HomeMy WebLinkAbout14352 ORD - 06/07/1978JKH:hb:6 /5/78 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WOODLAND CREEK DEVELOPERS BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A (3.218 ACRES)AND TRACT B (3 193 ACRES) OUT OF TRACT I AND II OF THE C.C. HART PARTITION SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES C UNTY, TEXAS, FROM "R -1B" ONE - FAMILY DWELLING DISTRICT TO TRACT A - B7f-1-w- NIGH- BORHOOD BUSINESS DISTRICT, TRACT B - R -2" MULTIPLE DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PRO- VISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of WOODLAND CREEK DEVELOPERS for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday June 7, 1978 at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amendedUR-QFILMED making the change hereinafter set out. rJUC v o .> Iy�GL 14352 u w SECTION 2. That the zoning on Tract A (3.218 acres) and Tract B (3.193 acres) out of Tract I and II of the C. C. Hart Partition, situated in the City of Corpus Christi, Nueces County, Texas and more particularly described hereinafter: .'TRACT A Being 3.218 acres of land, more or less, out of Tracts I and II of the C. C. Hart Partition as recorded in Volume 293, Page -42.5 of the deed records of Nueces County and as shown by map recorded in Volume 289, Page 24 of the deed records of Nueces County and further described by metes and bounds as follows: Beginning at a point in the southwest right -of -way line of Leopard Street, said point being the northeast corner of Tract 5 of the Harney Partition as shown by plat recorded in Volume 6, Page 29 Nueces'County Map Records for the northernmost corner of this tract; Thence S56026'56 "E along the southwest right -of -way line of said Leopard Street at 251.50' pass the common point being the northeast corner of said Tract I and northernmost corner of said Tract II in all a distance of 502.81' to a point for the north- east corner of this tract; Thence S17037'17 "W 223.25' along the northeasterly boundary of said Tract II to a point for the southeast corner of this tract; Thence N72022'45 "W 100.00' to a point in said Tract II for an interior southerly corner of this tract; Thence N79032'17 "W at 123.38' pass the common boundary line between said Tracts I and II in all a distance of 335.49' to a- point in the northeast boundary line of said Tract 5 for the southwest corner of this tract; Thence N10127'43 "E 406.23' along the northeast boundary line of said Tract 5 to the'point of beginning. 'TRACT B 1 Being 3.193 'acres of.land, more or less, out of Tract I & II of 'the C. C. Hart Partition; as recorded in Volume 293, Page 425 of the Deed Records of Nueces County and as shown by map recorded in Volume 289, Page 24 of the Deed- Records of said County and further described by metes and bounds as follows: Beginning at a point in the northeast boundary line of Tract 5, Harney Partition, as shown by plat recorded in Volume 6, Page 29, Nueces County Map Records, said point being located S10027143 "W 406.23' from the northeast corner of said Tract 5; Thence S79032'-17 "E at 212.11' pass the common boundary line between said Tract I and II in all a distance of 275.02' to a point in said Tract II for the easternmost corner of this tract; Thence S17o37'17 "W 585.05' to a point in said Tract II for the southernmost corner of this tract; Thence N79032'17 "W at 26.32' pass the common boundary line between said Tracts I and II in all a distance of 162.85' to a point in said Tract I for an exterior southwesterly corner of this tract; -2- . Thence N64o22'03 "W 40.67' to a point in the northeast boundary line o£ said Tract 5 for the southwest corner of this tract; Thence N10027'43 "E 575.86' along the northeast boundary line of said Tract 5 to the point of beginning. be and the same is hereby changed from "R -1B" One - family Dwelling District to "B -1" Neighborhood Business District for Tract A and to "R -2" Multiple Dwelling District for Tract B. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. . SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or-resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension -3- of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the Z_ day of June 19 78.
