AN ORDINANCE
AMENDING ORDINANCE NO. 13815, PASSED AND APPROVED ON
JULY 6, 1977, BY AMENDING SECTION 4 OF SAID ORDINANCE,
SO AS TO CORRECT AND ADJUST THE ASSESSMENTS LEVIED
AGAINST THE ABUTTING PROPERTY OWNERS ON THE FOLLOWING
STREET:
Kostoryz Road (M.H. 103) from State Highway 358
(Padre Island Drive) to Holly Road.
AS HEREIN PROVIDED; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That Ordinance No. 13815, passed and approved on
July 6, 1977, be amended by amending Section 4 of said Ordinance No. 13815
so as to correct and adjust the assessments levied against the abutting
property owners on the following street:
Kostoryz Road (M.H. 103) from State Highway 358
(Padre Island Drive) to Holly Road,
as more fully described in the corrected and adjusted assessment roll, a
substantial copy of which is attached hereto, marked Exhibit "A ", and
made a part hereof.
SECTION 2. The necessity to immediately amend the assessment
roll as herein set forth creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared such emergency and necessity to
exist, and having requested the suspension of the Charier rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this theme- •o- day of May, 1978.

FINAL ASSESSMENT ROLL
April 18, 1978
Kostoryz Road from Padre Island to Holly Road. Project
Number M R017(1).
This project included the construction of street improvements to the above named
street within the limits described. The improvements consisted of excavation to
a width and depth to provide for the construction of a roadway width varying from
61.0' to 76.0' back to back of curb. The roadway section consisted of 6" of lime
stabilized subgrade, 10" of caliche,base surfaced with 2" of asphalt. Standard
4" thick reinforced concrete sidewalks and 6" thick reinforced concrete driveways
according to the plans and specifications of the State Department of Highways and
Public Transportation were provided.
The project was built jointly by the City and the State Department of Highways and
Public Transportation. This was an assessment project and the abutting property
owners were assessed in accordance with the assessment policy of the City of Corpus
Christi. Based on the final construction quantity and the low bid as submitted
by Asphalt Paving and Construction Company, the assessments were as follows:
Curb, Gutter, & Pavement 14.25 L.F.
Sidewalk .75 S.F.
Driveway 1.89 S.F.
Header Curb' 4.37 L.F.
Total Contract Price 387,667.54
State /Federal Portion 277,721.80
City's Portion 109,945.74

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
