AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
HUMPHREY ENTERPRISES BY AMENDING THE ZONING MAP BY
CHANGING THE ZONING ON TRACTS 1, 2, 5 AND 6, HARNEY
PARTITION, SITUATED IN THE CITY OF CORPUS CHRISTI,
NUECES COUNTY, TEXAS, FROM "F -R" FARM -RURAL TO "R -1B"
ONE- FAMILY DWELLING DISTRICT ON PARCEL A OUT OF TRACTS
1, 2, 5, AND 6; TO "B -1" NEIGHBORHOOD DISTRICT ON PARCEL
B OUT OF TRACTS 5 AND 6; TO "A -1" APARTMENT HOUSE
DISTRICT ON PARCEL C OUT OF TRACT 5, AND TO R -2 MULTIPLE
DWELLING DISTRICT ON PARCEL D OUT OF TRACTS 5 AND 6;
KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING
ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City
Council its reports and recommendations concerning the application of
Humphrey Enterprises for amendment to the
zoning map of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before
the City Council of the City of Corpus Christi, in accordance with proper
notice to the public, said public hearing having been held on May 17
1978 , at Special Council Meeting of the City
Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
WHEREAS, by motion duly made, seconded and carried, it was
decided by the City Council that to approve the hereinafter set forth
amendment would best serve public health, necessity and convenience and
the general welfare of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1.• That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed'on the 27th day of August, 1937, appearing of
record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution
Records, as amended from time to time, and in particular as amended by [�
Ordinance No. 6106, as amended, be and the same is hereby amended bmiGROFILMED

SECTION 2. That the zoning on Tracts 1,-2, 5 and 6, Harney Partition,
situated in the City of Corpus Christi, Nueces County, Texas, be and the same
is hereby changed from "F -R" Farm -Rural to 11R -1B" One- Family Dwelling District
on Parcel A out of Tracts 1, 2, 5, and 6; to "B -1" Neighborhood District on
Parcel B out of Tracts 5 and 6; to "A -1" Apartment House District on Parcel
C out of Tract 5, and to 11R -2" Multiple Dwelling District on Parcel D out of
Tracts 5 and 6, being more particularly described as follows:
PARCEL A
Field note description for 103.93 acres of land, more or less,
out of Tracts 1, 2, 5, and 6, Harney Partition, as shown by
plat recorded in Nueces County Map. Records, .Volume 6' Page 29,
and further described as.-follows: ,
Beginning at the easternmost corner"of said Tract 5, said
corner being in the southwest right of way line of Leopard
Street for the point of beginning of this 'tract;
Thence S10027'43 "W 1539.94' along the northeasterly boundary
line of said Tract 5 and the northwesterly boundary of Tract
X of the C. C_ Hart Partition, Nueces County, Texas, for an
easterly corner of this tract;
Thence S40012'44 "W 1144.70' along the southeasterly boundary
of said Tract,5 and along the southwesterly boundary line of
said Tract X of the C_• C. Hart Partition, to a point at the
southernmost corner of said Tract 5 for an easterly corner of
this tract;
Thence N53o34'36 "W 246.94' along a southerly boundary line of
said Tract 5 and a southwesterly boundary line of said Tract
I of the C. C_ Hart Partition, to a point at the easternmost
corner of said Tract 1, Harney Partition, for an interior
easterly corner-of this tract;

of said Tract is Harney Partition, to a point at the southern-

southernmost corner of this tract;

westernmost corner of this tract, said westernmost corner
being in the southwest boundary line of said Tract 2;

Beginning at a point in the southwest right -of -way line of -
Leopard Street, said point being the northeast corner of said
Tract 5 and point of beginning of this tract;
Thence S10o27'43 "W-406.23' along the northeasterly boundary of
said Tract 5 to a point for the southernmost corner of this tract;
Thence N62027'16 "W 339.25' to a point in said Tract 5 for the
westernmost corner of tfiis tract;
Thence N37026'45 "E 75.20' to a point iii said Tract 5 for an
interior westerly corner of this tract;
Thence N15035'12 "E 268.80' through the common boundary line between
said Tracts 5 and 6 to a point in said Tract 6 for a westerly
corner of this tract;

Harney Partition, as shown by plat recorded in Nueces County .

metes and bounds as follows:
Beginning at a point located in the eastern boundary line of
said Tract 5, said point bearing S10027'43 "W 406.23' from the
northeast corner of said Tract 5, said northeast corner of
said Tract 5 being in the southwest right -of -way line of Leopard
Street;
Thence S10027143 "W 310.81' to a point for the southernmost
corner of this tract;
Thence N64022'03 "W 485.50' to a point.in said Tract 5 for the
westernmost corner of this tract;

northernmost corner of this tract;

Field note description for 3.747 acres of land, more or less,
out of Tracts 5 and 6, Harney Partition, as shown by plat
recorded in Nueces County Map Records, Volume 6, Page 29,
and more fully described as follows:
Beginning at a point located in the eastern boundary line
of said Tract 5,, said point bearing S10027'43 "W 717.04'
from the easternmost corner of said Tract 5, said easternmost
corner of said Tract 5 being in the southwest right of way
line of said Leopard Street.
Thence sl0027'43 "W 259.03' along the easterly boundary line
of said Tract 5 to a point for the southernmost corner of this
tract;
Thence N64o22103 "W at 698.78' pass the common boundary line
between said Tracts 5 and 6, in all a distance of 712.85'
to a point in said Tract 6 for the westernmost corner of this
tract;
Thence N37026'45 "E 255.41' to a point in said Tract 6 for the
northernmost corner of this tract;
Thence S64022'03 "E at 14.12' pass the common boundary line
between said Tracts 5 and 6, in all a distance of 592.77'
to the point of beginning.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as
amended from time to time, except as herein changed, shall remain in full
force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That -the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or•Yesolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that
such emergency and necessity exist, and having requested the suspension

of the Charter rule and that this ordinance be passed finally on the
date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /7

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing ordinance,
a public emergency and imperative necessity exist for the suspension of the
Charter rule or requirement that no ordinance or resolution shall be passed
finally on the date it is introduced, and that such ordinance or resolution
shall be read at three meetings of the City Council; I, therefore, request
that you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of the City
Council.
