AN ORDINANCE ANNEXING THREE PARCELS OR TRACTS OF LAND, MORE FULLY DESCRIBED HEREINAFTER, BUT GENERALLY DESCRIBED AS FOLLOWS: (A) SARATOGA BOULEVARD FROM CABANISS FIELD TO GREENWOOD DRIVE, (B) NUECES BAY BOULEVARD FROM MARTIN LUTHER KING DRIVE (I.H. 37) TO A LINE BETWEEN NUECES AND DEMPSEY STREETS, AND (C) THE PORTION OF LAGUNA MADRE BETWEEN THE EXISTING CITY LIMITS AND PADRE ISLAND SOUTH OF THE-PADRE ISLAND CAUSEWAY AND THE CITY'S WASTEWATER TREAT- MENT PLANT ON PADRE ISLAND, PURSUANT TO ARTICLE 970a, V.A.C.S, TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR THE ANNEXATION TO THE CITY OF CORPUS CHRISTI OF ROADS, HIGHWAYS, AND STREETS ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; PROVIDING FOR SEVERA- BILITY; AND DECLARING AN EMERGENCY. WHEREAS, on the 14th day of June, 1978, a public hearing was duly held at the Regular Council Meeting of the City Council, following publica- tion of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of proceed- ings for the annexation of a defined area wholly within the extraterritorial jurisdiction of Corpus Christi, including the portion of Corpus Christi Bay south of the ship channel near Aransas Pass and Port Aransas and the portion of Laguna Madre between the existing city limits and Padre Island south of the Padre Island Causeway and the City's Wastewater Treatment Plant on Padre Island, as well as "Saratoga Boulevard from Cabaniss Field to Greenwood Drive and Nueces Bay Boulevard from Martin Luther King Drive (I.H. 37) to a line between Nueces and Dempsey Streets, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed on June 14, 1978; and WHEREAS, it has been determined by the City Council that the terri- tory above mentioned, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of Corpus Christi and constitutes lands and territories used for public purposes and which is owned by any governmental subdivision, or dedicated to a public use within the meaning of, the City Charter, Article I, Section 2(c); and VMICROALMED 143'7 JUL 0 8 wo WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid hereinafter more fully described area: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed a portion of Saratoga Boulevard, Nueces Bay Boulevard, and a portion of the Laguna Madre, and the City's Wastewater Plant on Padre Island, all more fully described hereinafter as follows as Parcels A, B and C, respectively: PARCEL A Being a tract of land out of Lots 1 & 8, Section 13, Lots 1 & 8, Section 14, and Lots 4 & 5, Section 8, Lots 4 & 5, Section 7, all in Bohemian Colony Lands as shown by map of record in Volume A, Page 48, Map Records, Nueces County, Texas, and being a portion of Saratoga Boulevard outside the City Limits, and more particulary described by metes and bounds as follows: Beginning at a point in the south right -of -way line of Saratoga Boulevard, said point being in the present City Limit line as established by City Ordinance No. 9270 for the beginning point of the tract of land herein described; Thence North 61 °30'00" West along the south right -of -way line of said Saratoga Boulevard, pass the common east boundary line of said Lot 1 and the west boundary line of said Lot 8 at 604.50 feet plus or minus, in all a distance of 3194.50 feet to the point of intersection of the south right -of -way line of said Saratoga Boulevard and the east right -of -way line of Ayers Street; Thence South 29 °00'00" West along the east right -of -way line of said Ayers Street a distance of 200.00 feet to a point; Thence North 61 030'00" West a distance of 120.00 feet across said Ayers Street to a point of the west right -of -way line of said Ayers Street; Thence North 00 °03'10" East along the southwest right -of -way flare -out of said Saratoga Boulevard, a distance of 227.26 feet to a point; " Thence North 61 °30'00" West continue along the south right -of -way line of said Saratoga Boulevard a distance of 4881.00 feet to a point, said point being in the present City Limit line as established by City Ordinance No. 9270, and being the point of intersection of the south right -of -way line of said Saratoga Boulevard and the east right -of -way line of Greenwood Drive; Thence in a northerly direction cross said Saratoga Boulevard with the present City Limit line to a point being the intersection of the north right -of -way line of said Saratoga Boulevard and the east right -of -way line of Greenwood Drive; Thence in an easterly direction along the north right -of -way line of said Saratoga Boulevard and its flare -out, being also the present City Limit line a distance of approximately 8275.00 feet to a point being a corner in the present City Limit line; Thence in a southerly direction cross said Saratoga Boulevard with the present City Limit line to the Place of Beginning and containing 28.0 acres, more or less. PARCEL B Being a portion of Nueces Bay Boulevard that is not within the present City Limits: Beginning at a point in the present City Limit line, said point being the northwest corner of Lot 239, Baymoor Addition, as shown by map of record in Volume 4, Page 42, Map Records, Nueces County, Texas, and also being the point of intersection of the north right -of -way line of Interstate Highway No. 37 and the present City Limit line; Thence South 56 °26'42" East along the north right -of -way line of said Interstate Highway No. 37, with the present City Limit line a distance of 28.05 feet to a point for the beginning point of the tract of land herein described; Thence South 65 °54'15" East along the north right -of -way line of said Interstate Highway No. 37 a distance of 35.15 feet to a point; Thence North 74 °18'03" East along the northwest flare -out of said Interstate Highway No. 37 right -of -way a distance of 58.39 feet to its intersection with the west right -of -way line of 80.0 foot wide Nueces Bay Boulevard; Thence North 34 °30'20" East along the west right -of -way line of said Nueces Bay Boulevard a distance of 48.42 feet to an angle point; Thence North 31 °43'20" East continue along the west right -of -way line of said Nueces Bay Boulevard a distance of 2240.0 feet, more or less, to the point of intersection with the west line of the original City Limit line as surveyed by C. F. von Blucher in August, 1883; Thence in a southeasterly direction cross Nueces Bay Boulevard with the present City Limit line to a point on the east right -of -way line of said Nueces Bay Boulevard; Thence in a southwesterly direction along the easterly right -of -way line of said Nueces Bay Boulevard with the present City Limit line a distance of 2200.0 feet, more or less, to a point in said Interstate Highway No. 37 right -of -way and a corner in the present City Limit line; Thence in a westerly direction with the present City Limit line a distance of 780.0 feet, more or less, to the Place of Beginning and containing 4.20 acres, more.or less. .' The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter of the City of Corpus Christi and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, -4- phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The necessity to immediately annex to the City of Corpus Christi the aforesaid lands and to declare that they shall hereafter be a part of the corporate limits of the City of Corpus Christi, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the a d day of June, 1978.
