A RESOLUTION
ADOPTING MINUTE ORDER NO. 74221 PASSED BY THE STATE
HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION ON MARCH
27, 1978, PERTAINING TO TRAFFIC SIGNAL IMPROVEMENTS
ON OCEAN DRIVE, BETWEEN BUFORD STREET AND LOUISIANA
PARKWAY-, ALL AS MORE FULLY SET FORTH IN THE MINUTE
ORDER, A SUBSTANTIAL COPY'OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AUTHORIZING
THE C MY MANAGER TO EXECUTE AGREEMENTS WITH THE STATE
DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION
PROVIDING FOR THE. DEVELOPMENT AND COMPLETION OF SAID
PROJECT; AND DECLARING AN EMERGENCY.
WHEREAS, the State Department of Highways and Public Transportation
has submitted a copy of Minute Order No. 74221, passed by the State Highway
and Public Transportation Commission on March 27, 1978 as follows:
WHEREAS, in NUECES COUNTY, the City of Corpus Christi
has requested assistance in construction of Traffic
Signal Improvements on Ocean Drive between Buford
Street and East Louisiana Parkway; and
WHEREAS, the proposed improvements have been accepted
by the Federal Highway Administration for participation
in the Traffic Control Signalization Demonstration
Program; and
WHEREAS, Federal regulations for this program specify
that the Federal share payable shall not exceed 100%
of the funds allocated to the project; and
WHEREAS,'total Federal Aid available for this project
is limited to a fixed amount of $49,000 to include
the cost of preliminary engineering, construction and
a project evaluation report; and
WHEREAS, State funds are not available for this
project; and
WHEREAS, funds required for this project in excess of
available Federal Aid funds must be provided by the
City of Corpus Christi; and
WHEREAS, it is the desire of the State Department of
Highways and Public Transportation to assist the City
of Corpus Christi in such work;
NOW, THEREFORE, the Engineer- Director is directed to
tender the following proposal to the City of Corpus MICROFILMED
Christi for the development of the project:
Provided the City will:
1. Provide all required funds in excess
of available Federal Aid funds.
2. Maintain all work constructed as part
of the project, agree to regulate traffic
and prohibit parking and prevent en-
croachment on the right of way except for
situations where agreements between the
State Department of Highways and Public
Transportation and the City allow otherwise.

NOW, THEREFORE, the Engineer - Director is directed to tender the following proposal
to the City of Corpus Christi for the development of the project:
Provided the City will:
1. Provide all required funds in excess of available Federal Aid funds.
2. Maintain all work constructed as part of the project, agree to regulate
traffic and prohibit parking and prevent encroachment on the right of
way except for situations where agreements between the State Department
of Highways and Public Transportation and the City allow otherwise.
3. Furnish the State Department of Highways and Public Transportation with
necessary data to compile an evaluation report.
4. Prepare construction plans and specifications, in close cooperation with
the State Department of Highways and Public Transportation.
The State Department of Highways and Public Transportation will:
1. Assist in advance planning and preliminary engineering.
2. Assemble and process construction plans and specifications for letting.
3. Compile traffic data and prepare an evaluation report.
Upon acceptance of the provisions of this Order by the appropriate officials of
the City of Corpus Christi, the Engineer - Director is directed to enter into any
necessary agreements with the City of Corpus Christi covering the details of the
project and its cost, to proceed in the most feasible and economical manner with
advance planning, preliminary engineering and construction, financing the cost
with Federal Aid Traffic Control Signalisation Demonstration Program funds.
This Order shall become operative upon acceptance by the City of Corpus Christi
and if not accepted within 90 days of the date hereof, the action herein contained
shall be automatically cancelled.

NOW, THEREFORE, BE IT RESOLVED BY.THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Minute Order No. 74221, passed and approved by
the State Department of Highways and Public Transportation Commission March
27, 1978 pertaining to traffic signal improvements on Ocean Drive, between
Buford Street and Louisiana Parkway be and the same is hereby adopted by
the City of Corpus Christi, Texas.
SECTION 2. That the city manager be and he is hereby authorized
to execute agreements with the State Department of Highways and Public Trans-
portation providing for development and completion of the aforesaid project.
SECTION 3. The necessity to immediately adopt the aforesaid
Minute Order creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such
ordinance or resolution shall be read at three several meetings of the City
Council and the Mayor having declared that such emergency and necessity
exist, and having requested the suspension of the Charter rule and that
this resolution be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage, IT IS
ACCORDINGLY SO RESOLVED, thts the 26 _tk day of�Q fib. 1978.

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
