Mohawk Street from Blake Street to Morgan Avenue; 4. Aztec Street from Cheyenne Street to Blake Street; 5. Osage Street from Morgan Avenue to 300 feet south of Aztec Street; 6. Seminole Street from Blake Street to Morgan Avenue; 7. Rosewood Street from Blake Street to Morgan Avenue; w B. Reynosa Street from Burnet Street to Belton Street; 9. WHEREAS, the City Council of Corpus Christi, Texas, by duly enacted ordinance passed and approved on the 22nd day of March , 1978, determined the necessity for, and ordered the improvement of the following streets: 1. T�:]i,..b.lz r i'= w '� • ;��- 3y!�•••� z• 9` fl, ....`�,.�t, � ; • '4.' 4 4• S • AYµ .. _f - - c in the manner and according to the plans and specifications heretofore approved and adopted by the City Council by ordi- nance dated March 22 , 1978 , a duly executed notice of said ordinance having been filed in the name of the said City with the County Clerk of Nueces County, Texas; and WHEREAS, said City Council of the City of Corpus Christi, Texas, after having advertised for and received bids on the construction of said improvements for the length of time and in the manner and form as required by the Charter of said City and the laws of the State of Texas, and after having duly and regularly made appropriation of funds available for such purpose to cover the estimated cost of said improvements to said City, all as provided by the Corpus Christi City Charter and by law, did award a contract for the construction of said improve- ments to their lowest and most advantageous bid and said contract has been awarded to M & M Construction Company , as authorized by Ordinance No. 141A,91 , dated April 26 19 78, and the performance bond required by said contract has been pro- perly furnished by said contractor and accepted by the said City Council of said City as to form and amount as required by the Charter of said City and the laws of the State of Texas; and WHEREAS, the said City Council has caused the Director of Engineering and Physical Development to prepare and file estimates of the cost of such improvements and estimates of the amount per front foot proposed to be assessed against the property abutting upon a portion of the aforesaid streets within the limits herein defined, to be improved, and the real and true owners thereof, and said Director of Engineering & Physical Development has heretofore filed said estimates and a statement of other matters relating thereto with said City Council, and same has been received, examined and approved by said City Council; and 2 FkI .iie• e.,2y'�ib�.{ JTo-= : �.�t'?-`K1C. WHEREAS, said City Council, by duly enacted ordinance dated March 22 , 1978, did determine the necessity of levying an assessment for that portion of the cost of construct- ing said improvements on the above named streets, within the limits herein defined, to be paid by the abutting property and the real and true owners; thereof, and by ordinance dated March 22 1978, did order and set a hearing to be held at 7:00 P.M. on the 19 day of April 19 78, at ` Lozano School in the City of Corpus Christi, Texas, for the real and true owners of the property abutting upon said streets, within the limits above defined, and for all others owning or claiming any interest in, or otherwise interested - -in said property, or any of said matters as to-the assessments and amounts to be assessed against each parcel of abutting property and the real and true owner or owners thereof, and as to the special benefits to accrue to said abutting property by virtue of said improvements, if any, or concerning any error, invalidity, irregularity or deficiency in any proceedings, or contract, to appear and be heard in person or by counsel and offer evidence in reference to said matters; and the City Council did by said ordinance order and direct the City to give notice of said hearing to the owners abutting upon said streets as shown by the current ad valorem tax roll by mailing such notice to such owners and publishing said notice at least three times in the Corpus Christi Times before the date of the hearing, such notice of mail and by publication being in compliance with the provisions of Article 1105b of Vernon's Annotated Civil statutes of Texas; and WHEREAS, such notice was given said owners of property as shown on the current ad valorem tax roll within the limits of the streets being improved by mailing such notice at least four- teen (14) days prior to the hearing to such owners and by publish- ing three times notice of such hearing in the Corpus Christi Times, the first of which publication was at least twenty -one (21) days 3 �'!' PRESENT: Mayor Gabe Lozano, Sr. Council Members: David Diaz City Manager R. Marvin Townsend *Joe Holt City Attorney J. Bruce Aycock Tony Juarez City Secretary Bill G. Read Edward L. Sample Mayor Gabe Lozano, Sr. called the meeting to order at Lozano Elementary School and stated that the purpose of the meeting was to conduct a public hearing on the preliminary assessment roll for street improvements in the Lozano School area. City Secretary Bill G. Read called the roll of required Charter Officers and stated that the necessary quorum was present to conduct a legally constituted meeting. City Manager R. Marvin Townsend explained that the public hearing on paving assessments is required by law to obtain the property owners' comments pertaining to the assessments on the street improvement project. Mr. Townsend stated that the planned street improvement project is the result of voluntary paving petitions that have been filed