HomeMy WebLinkAbout14331 ORD - 05/24/1978JKH:hb:5 /22/78 AN ORDINANCE FINDING THAT A PUBLIC STREET DANCE ON SATURDAY, JUNE 3, 1978 IS IN THE PUBLIC INTEREST AND WELFARE; CLOSING THE 400 BLOCK OF LAGUNA STREET AND THE 100 AND 200 BLOCKS OF NORTH "MESQUITE STREET TO VEHICULAR TRAFFIC FROM 8:00 P.M., SATURDAY, JUNE 3, 1978 TO 1:00 A.M., SUNDAY, JUNE 4, 1978, FOR SAID STREET DANCE SPONSORED BY KEYS RADIO; PROVIDING FOR BARRICADES, AND EMERGENCY VEHICLE ENTRANCE, LIABILITY INSURANCE, RESTORATION OF DAMAGED CITY PROPERTY, CROWD SECURITY, AND PUBLIC RESTROOMS; PROHIBITING THE SALE OR DISTRIBUTION OF ALCOHOLIC BEV- ERAGES AND THE DEFACEMENT OF PUBLIC PROPERTY; REQUIRING THE SPONSOR TO RESTORE THE AREA FOR USE BY VEHICULAR TRAFFIC; AUTHORIZING THE CITY MANAGER TO EXECUTE THE ATTACHED APPLICATION /PERMIT; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR PUBLICATION; PROVIDING FOR SEVER- ANCE; AND DECLARING AN EMERGENCY. WHEREAS, KEYS Radio has formulated plans for a public street dance to -be held on Saturday, June 3, 1978; and WHEREAS, the purpose of said public street dance is to provide public recreation to the youth of Corpus Christi and develop positive contact with that group; and WHEREAS, KEYS Radio has requested that from 8:00 P.M. Saturday, June 3, 1978 to 1:00 A.M. Sunday, June 4, 1978, the 400 block of Laguna Street and the 100 and 200 blocks of North Mesquite Street be closed to vehicular traffic; and WHEREAS, the City Council finds that the proposed public street �c danc� will be in the public interest and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That vehicular traffic be barred from the 400 block of Laguna Street and the 100 and 200 blocks of North Mesquite Street from 8:00 P.M., Saturday, June 3, 1978 to 1:00 A.M., Sunday, June 4, 1978, so that KEYS Radio can sponsor a public street dance, and that said areas be barricaded to through traffic. It is directed that said areas be barricaded so as to allow emergency vehicles, such as fire, police and ambulance vehicles to enter said areas in case of an emergency. It is further provided that vehicles of the City or utility companies furnishing public utilities, R- 0 ILMED' 6JUL 0 81980 14331 such as electrical, gas, water and telephone service to said areas be permitted to enter said areas in case of emergency. SECTION 2. That in maintaining the streets closed by this ordinance, the following regulations shall be observed: A. Liability insurance shall be furnished free of cost to the City protecting against liability to the public. Such insurance shall have policy limits of at least $100,000 personal injury up to $300,000 per accident, and $50,000 property damage, and shall name the City of Corpus Christi, Texas and KEYS Radio as insureds. A Certificate of Insurance in the above amounts shall be furnished to the City Secretary and approved by the -City Attorney with the application and permit provided for hereinafter. Also, KEYS Radio shall save and hold the City harmless from any liability or damages arising out of said street closure. B. Any damages to city property will be restored by the sponsor of the said public street dance promptly after the close of said dance. C. No alcoholic beverages will be sold or provided at said public street dance. D. Restrooms will be provided by KEYS Radio. E. No paint or markings shall be permitted which in any way obliterate or deface any pavement markings or traffic control devices here- tofore existing for the guidance and direction of motor vehicles and pedes- trian traffic. F. Sponsor shall provide and erect street barricades in accordance with a barricade plan as determined and approved by the Director of Traffic and Transit. Such barricades, except for periods of emergency, shall be so maintained during the full period of the public street dance described herein. G. Sponsor shall provide adequate security forces for crowd control and the protection of persons and property. H. After the public street dance ends, the "sponsor will see that the streets are cleaned and restored to a condition to allow vehicular traffic to return to the streets at the expiration of the public street dance. SECTION 3. That the City Manager is hereby authorized to execute the attached application /permit for and on behalf of the City, which shall be filed for record in the office of the City Secretary. -2- SECTION 4. That the provisions of this ordinance relating to closing of the aforementioned streets are effective for the period beginning at 8:00 P.M., Saturday, June 3, 1978, to 1:00 A.M., Sunday, June 4, 1978. -The other provisions of this ordinance are effective from and after the date of publication of the caption of this ordinance in the official publication of the City one time. However, no part of this ordinance shall be effective until the City Manager and the authorized representative of the sponsoring organization execute the aforementioned application /permit, and the Certi- ficate of Insurance is approved and filed. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 7. The necessity to close the 400 block of Laguna Street and the 100 and 200 blocks of North Mesquite street, for a street dance sponsored by KEYS Radio creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its intro- duction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the elkday of ` 1978. Marvin Townsend, City Manager, for the closing to vehicular traffic of the 400 block of Laguna Street and the 100 and 200 blocks of North Mesquite Street from 8:00 P.M. Saturday, June 3, 1978 to 1:00 A.M., Sunday, June 4, 1978, for the purpose of sponsoring a public street dance. In consideration of the closing of said streets, KEYS Radio agrees to perform the following conditions: 1. No alcoholic beverages will be provided. 2. To be responsible for cleanup of the area and returning the streets and sidewalks to pre -event condition by 1:00 A.M., Sunday, June 4, 1978. 3. To not obliterate or deface any pavement markings or traffic control devices heretofore existing for the guidance and direction of motor vehicles and pedestrian traffic. 4. To provide public restrooms. 5. To file with the City Secretary, at KEYS Radio sole expense, a certificate of public liability insurance in a form to be approved by the City Attorney and naming the City as an additional insured, and providing coverage for personal injury of $100,000 up to $300,000 for each accident and $50,000 property damage. 6. To provide for the control of traffic*to and around the above described area. 7. To allow emergency vehicles to use such areas as may be required during the event. 8, To provide adequate control of parking in the area. 9. To insure sound level control suitable to the area. 10. To provide street barricades in accordance with a barricade plan adopted and approved by the Director of the Department of Traffic & Transit. 11.
