BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 7.29+ ACRE TRACT OF LAND OUT OF THE A.M. FRENCH TRACT , SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "RA B" ONE- FAMILY DWELLING DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Gibralter Savings for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday July 12, 1978 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 0��j�� ..gg Jv �14a3� r3 SECTION 2. That the zoning on a 7.29+ acre tract of land out the A. M. French Tract, situated in the City of Corpus Christi, Nueces County, Texas and more particularly described hereinafter: FXELDNOTES for 7.289 acres of land proposed for A -2 zoning out of the A.M. French 237 acre tract out of Survey 417,-Abstract No. 571; said 237 acre tract recorded in Volume 165, Page 265, deed records of Nueces County, Texas; BEGINNING at a point on the South subdivision line of Bervonne Terrace, a map of which is recorded in Volume 16, Page 6, map re- cords of Nueces County, Texas for the Northeast corner of this tract from which corner the Southeast corner of Lot 38, Block 4, Bervonne Terrace bears South 80 °49130" East 15.23 feet, more or less; THENCE in a South direction, along the proposed West right -of- way line of McKinile Road parallel with the original centerline thereof and 50.0 feet distant therefrom with a circular curve to the left whose radius point bears North 89 °32'50" East 955.10 feet and which has a central angle of 21 °02150 ", a radius of 955.10 feet, a tangent distance of 92.36 feet, 184.15 feet to the point of tangency; THENCE South 1I °30100" East, with said proposed right -of -way, 165.33 feet to the point of curvature of a circular curve to the right whose radius point bears South 78 °30'00" West 10.0 feet and which has a central angle of 90 100100 ", a radius of 10.00 feet, a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE with said curve to the right, 25.71 feet for the point of tangency and the point of curvature of another circular curve to the right whose radius point bears North 11 °30'00" West 707.86 feet and which has a central angle of 11 °36'28 ", a radius of 707.86 feet, a tangent distance of 71.95 feet and an arc length of 143.41 feet; THENCE with said curve to the right, 143.41 feet for the point of tangency; THENCE North 89 °53'32" West 534.45 feet to the point of curvature of'a circular curve to the left which has a central angle of 04 °25'12 ", a radius of 840.54 feet, a tangent distance of 32.44 feet and an arc " length of 64.84 feet; THENCE with said curve to the left, 64.84 feet for the point of tangency and the point of curvature of another circular curve to the right which has a central angle of 04 °25112 ", a radius of 840.54 feet, a tangent distance of 32.44 feet and an arc length of 64.84 feet; THENCE with said curve to the right, 64.84 feet for the Southwest corner of this tract; THENCE North 09 °10'30" East 491.36 feet to a point on the South subdivision line of said Bervonne Terrace for the Northwest corner of this tract; THENCE South 80 °49'30" East, along said subdivision line, 692.68 feet to the POINT OF BEGINNING. be and the same is hereby changed from "R -W' One- Family Dwelling.District to "A -1" Apartment House District. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as 0 amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose.of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ice_ day of � . , 19 ) 115.
