HomeMy WebLinkAbout14391 RES - 07/19/1978jkh:7 -19 -78 A RESOLUTION WHEREAS, the last session of the Texas Legislature considered but did not pass a bill relating to the operation of motor vehicles on public beaches; and WHEREAS, the City Council previously passed Resolution No. 13713 opposing passage of this bill; and WHEREAS, the bill would have eliminated motor vehicle traffic on all beaches in the State and thereby severely restrict access to miles of beaches by those citizens unable to own homes or condominiums on or near public beaches; and WHEREAS, passage of such a bill would require construction of parking lots for the thousands of motor vehicles using public beaches and the provision of transportation to other beach visitors; and WHEREAS, the cost of construction of such parking lots and the provision of transportation would be exorbitant and a burden on the taxpayers of the State; and WHEREAS, the construction of sufficient parking areas and access of the beaches would also result in severe damage to the dune system on Padre and Mustang Islands which protects the islands and portions of the Coastal Bend area from tide erosion and tropical storms; and , WHEREAS, Nueces County presently provides adequate regulation and control of beach traffic for the safety of those citizens using the beaches as authorized by State law; and WHEREAS, because the expanse, access to, and proximity to population centers of beaches vary between each county and municipality along the Gulf Coast, statewide regulation is impractical and beach traffic regulation is best left to the counties and municipalities of the Texas Gulf Coast; and WHEREAS, the session of the Legislature beginning January 1, 1979 may consider such a bill again, and it is imperative that the City Council of the City of Corpus Christi make known again its views concerning such a bill in a timely manner: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: ,,MICROFILMED iJUL 0 8 Igg- 14391 SECTION 1. That the City Council of the City of Corpus Christi strongly opposes the passage of any legislation which would limit access to public beaches by prohibiting motor vehicle traffic thereon and firmly believes that such regulation should remain with the counties and munici- palities along the Texas Gulf Coast; and expresses further opposition because the construction of beach parking lots which would be made necessary by passage of such a bill would be detrimental to the ecology of many Gulf Coast beaches, particularly Padre and Mustang Islands. SECTION 2. That the City Secretary is hereby instructed to send true copies of this Resolution to the Nueces County Commissioners Court. SECTION 3. The necessity to make the City Council's opinion on traffic on public beaches known creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspen- sion of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the__Lj_day of July, 1978.