on each of the various streets inclued in the project and the funds for the project were approved in the 1977 Bond Election. City Manager Townsend then asked City Attorney J. Bruce Aycock to preside in estab- lishing testimony in connection with the project. City Attorney Aycock stated that the State law requires that the amount of assessment for each property owner shall not exceed the value of the enhancement received from the improvements. He called as his first witness Mr. Gerald Smith, P.S., Chief Engineer in the Department of Engineering and Physical Development, City of Corpus Christi, Texas. City Attorney Aycock ascertained that Mr. Smith is a qualified Registered Engineer in the State of Texas and that he is familiar with the proposed project. Mr. Smith proceeded to explain the Lozano School area street improvement project, stating that this is a neighborhood street improvement project, which Minutes Special Council Meeting April 19, 1978 Page 2 includes the following streets: 1. Dunbar, Easley and Sonora Streets from Greenwood Drive to Blake Street; 2. Elgin, Sabinas and Blake Streets from Sonora Street to Baldwin Boulevard; 3. Mohawk Street from Blake Street to Morgan Avenue; 4. Osage Street from Morgan Avenue to 300 feet south of Aztec Street; 5. Aztec Street from Cheyenne Street to Blake Street; 6. Seminole Street from Blake Street to Morgan Avenue; 7. Rosewood Street from Blake Street to Morgan Avenue; 8. Reynosa Street from Burnet Street to Belton Street; and 9. Tasco Street from Sarita Street to State Highway 286. Mr. Smith further explained that voluntary paving petitions have been received on all of the streets; funds were included in the 1977 Bond Program; bids on the project were received on March 1, 1978; and the plans and specifications were prepared by the Department of Engineering and Physical Development. Mr. Smith informed the Council and the audience that the streets will be constructed tc a width and depth to permit the laying of a standard curb and gutter section, 6" compacted subgrade, 8" compacted caliche base and 1" Type "D" hot -mix asphaltic pavement, and that the streets will vary in width from 28' to 38' depend- ing on right -of -way and street usage. He also stated that 4' wide reinforced side- walks and 6" reinforced driveways will be constructed as shown on the construction plans or where requested by the property owner. Mr. Smith also stated that the amount of the assessments has been computed according to the City ordinance pertaining to the levying of assessments and that the maximum charge for residential property was computed at a rate of $4.75 per linear foot for curb, gutter and pavement, and $.75 per square foot for sidewalks. Chief Engineer Smith informed the audience that the low bidder on the project was M 6 M Construction Company in the amount of $626,504.49. *Council Member Holt arrived at the meeting at 7:15 p.m. Mayor Lozano inquired if anyone in the audience had any questions in regard to the construction as explained by Mr. Smith. An unidentified gentleman in the audience mentioned the drainage problem on Mohawk Street, and Mr. Smith replied that the plans call for the installation of 43 catch basins and various sizes of storm servers. City Manager Townsend suggested that the gentleman examine the plans, which were available, and discuss the drainage with members of the Engineering staff. Minutes Special Council Meeting April 19, 1978 Page 3 Another unidentified gentleman in the audience questioned the qualifications of the low bidder and inquired if it was the same contractor who had performed the work on the Austin School area street improvements, indicating that there were com- plaints following that particular street construction. Mr. Smith stated that two different companies, Asphalt Paving Company and Burtex Constructors, Inc., had performed the work in that area. He informed the gentleman that M & M Construction had not bid on any City projects in some time but that they are experienced in street construction in that they have constructed a number of streets for subdivision developments. Another unidentified gentleman urged careful inspection of the construction by City inspectors to assure that the - streets will be up to standard, and Mr. Smith assured him that City inspectors will be performing inspections at all times. Mr. Benito Clark, 674 Rosewood, asked if additional street lights will be installed in conjunction with these improvements. Mayor Lozano explained that the construction project will not include street lighting, but if there is a problem with the lighting, this will be reported to the staff. Mr. Clark reported that the street is particularly dark between Baldwin Boulevard and Sonora Street because the blocks are quite long. City Manager Townsend assured him that this problem will be investigated by the staff. A gentleman in the audience inquired about payment of the assessments, and Mayor Lozano explained that the property owners will have 60 months in which to pay their assessments, and payments will not be required until the project is completed. Mr. Smith further explained the payment policy and informed the property owners that the assessments may be paid in several different ways following comple- tion of the project, which will require 175 working days, or approximately 8 to 9 months. He stated that the property owner may pay the entire assessment in cash following completion of the project; or may take 60 months to pay the assessments, either on a monthly or yearly basis; and the inte -°-st