HomeMy WebLinkAbout14280 ORD - 04/19/1978' I jkh:ya:4 -4 -78; 2nd AN ORDINANCE CLOSING MINTON STREET FROM NORTH PORT AVENUE EAST TO THE RAILROAD RIGHT OF WAY, SUBJECT TO RETENTION OF THE HEREINAFTER DESCRIBED AREA AS A UTILITY EASE MENT; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of Minton Street from North Port Avenue east to the railroad right of way, in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known addresses of the owners of property abutting the portion of Minton Street proposed to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council of the City of Corpus Christi on March 29, 1978, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the said portion of Minton Street from North Port Avenue east to the railroad right of way, is not needed now, nor will it be within the fore- seeable future needed as public right of way; however, the closing is to be subject to the retention of the hereinafter described portion of Minton Street as a utility easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the portion of Minton Street from North Port Avenue eastward to the railroad right of way, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby closed for public use and abandoned to the abutting property owners subject to retention of the hereinafter described portion of Minton Street as a utility easement: Being a 37.76 foot wide strip of land to be retained by the City of Corpus Christi for a utility easement out of that portion of Minton street proposed to be closed, and more particularly described by metes and bounds as follows: Beginning at a point on the northeast right -of -way line of abovementioned Minton Street, said point being the south corner of Lot 9 -A, Block 8, John G. Hatch Addition as shown by map of record in Volume 39, page 159, Map Records, Nueces County, Texas, for the beginning point of the tract of land herein described; Thence S. 30° 30' 00" W. a distance of 37.76 feet to a point; MICROFILMED JUL 0 71980 14280 i Thence N. 59° 30' 00" W. along a line that is 37.76 feet southwest of and parallel to the northeast right -of -way line of said Minton Street a distance of 221.50 feet to a point on an extension of the southeast right -of -way line of Port Avenue crossing said Minton street; Thence N: 30° 30' 00" E. along the extension of said southeast right -of -way line of Port Avenue a distance of 37.76 feet to a point, being the west corner of abovementioned Block 8; Thence S. 59° 30' 00" E. along the northeast right -of -way line of said Minton Street a distance of 221.5 feet to the place of beginning and containing 0.192 acres, more or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the hereinabove described street, within the limits defined, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its intro- duction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1`) y of April, 1978.
