HomeMy WebLinkAbout14283 ORD - 04/26/1978t" AN ORDINANCE AMENDING CHAPTER 29, MUNICIPAL COURTS, OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, BY ADDING A FOURTH COURT; BY MAKING APPOINTMENTS OF JUDGES FOR A PERIOD OF TWO YEARS COTERMINOUS WITH THE TERM OF THE APPOINTING CITY COUNCIL; REQUIRING THAT JUDGES OF MUNICIPAL COURTS A, B AND C SERVE FULL TIME AND THAT THE JUDGE OF MUNICIPAL COURT - D SERVE AS REQUIRED BY THE PRESIDING JUDGE, AND OTHERWISE AMENDING SAID CHAPTER TO REFLECT THE ADDITION OF A FOURTH COURT. - BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 29 -1, paragraph (a) is hereby amended by changing the number "three" to "four ", so as to read "four (4) municipal courts of concurrent jurisdiction ", etc. SECTION 2. That Section 29 -1, paragraph (b) is hereby amended as follows: - "(b) Such courts are hereby designated as 'Municipal Court in Corpus Christi, Texas - A'; 'Municipal Court in Corpus Christi, Texas - B'; 'Municipal Court in Corpus Christi, Texas - C'; and 'Municipal Court in Corpus Christi, Texas - D'. Municipal Court in Corpus Christi, Texas - B, is hereby designated and declared the 'corporation court' described in the city charter, Article II, section 27, and the judge, as hereinafter provided, appointed to said court, also and additionally here described as a 'municipal court,' pursuant to said Article 1194A, shall be qualified as specified by the city charter. The powers and duties of such courts shall be those defined or permitted by the laws of the State of Texas and the Charter and Ordinances of the City of Corpus Christi." SECTION 3. That Section 29 -4, paragraph (d) is hereby amended to read as follows: "(d) A judge of the municipal courts shall be nominated by the mayor and confirmed by a majority of the city council and shall hold office for a term of two (2) years, coterminous with the term of the appoint- ing city council, unless sooner removed, and until the successor, if any, is appointed and qualified." MICROFILMED 14283 SECTION 4. That Section 29 -4, paragraph (f) is amended to read as follows: "(f) Judges of Municipal Courts A, B and C shall serve full time. The judge of Municipal Court D shall serve as required by the pre- siding judge.. The presiding judge shall assure that a true night court functions regularly after sunset and no later than,midnight, unless exigent circumstances from time to time may otherwise dictate." SECTION 5. That Section 29 -13 is hereby changed to read as follows: "Sec. 29 -13. Dockets. "The clerk of the municipal court shall keep dockets with the proper court designations, in which shall be entered: (1) The number of the case. (2) The date of filing. (3) The name of the complainant. (4) The name of the defendant. (5) The nature of the offense. (6) The plea of the defendant. (7) Continuances. (8) The judgment of the court. (9) The amount of fine. (10) The total fine. (11) The amount paid by the defendants. (12) The amount for which the defendant was committed. (13) The amount remitted. (14) The date released. (15) The date of filing an appeal bond and the final disposi- tion on appeal. (16) Remarks." SECTION 6. That Section 29 -8 be amended by inserting the words, "and by State law" after the word "Charter ", so that the first sentence shall hereafter read as follows: "A substitute judge or judges of the municipal courts may from time to time be appointed as provided by the city charter and by state law with the confirmation of the city council."