charged is 514%. A gentleman in the audience mentioned that he understood that neighborhood improvement loans at 3% interest are available for this area and inquired if it E Minutes Special Council Meeting April 19, 1978 Page 4 would be possible to borrow money at this lesser interest to pay for assessments. City Manager Townsend agreed that there is a Federal program whereby resi- dents of this area could borrow funds at this interest rate, but such loans are handled by another department and'it is specified that these funds may be acquired for home improvements only. Mr. Smith summarized his testimony by stating that this project will begin about the middle of May; it should be completed in 8 or 9 months; and the contrac- tor is required to complete the streets in the immediate vicinity of Lozano School during the summer months to avoid conflicts with school traffic after the beginning of school. City Attorney Aycock called as his next witness, Mr. W. J. (Bill) Holly, Jr., a licensed Real Estate Broker in the State of Texas, and ascertained that Mr. Holly Is familiar with the area and had examined each and every piece of property to be assessed in connection with this street project. Mr. Holly testified that, in his opinion, each and every piece of property will be enhanced at least in the amount of the proposed assessment. He did state, however, that there are several pie- shaped lots abutting the streets to be improved on which he recommends the following reductions in assessments: 1. Items No. 103 & 178: Property bounded by Aztec (front), Seminole (side) and Blake (no improvements)- Recommended reduction in the total amount of $177.80. 2. Items No. 163, 188 & 227: Property bounded by Blake (side), Aztec (side) and Rosewood (front) Streets - Recommended reduction in the total amount of $38.65. 3. Items No. 164 & 238: Property bounded by Blake (side) and Rosewood (front) Streets - Recommended reduction in the total amount of $217.47. 4. Items No. 165 & 239: Property bounded by Blake (side) and Rosewood (front) Streets - Recommended reduction in the total amount of $86.12. 5. Item No. 167: Property bounded by Blake Street (to be improved) and Baldwin Boulevard - Total recommended reduction in the amount of $436.21. Mr. Holly also testified that a number of these properties are zoned higher than the use of the property and that he is recommending that each piece of property that is used as a residence be assessed as residential property at the lesser rate if the property owners of these particular lots ag -ee to have their property rezoned "R -lb" One - family dwelling district. He also stated that a few businesses exist on Minutes Special Council Meeting April 19, 1978 Page 5 property which is zoned for residential use rather than zoned for business and on these properties, he has recommended an increase in the assessments. City Manager Townsend explained the aforementioned zoning exceptions and stated that in the past, the Council has agreed to reduction of assessments in such instances providing the property owner agrees to accept a lower zoning of "R -1B ". He noted that in some cases, it would not be to the property owner's advantage to have their property zoned differently, and this will be explained to each owner affected. Council Member Holt stated that if the property owner desires to have their property rezoned in order to reduce the rate of assessment, the staff should ini- tiate the zoning change procedure without charge to the property owner. 'City Manager Townsend agreed that it should be accomplished in this manner and assured the Council that it had been done in this way in the past. Council Member Diaz cautioned the staff to very carefully explain the impli- cations involved in down- zoning property to each property owner, pointing out that it might not be to the property owner's advantage to have the zoning changed on some of the property. City Manager Townsend assured him that this would be clearly explained by members of the staff. Following this discussion, the Council indicated agreement to the suggested changes in assessments as recommended by Mr. Holly. Mr. Guadalupe Garcia, 3323 Aztec Street, mentioned the existence of water meters in the easement and the water lines that are located there. Mr. Victor Medina, P.E., who will serve as engineer on this project in the field, explained that this problem will be worked out. Mrs. Charles R. Schwabe, 637 Osage, also referred to the water lines in the alley and stated that it was her understanding that the lines will be relocated in the street and the meters placed in front of the property on this street. City Manager Townsend explained that if the existing water line is satis- factory, it will not be moved, but if the condition of the water line warrants the relocation of the line to the street, the City will accomplish this with no charge to the property owner, indicating that this also applies to relocation of gas lines. Minutes Special Council Meeting April 19, 1978 Page 6 Mr. Refugio Calderon, 3418 Aztec, stated that improvements are planned for this street but he did not receive a letter in regard to his assessments. Mr. Medina explained that the names of the property owners are obtained from the City's tax rolls, and it is possible that if the property has recently been sold, his name might not appear on the tax rolls as owner of this property. Mr. Smith also stated that this project contains 298 separate items, and it is conceivable that a few errors might have existed on the list of property owners