HomeMy WebLinkAbout14313 ORD - 05/10/1978jkh:5- 10 -78; 2nd :,1< . v AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF PJC PARTNERSHIP, BY GRANTING A SPECIAL PERMIT FOR AN APARTMENT COMPLEX, ACCORDING TO THE SITE PLAN ATTACHED HERETO AND MADE A PART HEREOF, SUBJECT TO THE CONDITIONS HEREINAFTER SET FORTH ON A 3.4 -ACRE PORTION OUT OF LOTS 18 AND 19, SECTION 13, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AS MORE FULLY DESCRIBED HEREIN- AFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. SAIEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of P.1C Par nerd_ for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday , May 10, 1978 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOM, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF '= CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, 'texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended b g OFl1ME0 making the change hereinafter set- out, h _ 14313 SECTION 2. That a Special Council Permit be granted on a 3.4 -acre portion of Lots 18 and 19, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, according to the site plan, for an apartment complex, all as more fully described on the site plan, attached hereto and made a part hereof, marked Exhibit "A ", and subject to all other conditions of "R -1B" One Family Dwelling District, said tract being more fully described as follows: Being a 3.4 -acre tract of land, more or less, out of Lots 18 and 19, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Plat Book "A ", pages 41, 42 and 43, Map Records of Nueces County, Texas, more fully described as follows: . BEGINNING at a point on the Southwest right -of -way line of Williams Drive for the North corner of Lot 1, Block 9, Gulfway Air- line Park Unit 1, a map of which is recorded in Volume 41, Page 42 of said Map Records and the East corner of this tract; THENCE South 29 000'00" West, along the Northwest boundary line of said Lot 1, Block 9, 160.00 feet'for the West.corner of said Lot 1 and the South corner of this tract; THENCE North 61 °00100 11•West, at 260.00 feet pass the common lot line of said Lots 18 and 19, in all a distance of 925.00 feet, more or Iess, to a point on the common boundary line of Lots 17 and 18 for the West corner of this tract; THENCE North 29 °00100" East, along said common boundary line of Lots 27 and 18, 160.00 feet to a point on said Southwest right -of -way line of Williams Drive for the North corner of this tract from which corner the North corner of said Lot 18, Section 23 bears North 29 000` 00" East 60.00 feet; THENCE South 61 °00 -00" East, along said Southwest, right -of -way line, parallel to the original centerline of Williams Drive thereof and 60.00 feet distant therefrom, measured at right angles thereto, 925.00'feet, more or less, to the POINT OF BEGINNING. In the event the Board of Adjustment grants any special exception or variance.to the Zoning Ordinance, applicable to the property included in the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit will be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Nap of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. -2- SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and of er its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of 1911 ATTEST: //1 d City Secretary L MAYOR APP D. • 4' � THE CITY Or —C-MUS CHRISTI, TEXAS !/vL DAY OF , 1976 J.
