HomeMy WebLinkAbout14244 ORD - 03/29/1978jkh:ya:3- 29- 78;2nd AN, ORDINANCE CLOSING AND ABANDONING A 10' X 595' UTILITY EASEMENT ALONG THE NORTH SIDE OF LOTS A AND B, BLOCK 1C, LOKEY SUBDIVISION, LOCATED ON THE EAST SIDE OF SOUTH STAPLES STREET NEAR ITS INTERSECTION WITH HOLLY ROAD, SUBJECT TO THE DEDICATION OF A 10 -FOOT ALTERNATE EASEMENT ALONG THE NORTH AND EAST PROPERTY LINES OF THE NORTHWEST ONE - HALF OF LOT 1, TRACT C, LOKEY SUBDIVISION, ALL AS MORE FULLY DESCRIBED ON THE MAP OR PLAT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a certain 10 -foot by 595 -foot utility easement along the north side of Lots A and B, Block 1C, Lokey Subdivision, located on the east side of South Staples Street near its intersection with Holly Road; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon said easement upon the dedication of an alternate easement, as more fully described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 10 -foot by 595 -foot utility easement along the north side of Lots A and B. Block 1C, Lokey Subdivision, situated in the City of Corpus Christi, Nueces County, Texas, located on the east side of South Staples Street near its intersection with Holly Road, be and the same is hereby closed for public use and every municipal purpose, and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabi- tants of the City of Corpus Christi, Texas, subject to the dedication of an alternate 10 -foot easement along the north and east property lines of the northeast one -half of Lot 1, Tract C, Lokey Subdivision, more fully described as follows, and as shown on map or plat thereof, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ": Being a 10.0 foot wide tract of land out of the Northeast one -half of Lot 1, Tract C, Lokey Sub- division as shown by map of record in Volume 7, Page 16, Map Records, Nueces County, Texas,,and more particularly described by metes and bounds as follows: MICROFILMED JUL 0 71980 llli n r, Inno *14244 '` Beginning at a point on the Southeast Right -of -Way line of 100 foot wide South Staples Street, said point being in the Northeast boundary line of abovementioned Lot 1; Thence S. 61 °00'40" E. along the Northeast boundary line of said Lot 1, Tract C, a distance of 10.0 feet to a point for the beginning point of the tract of land herein described; Thence continue S. 61 °00'40" E. along the Northeast boundary line of said Lot 1, Tract C, a distance of 605.50 feet to a point being the Southeast corner of said Lot 1, Tract C; Thence S. 29 °00' W. along the Southeast boundary line of said Lot 1, Tract C, a distance of 165.0 feet to a point being the Southeast corner of Lot 1 -C, Tract B, Lokey subdivision, as shown by map of record in Volume 27, Page 61, Map Records, Nueces County, Texas; Thence N. 61 °00'40" W. along the Southeast boundary line of said Lot 1 -C, Tract B, a distance of 10.0 feet to a point; Thence N. 29 000' E. along a line that is 10.0 feet Northwest of and parallel to the Southeast boundary line of said Lot 1, Tract C a distance of 155.0 feet to a point; Thence N. 61 °00'40" W. along a line that is 10.0 feet Southwest of and parallel to the Northeast boundary line of said Lot 1, Tract C, a distance of 595.50 feet to a point on the Southeast boundary line of a 10.0 foot wide utility easement conveyed to the City of Corpus Christi, Texas, as recorded in Volume 1637, Page 735, Deed Records, Nueces County, Texas; Thence N. 29 °00' E. along the Southeast boundary line of said easement a distance of 10.0 feet to the place of beginning and containing 0.175 acres more or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full farce and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the�day of March, 1 8.