obtained from the Tax Office. He suggested that Mr. Calderon contact one of the members of the staff present at the meeting to request a letter in regard to his assessments. Several other members of the audience indicated that they had not received letters and were assured that this oversight would be corrected. Mr. Smith explained that two types of driveways are planned as a part of the project and informed the property owners if they desire a different width driveway from the one specified for each piece of property, changes can be made. Mayor Lozano reiterated that members of the City staff will remain after the meeting to discuss individual problems. Mr. Smith then introduced the following City staff members who will be involved in the project: Mr. Victor Medina, Engineer in charge of the construc- tion; Mr. Bob Hobbs, one of the two inspectors assigned to the project; Mr. Marion Brown of the Voluntary Paving Division and his staff members, Mr. Dan Ambriz, Mr. Erasmo Garza, and Mr. Harry Maxim, all of whom will be working with the property owners. Mr. Smith then introduced Mr. Ron Young of M & M Construction Company. Mr. Jerry Darden, 2945 Carver, inquired if additional stop signs will be installed, pointing out the need for some type of traffic control at the inter- section of Dunbar and Carver Streets. City Manager Townsend replied that this construction project will not have anything to do with the traffic problems, but this location will be investigated by other staff members. Mr. Darden also mentioned a drainage problem that exists in the 2900 block of Carver, and Mr. Smith pointed out that The street will be lower than the exist- ing property, and hopefully, this problem will be alleviated. Minutes Special Council Meeting April 19, 1978 Page 7 Mayor Lozano thanked the citizens for attending the meeting and suggested that if they had other questions, they discuss them with Engineering staff members following the adjournment of the meeting. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there being no further protest or testi- mony for or against said improvements, said hearing granted to the real and true owners of abutting property on said streets, within the limits above defined, and to all persons, firms, corporations and estates, owning or claiming same or any interest therein, be acid the same is hereby closed and all protests and objections, whether specifically mentioned or not, shall be, and the same are hereby overruled and denied. SECTION 2. That said City Council hereby finds and determines upon the evidence heard in reference to each and every parcel or property abutting upon the aforesaid streets, within the 6 ,....Y>JC.� ' �^id.0 - }1'•, CAW z'• ^' �'. -r»b�'.,,vk..'.t't',. s a _'}•.- Y. -, r '-Kati- $', .x2 ,,.•4 %.7 .., •.+;�'+`.�- t�t'� =.`,. i ? .. wz., ?.sib limits defined, that the special benefits in the enchanced value to accrue to said property and the real and true owner or owners there- of, by virtue to the construction of said improvements to said portion of said streets upon which said property abuts, will be in excess of the amount of the cost of said improvements as proposed to be, and as herein assessed against said abutting property and the real and true owners thereof, and finds that the apportionment of the cost of said improvements, and that all assessments hereinbelow made are just and equitable and produce substantial equality con- sidering the benefits received and the burdens imposed thereby, and are in accordance with the laws of the State of Texas, and the Charter provisions of the City of Corpus Christi, Texas, and that the proceedings and contract heretofore had with reference to said improvements are in all respects regular, proper and valid, and that all prerequisites to the fixing of the assessment liens against said abutting properties, as hereinabove described and the personal liability of the real and true owner or owners thereof, whether named or correctly named herein or not, have been in all things regularly had and performed in compliance with the law, Charter provisions and proceedings of the said City Council. SECTION 3. Be it further'ordained that in the event the actual frontage of any property herein assessed shall be found upon the completion of said improvements to be greater or less than the number of feet hereinabove stated, the assessments herein set against any such property and against the real and true owner or owners thereof, shall be, and the same are hereby declared to be increased or decreased as the case may be, in the proportion which said excess or deficiency or frontage shall bear to the whole number of front feet of property actually improved in accordance with the front foot rule or rate of assessment here- in adopted, it being the intention that such parcel of property and the real and true owner or owners thereof abutting on the portion of the streets above described, within the limits defined, shall pay for said improvements under the "FRONT FOOT RULE OR PLAN ", which rule or plan is hereby found and determined to be just and equitable and to produce a substantial equality, having in view the special benefits to be received and the burdens imposed thereby; and it is further ordained that upon final completion and acceptance of said improvements on the aforesaid streets, within the limits defined all certificates hereinafter provided for, issued to evi- dence said assessments against said parcels of property abutting upon said street, and the real and -true owner or owners thereof shall be