HomeMy WebLinkAbout14394 ORD - 07/19/1978jkh:7 -12 -78 -1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 3. DEFINITIONS. SUBSECTION 3 -1.26 FLOOR AREA FACTOR "R -1B" ONE FAMILY DWELLING DISTRICT FROM 7 TO 7.26; "R -2" MULTIPLE DWELLING DISTRICT FROM 14 TO 14.52; "A -1" APARTMENT HOUSE DISTRICT FROM 21 TO 21.78; "A -2" APARTMENT HOUSE DISTRICT FROM 34 TO 36.3; "AT" APARTMENT - TOURIST DISTRICT FROM 43 TO 43.56; "AB" PROFESSIONAL OFFICE DISTRICT FROM 34 TO 36.3; "B -lA" TOURIST COURT DISTRICT FROM 43 TO 38.72;' "B -1" NEIGHBORHOOD BUSINESS DISTRICT FROM 34 T0,36.3;. "B -2" BAYFRONT BUSINESS DISTRICT FROM 43 TO 43.56; "B -4" GENERAL BUSINESS DISTRICT FROM 34 TO 36.3;_- DELETING THE SECOND SENTENCE OF THE TWO- ASTERISK NOTA- TION BELOW THE CHART; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCFSIN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi, Texas; and w WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, July 12, 1978, at Special Council Meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment MICROFILMED �UL 081980 14394 would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: 'NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the changes hereinafter set out. SECTION 2. That Article 3, Definitions, be amended by amending Subsection 3 -1.26 Floor Area Factor by deleting the word "land" and substitut- ing therefor the word "lot ", said subsection to hereafter read as follows: "3 -1.26 Floor Area Factor. The floor area factor is multiplied by lot area to determine the permitted floor area." SECTION 3. That Article 24, Height, Area and Bulk Requirements, be amended by amending the chart as follows: A. Add the phrase "of lot area" to the heading of Column 6, said heading to hereafter read as follows: "Maximum Square Foot of Floor Area Per Acre of Lot Area ". B. Add the phrase "of lot area" to the heading of Column 8, said heading to hereafter read as follows: "Maximum Number of Units Per Acre of Lot Area ". C. Amend the heading of Column 9 by deleting the words "Total Land" and substituting therefor the words "Lot Area ", said heading to hereafter read as follows: "Yard, Open Space (in % of Lot Area) ". D. Change the maximum number of units per acre of lot area for the following zoning districts as hereinafter provided: (1) "R -16" One Family Dwelling District from 7 to 7.26. (2) "R -2" Multiple Dwelling District from 14 to 14.52. (3) "A -1" Apartment House District from 21 to 21.78. (4) "A -2" Apartment House District from 34 to 36.3._ -2- (5) "AT" Apartment- Tourist District from 43 to 43.56. (6) "AB" Professional Office District from 34 to 36.3. (7) "B -1W Tourist Court District from 43 to 38.72. (8) "B -1 "Neighborhood Business District from 34 to 36.3. (9) "B -2" Bayfront Business District from 43 to 43.56. (10) "B -4" General Business District from 34 to 36.3.; E. Amend the two - asterisk notation below the chart by deleting the second sentence in its entirety. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 6. That the necessity of immediately making the aforesaid changes for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this the /I day of July, 1978.
