENCE North 60 °59100" west 574.38 feet for the West corner of this tract; THENCE North 06 °54'40" West 154.48 feet to the point of curvature of a circular curve to the right whose central angle is 35 °59'40" and whose radius is 322.86 feet with a tangent distance of 104.73 feet for an arc distance of 202.54 feet; THENCE with said curve to the right 202.54 feet to the point of tangency; THENCE North 29 °02'00" East 10.00 feet to a point on the Southwest right -of -way line of Corona Drive for the North corner of thfs tract; THENCE South 60 °58'00" East with said right -of -way line 726.54 .feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an Imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance by passed finally on the date of its introduction and take effect and be in full force and effect from and af��ter it s passage,,, IT IS ACCORDINGLY SO ORDAINED, this the Ay / day of / � A rck , 19 %d .