issued in accordance with, and shall evidence the actual frontage of said property and the actual cost of said improvements, the amount named in said certificate in no case to exceed the amount herein assessed against such property unless such increase be caused by an excess of front footage over the amount hereinabove stated, such actual cost and such actual number of front feet, if different from the hereinabove shown in Section 3 hereof, to be determined by the Director of Engineering & Physical Development upon comple- tion of said work on said street, and the findings of the Director 9 of Engineering & Physical Development shall be final and binding upon all parties concerned. SECTION 5. That the several sums mentioned above in Section 3 hereof assessed against said parcels of property abutt- ing on the aforesaid streets, within the limits defined, and the real and true owners thereof, whether named or correctly named herein or not, subject to the provisions of Section 4 thereof, together with interest thereon at the rate of five and one - quarter (5 1/4 %) per annum with reasonable attorney's fee and all costs and expenses of collection, if incurred, are hereby declared to be made a first and prior lien upon the respective parcels of property, against which same are assessed from and after the date said improvements were ordered by said City Council, to -wit: March 22 , 1978, and a personal liability and charge against the real and true owner or owners be named or correctly named here- in, and that said lien shall be and constitute the first and prior enforceable claim against the property assessed and shall be a first and paramount lien superior to all other liens, claims or title, except for lawful ad valorem taxes; and that the same so assessed shall be paid and become payable in one of the following methods-at the option of the property owner: 1. All in cash within 30 days after completion or accep- tance by City; or 2. Payments to be made in maximum of 60 equal install- ments, the first of which shall be paid within 30 days after the completion of said improvement, and the acceptance thereof by the City, and the balance to be paid in 59 equal consecutive monthly installments commencing on the 1st day of the next succeeding month until the entire sum is paid in full, together with interest from the date of said completion and accep- tance by the City, until paid, at the rate of five and 10 RR e% At— of Engineering & Physical Development shall be final and binding upon all parties concerned. SECTION 6. That said certificate shall further provide substan- tially that if default shall be made in the payment of any in- stallment of principal or interest when due, then at the option of the City, its successors, or assigns, or the holder thereof, the whole of said assessment evidence thereby shall at once become due and payable, and shall be collectible with reasonable attorney's fees and all expenses and costs of collection,' if incurred, and said certificate shall set forth and evidence the personal liability of the real and true owner or owners of such property, and that said lien is first and paramount thereon, superior to all other liens, titles and charges, except for law- ful ad valorem taxes, from and after the date said improvements were ordered by said City Council, to -wit: March 22 , 1978 , and shall provide in effect that if default shall be made in the payment thereof, the same may be enforced, at the option of.the City, or their successors and assigns, by the sale of the pro- perty therein described in the manner provided for the collection of ad valorem taxes as above recited, or by suit in any Court having jurisdiction. That said certificates shall further recite in effect that all the proceedings with refdrence to making said improvements have been regularly had in compliance with the law and Charter in force in said City and the proceedings of said City Council of said City, and that all prerequisites to the fixing of the assessment lien against the property therein described, or attempted to be described, and the personal liability of the real and true owner or owners thereof, evidence by such certificates, have been regular- ly done and performed, which recitals shall be evidence of all the matters and facts so recited and no further proof thereof shall be required in any Court. 12 That said certificates shall further provide in effect that the City of Corpus Christi, Texas, shall exercise all of its lawful powers, in the enforcement and collection thereof, and said certificates may contain other and further recitals, pertinent and appropriate thereto. It shall not be necessary that said certificates shall be in the exact form as above set forth, but the substance and effect thereof shall suffice. SECTION 7. That all such assessments levied are a personal liability and charge against the real and true owner or owners of the property described, or attempted to be described, notwithstanding such owner or owners may not be named or correctly named, and any irregularity in the name of the property owner, or the description of any property or the amount of any assessment, or in any other matter.or thing shall not in anywise invalidate or impair any assessment levied hereby or any certificate issued, and such mistake, or error, invalidity or irregularity whether in such assessment or in the certificate issued in evidence there- of, may be, but is not required to be, to be enforceable, at any time corrected by the said City Council of the City of Corpus Christi.
